This regular monthly meeting of the City Council is called to order by
His Honor Kenneth L. Petersen, Mayor Pro-tempore.
Present: Council Member's: GoergeT. Duffin, WilTordE.'Jordan,Charles
F. Quartiroli, Everett C. Wentworth, and Kenneth L~ Petersen.
Absent: Council Members: Norman B. Goodrich and Sig Sanchez.
The Mayor Pro-tempore calls for the opening of 'bIds for construction

on the official plan lines on Tenth Street from Monterey to Princevalle Streets.
The Mayor Pro-tempore asks if anyone in the audience wishes to speak for or against
the proposal. There is no comment.
The City Attorney presents and reads Resolution No. 623. Motion by Council-
man Wentworth second by Councilman Goodrich that Resolution No. 623 be adopted.

RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY APPROVING AND ADOPTING OFFICIAL
PLAN LINES FOR TENTH STREET BETWEEN PRINCEVALLE STREET AND ALEXANDER STREET.
PASSED AND ADOPTED this 15th day of May, 1961, by the following vote:

A letter is read from Robert Podesta and Associates requesting endorsement
of his application for the construction of an F. M. Radio station in the City of
Santa Clara.
Motion by Councilman Goodrich second by Councilman Wentworth and carried
that the City of Gilroy Council endorse the application of Robert Podesta and
Associates for construction of F. M. Radio Station in the City of Santa Clara.
A petition is read from property owners on Princevalle Street requesting
additional lighting on Princevalle Street between First and Second Streets.
Discussion is had.
Director of Public Works Kludt is instructed to investigate the lighting
situation on Princevalle Street and report back to the Council at the next meet-
ing.
The Mayor Pro-tempore calls on Mr. Pasquale La Macchia and asks him if he
has anyth i ng to discuss before the -Court: i I .
Mr. La Macchia addresses the Counci I and requests that the Counci I order
property owners to put their rubbish on the curbs for collection on the night
before their district is scheduled for rubbish collection instead of two or
three days before, because it causes an unsightly appearance to visitors viewing
our City.
The Council agrees that notifying property owners through newspaper coverage
regarding this matter might help to remedy the situation.
Mr. La Macchia also congratulates the Council for sighing the City streets.
A report of the Plahning Commission is read requesting the Counci'l to'order
a feasability study by the City Engineer for extension of Old Gilroy Street
across Monterey Street to make possible the setting of plan lines; notifying the
Council that a request for a variance for on-sale beer from J. T. Walker in a
I'C-P' Distritt was not' recommended; notifying the Cbunci I of the denial of a
request fOr S'Use Permit to construct an additional'dwelling on a lot belonging
to Mr. Yamagama between Old Gilroy and Seventh Stre~ts;and requesting issuance
of a Use Permit to the First Baptist Church at Srxth and Hanna Streets.
Motion by Councifman Goodrich second by Councilman Quartttoli and carried
that City' Engineer Hanna Jr. be instructed to conduct a feasability study for
extension of Old Gi Iroy Street across Monterey Street for the purpos'e of setting
p I an lines.
Discussion is had on the Planning Commissions' denial of a variance for
liOn-Sale Beerll from J. T. Walker In a "C-I" District. The City Attorney states
that the Planning Commission will notify Mr. Walker of the denial and inform him
that if he desires he may appeal to the Counci I. The City Attorney al'so states
that the Council cannot take any action at th~s time.
City Administrator Carr reports that there is no action necessary on the
request denying a Use Perm it-by Mr. Yamagama.
The City Attorney presents and reads Resolution No. 624. Motion by Council-
man Duffin second by Counci Iman Wentworth that Resolution No. 624 be adopted.

GRANTING OF, USE PERMI'T TO FIRST BAPTIST CHURCH TO USE PREMISES AT THE SOUTH-
WEST CORNER OF SIXTH AND HANNA STREETS FOR CONSTRUCTING AN ADDITION TO THE
CHURCH BUILDING.

A report Is read from the Personnel Commission concerning overtime in the
Fi re Department and for payment of overtime to all departments if compensating
time-off is not used by the end of the fiscal year ending June 30, 1962.
Discussion Is had.
Motion by Councilman Quartiroli second by Councilman Jordan and carried that
the Fire Department be allowed to grant two hours time-off for everyone hour
overtime for work performed by firemen during other than normal working hours.
Motion by Councilman Goodrich second by Councilman Duffin and carried that
a policy is hereby established to become effective July I, 1962 to compensate
employees in all d~part~ents at a rate equal to his existing salary for any
overtime that has not been compensated for by the equivalent time-off in the
fiscal year in which it occurs, except the overtime accumulated in the last two
weeks of the fiscal year can be carried over to the following fiscal year.
City Administrator Carr reports that he had sent out copie~ to Council Mem-
bers of the Parking Committee recommendation on the Site Control District and
Parking Regulations for informational purposes and that it will come before the
Plan'ning Commission before any Council action is necessary.
The Mayor-Protempore states that this is the time to appoint a member of
the Council as representative on the County TrafficwaysCommittee.
Motion by Counci lman Jordan second by Counci lman Quartl rol i and carried
that Councilman Duffin be appointed to represent the Council on the County
Trafflcways Committee.
City Administrator Carr notifies the Council that he has instructed the
City Attorney to start condemnation proceedings for removal of a building on
Seventh Street belonging to Joe Semas which was authorized by the Council on
J u I y 7, 1960.
The City Attorney presents and reads a proposed ordinance adopting the
Gilroy City Code. Motion by Councilman Goodrich second by Councilman Jordan
and carried that the ordinance be introduced and that it be published by title
and summary. Motion barried by unanimous vote of the Council present.
City Administrator Carr reports that copies of the report of the Subcom-
mittee of the County Trafficways Committee concerning additional revenue for
road purposes were sent to all Council Members.
Discussion is had.
This matter is tabled for further study.
A letter Is read from the Gilroy Elementary School Board concerning a joint
meeting to discuss extension of Fourth Street. This joint meeting is set for
Thursday, June 22, 1961.
A letter is read from Congressman Gubser and copies of correspondence per-
taining to adequacy of the present National Guard Armory site.
Discussion is had and no action Is taken.
City Administrator Carr reports that he has received salary recommendations
from various department heads recommending advancement to the next step in their
respective salary ranges for, Mrs. Helen Eustis, hourly $J.70 to $1.79; Susanne
E. Payne - Range 17, $415.00 to $436.00; Mrs. June Cadile - Range 12, $281.00
to $295.00; Hurshel Wingo - Range 19 $458.00 to $481.00; Gabriel Filice -
Range 21 - $481.00 to $505.00; and William Kellar - hourly $1.88 to $1.97 ef-
fective June I, 1961. City Administrator Carr approves the recommendations.
Motion by Councilman Goodrich second by Councilman Wentworth and carried
that the salary recommendations for the above stated employees be approved for
advancement to the next step in their salary ranges, effective June I, 1961.
A letter is read from Cecille Kirk, Account Clerk, requesting authority to
write-off uncollectable water accounts in the amount of $304.75 with $80.00 covered
by deposits. Motion by Councilman Jordan second by Councilman Goodrich and
carried that permission be granted to write-off uncollectable water accounts In
the amount of $304.75.
City Administrator Carr reports that copies of the Police Manual setting
forth administrative rules and regulations for police officers have been dis-
tributed to each Council Member.
Chief of Police Laizure states that the manual is self-explanatory and en-
courages Council Members to read it.
Chief of Police Laizure is commended for initiating the manual in the
Police Department and for the work involved in compiling it.
City Administrator Carr presents a proposed agreement with local banks to
perform certain functions for the Department of Finance.
Discussion is had.
Motion by Councilman Duffin second by Councilman Wentworth and carried that
Director of Finance Carr be authorized to enter into agreement with the local
banks and selected banks whereby the selected banks would act as "Depositories"
for securities deposited to secure deposits of money in the local banks.
A letter is read from City Engineer Hanna Jr. setting forth a schedule of
payment for engineering on the outfall sewer requiring an amendment to the cur-
rent 1960-61 budget. Discussion is had.
Motion by Councilman Duffin second by Counci lman Goodrich and carried that
City Administrator Carr be authorized to issue a warrant in the amount of $5,363.61
from the Capital Outlay Revolving Fund to W. J. Hanna and Son for 3% of the

estimated cost for engineerin9 on the outfall sewer.
The'preliminary f961~62 Budget is distributed to each Council Member
and City Administrator gives an explanation of this budget requesting work
meetings for May 22nd and 29th. The first work meeting is set for May 22nd
at 7:30 P.M.
Assistant City Administrator Reinsch requests permission to advertise
for bids on Employee Bonds.
Discussion is had.
Motion by Councilman Goodrich second by Councilman Jordan and carried
that Assistant City Administrator Reinsch be authorized to advertise for bids
on Employee Bonds as set forth in the specifications.
A letter is read from Mr. R. W. Winkler commending a police officer for
assistance given.
A letter is read from Councy Executive Howard Campen setting forth a~
tion taken by the Board of Supervisors on separate court facil ities for Mor-
gan Hill and Gilroy.
A letter from the Santa Clara County Safety Council accompanied by the
yearly report is read.
Motion by Councilman Jordan second by Councilman Goodrich and carried
that this report be tabled.
Water samples taken by the Santa Clara County Health Department are
read and are satisfactory.
Director of Public Works Kludt reports that the Princevalle Well is
now in operation.
Councilman Wentworth requests permission to be excused. The Mayor
Pro-tempore excuses Councilman Wentworth~
Councilman Goodrich suggests that the shoulder on Carmel and Sargent
Streets be improved. Discussion is had.' The Mayor Pro-tempore instructs
Director of Public Works Kludt to investigate this situation.
Councilman Jordan reports that children have been playing hard-ball
at Oak Court and have broken a window in that vicinity. '
Discussion is had conerning organized playing In the park areas.
Councilman Jordan asks If Mr. Walker should be informed of the Planning
Commissions' denial of his request for a variance for On-Sale Beer in a "C-11I
District. The Mayor Pro-tempore states that Planning Commission Secretary
Kludt will inform Mr. Walker of his right to appeal before the Council.
Councilman Quartiroli'states that he believes the Council has a moral
obligation to issue a variance to Mr. Walker because at the time he requested
the change in location for his card-room the Council thought there would be
no obj ect ions.
Motion by Councilman Goodrich second by Councilman Duffin and carried
that this Council meeting adjourn.
