Present: Council Members:, George 1. Duffin, Norman B~ Goodrich, Charles F. Quartlrpli, Evere.tt C. WentW9rth, and Sig Sanch~z" Absent: Counci lmembers: ~1:lford,E. .Jordan, and K,enneth L. Pe,tersen. The Mayor states that the purpose ofthi s meeting i.s to di scussthe proposed sewer line in the Maple Street area with Mrs. Mazzucca in order to obtain an easement through /le.r property for construction of the~ewer line. He states that the existing sewer line is adequate to service the La Hacienda Units of Coryell and Forsyth as determined by the City Engineer's survey however, it would be a sub-standard situation, and for this reason Mr. Coryell and Mr. Fors.yth are willing .tocontripute $600\.00 toward a,new I ine if the City. prov.ides the right-pf-way through. Mrs~'Mazzucc~'s prop~rty. He states that Mr. Long and Mr. Cirel II will pay for a portion of .the line based on fron:tfoot charges and Mrs. Mazzucca wi 11 be a 11 owed to connect to the proposed new line a,t any time. Discussion is had. Mrs. Mazzucca states that she does- not want to grant an, easement to the City if she has to continue to use the old sewer line. She also states that if she has to continue to use the old line will the City maintain her 1 ine? The Mayor. s,tates. that if. M,rs. He also states that if there is enough fall on Mrs~: Mazzu~ca's property the City will replace the existing line with a new line and If the fall is not adequate we will maintain the existing line. Director of Public Works Kludt states that the City would only be able to maintain the present line from the main only, because the City does not have the proper equipment, to. maintain a four inch line. Mrs., Mi;I~zucca under- stands that if there was sewer trouble in the sewer line on her property that she would be responsible for its maint.nance. Mrs. Mazzucca states that if she gi ves an ea~ement through her pro- perty she would prefer the new line to go in back of her property. Mrs. Mazzucca also states that she should receive something from the City if she gives an easement through her property. The, Mayor s.tates that wi th a new line through her property .she would be able to connect to the sewer line at no cost if and,when abuilding was constructed on, her property. He s,tates that the City has n~ver paid for an easement with the thought in mind that a sewer line would benefit the property. Further dllscuss i.on is had. Mrs. Mazzucca ~tates that a new line would cut off her property and ruin the valuation of her property. The Mayor states that Mr. CoryeJl intends ~o fence the, entire La Hacienda Units and :the project will not ~lstract from her property. Discuss ion is had. Mrs. Mazzucca agrees to grant i ng of an easement to the City for cOAstru~tlon of a sewer line through her property. Motion by Councilman Goodrich second by Councilman Wentworth and carried th~tthe.City' Attorney be instructed to prepare the necessary easement and agreements bet- ween the City of G i I rOrt~. and Mrs.Mazz",cca fora ri ght-of-way of f.i ve feet on the north, 10 feet across the: corner, and fJve, feet on the east of Mrs. Maz~ucca's property line for construction of a new sewer )Ine; that if there is fall enough to allow for the cpnstruction ofa new Sewer line to replace the exist- ing line she will have the right to connect to it; that if this line can not be constructed because of. lack of grade, the City will guarantee maintenance of the existing line; and that Mrs. Mazzucca will be allowed to connect to the new 1 ine on the north.and east of her, property if and when a new bui lding is constructed" Councilman Petersen enters and takes his seat at the CounciL table.
