Goodrich, Wilf6rd E. Jordan, Kenneth L. Petersen, Charles F. Quartiroli, Everett C. Wentworth, and Sig Sanchez. ' " UII ')lHO The Mayor asks if all Councilmen have received copies of the regular meet- Ings of February 5th and 19, 1962. All Councilmen answer in the affirmative. The Mayor now asks if there are any errors or omissions in the minutes as presented. No errors or omissions are noted. The Mayor now declares the minutes of the regu- lar meetings, of February 5th and 19, 1962 approved. City Administrator Carr reports that, the Pianning Commission have submitted their report on the 1962-1967 Capital Outlay Program and calls on Dr. James Neilson, Chairman of the Planning Commission, to explain the report. Dr. Neilson addresses the Council and expresses regrets for Bruce liacobs, Chai rman of the Capi tal Outlay Program Committee for not being able to attend this meeting. Dr. Neilson explains the report as submitted. A .lengthy discussion is had on the report. Planning Consultant, Nestor Barrett, also explains the proposed financing of the program. The Mayor states that the Planning Commission has done an excellent job in compiling the report and compliments them on their work. City Administrator Carr reads the report of the Planning Commission noti- fying the Council of the resuit of the public hearing on the official pian lines for Ninth Street from Tenth and Church Streets to the East City lim,its and recom- mending adoption of official plan lines. The City Attorney presents and reads Resolution No. 675. Motion by Coun- cilman Jordan second by Councilman Wentworth that Resolution No. 675 be adopted. ~ ..... RESOLUTION NO. 675 RESOLUTION FIXING TIME AND PLACE OF HEARING REPORT AND RECOMMENDATION OF PLANNING COMMISSION AFTER ITS HEARING ON ITS PROPOSAL THAT PRECISE PLAN liNES BE ADOPTED FOR THAT PORTION OF THE CIRCULATION ELEMENT OF THE GENERAL PLAN EXTENDING FROM TENTH AND CHURCH STREETS IN THE CITY OF GilROY TO NINTH AND f!lONTEREY STREETS AND THENCE ALONG NINTH STREET FROM MONTEREY STREET TO THE EASTERLY CITY LIMITS OF THE CITY OF GILROY. The City Attorney recommends that this proposed ordinance for official plan lines be adopted. The Mayor suggests that the Council study the proposed ordinance and act on it at a later date. Councilman Wentworth requests that official plan lines be set for the ex- tension of Church Street north of the City Limits. The Mayor states that this matter will be referred to the Planning Commission for study. Nestor Barrett reports that the County Planning Department wish to arrange a meeting with the Council to submit the new land use map. Ordinance No. 671 is presented for adoption. He explains this proposal. Motion by Councilman Petersen second by Councilman Duffin and carried that Director of Public Works Kludt be instructed to vote "yeS" on the proposed amendment as requested. City Administrator Carr requests permission to enter into an agreement with the Department of Finance for a population estimate. He presents and reads Resolution No. 677. Motion by Councilman Wentworth second by Councilman Quartiroli that Reso- lution No. 677 be adopted. - RESOLUTION NO. 677 A RESOLUTION OF THE CITY COUNCil OF THE CITY OF GILROY AUTHORIZING EXECUTION OF AN AGREEMENT WITH DEPARTMENT OF FINANCE REGARDING POPULATION ESTIMATE. Motion by Councilman Goodrich second by Councilman Wentworth and carried that City Administrator Carr be authorized to send in his recommendations as su~ mltted to the Council on the proposed legislation. City Administrator Carr reports that Installation of a six inch sewer line is necessary on Forest Street. Director of Public Works Kludt reports that the cost will be approximately $1,000.00. Motion by Counci lman Goodrich second by Counci lman Petersen and carried that a six inch sewer line be installed on Forest Street and that an amendment to the budget be made In the amount of $1,000.00. A letter from the County Department of Publ ic Works is read informing the City on the time schedule for construction of the Justice Court in Gilroy. Reports of water samples taken by the Santa Clara County Health Depart- ment are presented and read. The Mayor states that all Council Members have received copies of the pro- gress reports of City Officers; the report of the Police Department, Poundmaster, and Building Inspector; the City Auditor's report from July I, 1961 to February 28,1962; the financial report for February 1962; and the reports of receipts of City Officers. Motion by Councilman Goodrich second by Councilman Jordan and carried that all the reports be accepted as submitted. Discussion is had regarding the proposed capital out lay work to be done u 12182 at the sewer farm in 1962-63. Discussion is had regarding the ponding areas at the Sewer Farm. The City Administrator explains his investment program on surplus City funds. Director of Public Works .Kludt reports that ,the total cost for instal- ling ten inch meters on all City wells will be $2,875.71. Dlscusslon is had regarding purchase of recording meters instead of re- gistering meters. The Mayor instructs Director of P~blic Works Kludt to investigate and determine the cost of recording meters for the four Cj.ty wells before any ,action i s ta ken. Discussion is had regarding importation of water. The Mayor states that he thinks there might be a possibility of the City obtaining water rights at the Little Arthur Creek as an additional water source. Further discussion is had. All Councilmen agfee that the City should file an application for a water right on the Little Arthur Creek. Motion by Councilman Duffin second by Councilffian Wentworth and carried that proceedings be initiated for filing an application for a water right at the Little Arthur Creek. The City Attorney reports that George C. Renz wishes to negotiate with the City to vacate a portion of his land at the intersection of First and Way- land Lane. Discussion is had on this matter and also on obtaining dedication from all :property owners on First Street. No action Is taken.
