This regular monthly meeting of the City Council is called to order by
His Honor Sig Sanchez.
Present: Council Members: George T. .Duffin, Norman B. Goodrich, Wilford
E. Jordan, Kenneth L. Petersen, Charles F. Quartiroll, and Sig Sanchez.
Absent; Council Member: Everett C. Wentworth.
The Mayor calls on Judge Klarich and presents him with a certificate for
service on the Parks and Recreation Commission and thanks him for serving on
this commission.
The Mayor states that this is the time and place for the public hearing
on the 1961-1962 budget and finalization of the budget by the Council.
City Administrator Carr distributes copies of the proposed budget.
Councilman Wentworth enter.s and takes his seat at the Council table.
City Administrator Carr explains the changes in the budget and.reports
that the Golf Course has made a request for a $1,300.00 tool and storage shed.
Discussi.on is had and the request is not allowed.
Discussion is had regarding installation of curbs and gutters between
Carmel and Sargent Streets on First Street.
The Mayor instructs the City Attorney to prepare an ordinance enabling
the City to require property owners to install curbs, gutters and sidewalks, and
repairs to curbs, gutters and sidewalks if the City finds it to be necessary.
Director of Public Works Kludt is instructed to inform the school that
the City would like installation of sidewalks, curbs, and gutters on the south
side of First Street between Carmel and Sargent Streets.
Further discussion is had on the budget.
Motion by Councilma~ Goodrich second by Councilman Jordan and carried
that this public hearing for the 1961-1962 fiscal year budget be closed.
The Mayor calls on Mr. C. R. Acker to explain the problem at the City
dump regarding disposal of materials from demolished buildings and tree trimmings.
, Mr. Acker explains that since the Air Pollution Board prohibits burming
of this material and if the Council want the Gilroy Garbage Company to take care
of it then he feels that It will be necessary to charge $I~OO per yard for lum-
ber, tree stumps, tires, etc. because this material is more difficult to dis-
pose of and $.50 will not cover the cost involved.
Discussion is had.
The Mayor states that this problem will be taken under advisement and a
solution will be worked out.
A letter is read from the Gilroy Gliders requesting use of Wheeler Audi-
torium for a Folk Dance Festtval on November 11', 1961. Motion by Counci lman
Petersen second by CouncLlman Wentworth and carried that the Gilroy Gliders be
granted permission to use the auditor.ium free of charge on November II, 1961 for
a Fol~.Damce Festival.
A letter is read from Mr. Alfred JohAson reqwesting a card room license
at 19 South Monterey Street. City:Administrator Carr: reads a report from Chief
of Police Lalzure making no.recommendation at tints time. The Mayor instructs
Chief Laizure to investi,gate this application thoroughly~before making a recom-
men da t i on .
A letter is read from Mr. Ralph Valdez requesting a card room license at
63 South Monterey Street. A report from Chief of Police Laizure is read recom-
mending that this license be:granted.
Motion by Councilman Wentworth second by Councilman Petersen and carried
that a card room license be granted to Mr. Ralph Valdez at 63 South Monterey
Street.
Discussion is had on a request from the County Executive's Office for
Council decision on donating a site for the proposed Gilroy Judicial Court Build-
ing.
Motion by Councilman Goodrich second ,by Counci Iman Jordan and carried
that the City of Gilroy will offer an adequate site free of charge to the County
for a Gilroy Judicial Court and that the Council is willing to discuss further
requirements with them.:
A letter is read from City Engineer ,Hanna Jr. submitting the final map

of Castlewood Park, Unit No.4.

that the final map of Castlet.tood Park, Unit No.4, be approved subject to filing
an improvement agreement and furnishIng a satisfactory bond for the I~provements.
The Mayor suggests that the Council authorize the City Engineer to pr~
ceed with the preliminary engineering of the proposed North East Outfall Sewer
line subject to the understanding that the engineering cost shall be based upon
6% of the total cost of the project Including all preliminary engineering:ff the
project is approved.
Discussion is had.
Motion by Councilman Petersen second by Councilman Wentworth and carried
that the City Engineer be authorized to proceed with the preliminary engineering
and feasibility study of the North East Outfall Sewer line with the understanding
that the engineering cost shall be based upon 6% of the total cost of the project
including all preliminary engineering if the project is approved.
The Mayor suggests appointment of a Right-of-Way Agent in the near fur-
ture to obtain rights-of-way for the North East Outfall Sewer Line. City Adminis-
trator Carr reports that Mr. B. M.Klink has indicated that he Is willing to ac-
cept the appointment.
The City Attorney is instructed to prepare resolutions accepting ease-
ments from San Martin Vineyards Company and the Gilroy Elementary School District
for the outfall sewer line.
City Administrator Carr presents a proposed ordinance which increases
bicycle licenses from $.50 to $1.00.
Discussion is had. It is suggested that bicycle licenses be issued for
a three year period for $.50 and that a date be set for a deadline to obtain the
license and if the bicycle Is impounded a $1.00 penalty charged for redeeming the
bicycle.
City Administrator Carr states that the proposed ordinance will have to
be rewritten to include the changes and Introduced at the next meeting.
City Administrator Carr suggests that the license fee for female dogs
be raised from $1.00 to $3.00.
Discussion is had concerning raising the dog licenses and the present
leash law requiring all dogs to be on a leash and not allowing them to run at
large.

Motion by Counci Jman Goodrich second by Councilman Petersen that Poun~
master Weiss be Instructed to lmpound all unlicensed dogs as of July I, 1961, and
that a notice to this effect be published in the local newspaper.
The Mayor explains that he, City Administrator Carr and the City Engin-
eer have attempted to negotiate with Mrs. Mazzucca to obtain an easement through
her property for the proposed sewer line to service the new La Hacienda Units and
interested property owners in the Maple Street area. He states that Mr. Coryell
and Mr. Forsythe have agreed to contribute $600.00 toward the new line and the
other property owners that want to connect to the proposed line will pay their
share of the charges based on $1.50 per front foot and the City will assume the
balance of the cost.
The Mayor asks the City Attorney to give his opinion as to the City i~
suing a building permit for construction of La Hacienda Units in the event that
an easement is not obtained from Mrs. Mazzucca and it would be necessary for this
project to obtain sewer facilities from the existing line on Maple Street.
The City Attorney states that he submitted an opinion in writing to the
City Administ~ator and he states that a building permit can be Issued at any time
for construction of the La Hacienda Units.
The Mayor asks the City Attorney if condemnation proceedings would be in
order in the event that an easement cannot be obtained from Mrs. Mazzucca and if
the City wanted to proceed with the construction of a new sewer line.
The City Attorney states that condemnation proceedings can be initiated
if the City wants to construct the new sewer line and if an easement is not granted.
The Mayor asks the City Attorney to notify Mrs. Mazzucca that a building
permit is going to be issued for La Hacienda Units and the City can condemn her
property if she does not grant an easement for the proposed sewer line.
Motion by Counci Iman Duffin second by Councilman Wentworth and carried
that condemantlon proceedings be initiated through Mrs. Mazzucca's property if
necessary, enabling the City to construct a new sewer line.
Water samples taken by the Santa Clara County Health Department are pre-
sented and read. These samples are ordered filed.
A report is read from Director of Public Works Kludt concerning the water
level of the City's wells.
Director of Publ ic Works Kludt reports that It will not be necessary to
ration water this year but precautionary measures should be continued in the event
of another dry year.
The Mayor suggests ~~at this report be publicized and that the public be
thanked for conserving water in the past months.

Councilman Wentworth requests permission to leave the Council Chambers.
The Mayor gives Councilman Wentworth permission to leave.
The Mayor Informs City Engineer Hanna Jr. of the Council IS authorization
for him to proceed with the preliminary engineering of the North East Outfall
Sewer line.
City Administrator Carr reports that he has the easement from the Gilroy
Elementary School District but that it must be signed by three other officials
and that he has one signature on the easement from San Martin Vineyards Company
with four other signatures necessary.
The City Attorney presents and reads Resolution No. 628 granting an
easement from the Gilroy Elementary School District.

The City Attorney presents and reads Resolution No. 629 granting an

Assistant City Administrator Reinsch reports that the agreement with
the State Cooperative Personnel Board was referred to the Personnel Commission
who have approved it and now the authorization by the Council is necessary.
Motion by Councilman Goodrich second by Councilman Petersen and carried
that the agreement with the State Personnel Board for preparation and processing
of tests for job classifications be approved and that authorization be. given
to Personnel Director Reinsch to sign said. agreement.
Chief of Police Laizure requests investigation for a fan'or co@llng
system for the Police Department.
The Mayor instructs Purchasing Agent Reinsch to see what type of cool-
ing system can be found at a reasonable price for the Police Department.
Councilman Duffin states that he would like to go on record for remov-
ing all Yield.of-Right-of Way signs at right angle streets and replacing them
with stop signs.
Discussion is had.
The Mayor suggests that the City Attorney be authorized to prepare an
ordinance for removing "Yield-of-Right-of-Way" signs at all right angle streets
and replace them with stop signs.
The Mayor states in the past a survey had been made by the "AAA" Association
and asks If this can be done at this time.
The City Attorney leaves the Council Chambers.
The Mayor suggests that an ordinance be prepared tQ eliminate the Yield
of Right of Way signs and have the IIAAAII Association conduct a survey to dete~
mine where the stop signs shall be placed at these intersections. The Mayor
asks Councilman Duffin to refrain from making a motion to remove Yield of Right
of Way signs for a few months until it is determined from the "AAAII Association
where the stop signs should be placed.
Councilman Duffin is in accord with this suggestion.
The Mayor reads a letter from the California Nation Guard Commission
Inviting the Mayor and one Councilman to a reception at Camp Roberts. The
Mayor asks if anyone would like to go with him. There is no response.
The Mayor statesthat the next Inter-City Council meeting will be in
