Minutes 1962/04/02 J18Ll Gilroy, California Apri I 2, 1962 This regular monthly meeting is called to order by His Honor Sig Sanchez. Present: Counci I Members: George T. Duffin, Norman B. Goodrich, Wilford E. Jordan, Kenneth L. Petersen, Charles F. Quartlroll, Everett C. Wentworth. and Slg Sanchez. The Mayor asks if all Councilmen have received copies of toe regular meetings of March 5th and 19, 1962. All Councilmen answer in the affirmative. The Mayor now asks if there are any errors or omissions in the minutes as pre- sented. No errors or omissions are noted. The Mayor now declares the minutes of the regular meetings of March 5th and 19, 1962 approved. The Mayor states that this is the time and place for opening of bids for recording water meters. Purchasing Agent Reinsch states that representatives for the two bids received are present. He also states that one bid was opened In error by Be- Ge Manufacturing Company. Both representatives present are satisfied that the bid was opened in error. The bids are opened and they read as follows: 1.- Hersey Sparling Com- pany, Alternate A-a. For 2 ten inch main line saddle type meters $800.00, b. For 2 ten inch flange type meters $1,120.00, c. For electrical recorders $2,020. 00; total of $3,940.00 Alt. B, a. For 2 ten inch main line saddle type meters $800.00, b. For 2 ten inch flange type meters $1,120.00, c. For 2 electrical and 2 mechanical recorders $1,970.00, total $3,890.00; 2. - Badger Meter Company Alt. A, a. $768.00, b. $1,020.00, c. $2,480.00' total $4,268.00. The Mayor instructs Purchasing Agent Reinsch to refer the low bid from Hersey Sparling Company to the City Attorney. A.representative from the Hersey Sparling Meter Company explains the reason for Alt. B and gives advantages of the mechanical type recorders. Director of Publ ic Works Kludt recommends that the 2 mechanical and 2 electrical recording meters be purchased. The City Attorney reports that the bid of Hersey Sparling Meter Com- pany is In order. Motion by Counci Iman Duffin second by Counc.i lman Petersen and carried that the low bid of Hersey Sparling Company for Alternate B in the amount of $3,890.00 be awarded. A petition for annexation is read from John H. and Inez Stelling of a portion of their property (26.725 acres) south of Sixth Street between Prince- valle Street and Miller Avenue. John Stelling addresses the Council and explains his proposal. The City Attorney presents and. reads Resolution No. 678. Motion by Councilman Wentworth second by Councilman Goodrich that Resolution No. 678 be adopted. RESOLUTION NO. 678 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF GILROY OF UNINHABITED i TERRITORY DESCRIBED HEREIN AND DESIGNATED IIFIFTH WESTERN ADDITION (3-62) TO THE CITY OF GILROY" AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO. ADOPTED THIS 2ND DAY OF APRIL, 1962, BY THE FOLLOWING VOTE: AYES: COUNCIL MEMBERS: Duffln,Goodrich,Jordan,Petersen, Quartiroll,Wentworth, and Sanchez. 2185 NOES: ABSENT: COUNCIL MEMBERS: None COUNCIL MEMBERS: None r-' Discussion is had on the proposed subdivision plan regarding this annexation. A report is read from the City Engineer regarding storm drainage for th is area. City Administrator Carr reports that the City Engineer Is ill and wi II not be present at this Council meeting. The Mayor suggests that the recommendation of the City Engineer be held over until next meeting when the City Engineer can explain his proposal for storm drainage for the proposed annexation. A letter Is read from W. J. Hanna Sr. requesting preservation of a tree at First and Rosanna Streets. Discussion is had. Director of Public Works Kludt reports that the tree is 15 feet north of the Richfield Oil Company's south property line and is not in a driveway approach. He states that a driveway approach Is located north of the tree. The Mayor instructs the City Administrator and Director of Public Works to discuss this further with the Richfield 011 Company. The City Attorney presents and reads Resolution N1. 679. Motion by Counci lman Petersen second by Councilman Wentworth that Resolution No. 679 be adopted. ON NINTH STREET CAN BE DONE MORE ECONOMICALLY BY DAY LABOR AND THE MATERIALS AND SUPPLIES FURNISHED AT A LOWER PRICE ON THE OPEN MARKET THAN CAN BE OBTAINED BY SUBMITTING THE PROJECT TO BIDS. City Administrator Carr reports that the Planning Commission and Counci 1 have met to discuss the proposed 1962-67 Capital Outlay Pro~ram and requests formal approval of ..the program. Motion by Councilman Duffin ,second byCounci Jman Wentworth and carried that the 1962-67 Capital Outlay Program be approved. The City Attorney presents and introduces a proposed official plan line ordinance to be used for establishing plan lines for future within the City of Gilroy and Its plannJng area. Motion by Councilman Goodrich second by Counci I man Jordan and carr! ed that the proposed ordinance adopti.ng systematic official plan lines be Intro- duced, the reading waived, and published by title and summary. Discussion is had on ,the proposed amendment to Section 13.46 of the City Code regarding licensing of card rooms. City Administrator Carr reports that he and Chief of Police Laizure discussed licensing of card rooms and he reads a memorandum from 'the Chief of Police regarding this matter. ' Chief of Police laizure requests further stipulations to be embodied u 218b in the present ordinance regarding card room applican:ts. Discussion is had. The Mayor instructs the City Attorney to prepare an amendment to the card room licensing section of the Code to embody further stipulations as re- quested by the Chief of Police to include permission for temporary suspension of a card room license pending final revokation by the Counci I. City Administrator Carr requests authorization to advertise for bids for the northerly extension of Church Street. Discussion is had. Di rector of Public Works Kludt recommends Council approval of the plans and specifications. Motion by Councilman Goodrich second by Councilman Jordan and carried that the plans and specifications for the northerly extension of Church Street be approved and that bids be advertised for this project. A letter from the California Traffic Safety Foundation is read re- garding a proposed Vehicle Safety Check Program in Gilroy. A memorandum from Chief of Police Laizure is read regarding this pro- gram. Chief laizure explains this program and states that a program of this type will be advantageous. All Council members have no objections to a Safety Check Program. A letter is read from the State Treasurer thanking the Council for action taken on the proposed federal tax on public bonds. The Mayor states that alf Counci I members have received copies of the progress reports of City officers; reports of the Police Department, Poundmaster, and Bui Iding Inspector financial report for March 1962; and reports of receipts, of City officers. City Administrator Carr reports that ~he Water Study Committee has met regarding the proposed water study and four proposals which were submitted have been studied. The Committee recommends that the proposal submitted by John A. Carollo be selected. City Administrator Carr explains what John A. Carollo, Consulting Eng- ineers, will provide under their contract for the amount of $3,500.00. Motion by Councilman Goodrich second by Councilman Quartiroli and carried that John A. Carollo, Consulting Engineers, be selected to conduc~ a water study for the City of Gilroy In the amount of $3,500.00. The Mayor aJso states that representatives from the Community Service Organization are present. No person in the audience has any business to bring before this Council ~ .J ~ ..... meeting. Councilman Wentworth reports that Henry Allemand, leasee of property at the Sewer Farm, is having difficulty with packs of dogs and children shooting at the dogs on the property. The Mayor saates that this problem was referred to Poundmaster Weiss who stated that he would make arrangements with Coun~y personnel for poisoning the wild dogs. The Mayor also states that Mr. Allemand has the authority to post signs on property that he is leasing at the Sewer Farm. Counci Iman Duffin requests information on the progress if any, on the paving of First Street. Director of Public Works Kludt reports that he has not received any recent information on this project. Councilman Duffin requests information on progress of the City in ob- taining water rights on the Little Arthur Creek. The Mayor states that he will report on this project later this eve~r~9. . Councilman Petersen reports that he and City Administrator Carr recently met in Sacramento with the State Legislators. Discussion is had regarding suspension of water mains under bridges over Mill er Slough. Councilman Wentworth asks why curb lines on First Street are not uniform. Director of Public Works Kludt states that a former Council allowed Stanley Karp to construct an apartment buifding two feet closer to the street width line thus causing the curb to be set two feet fonther into First Street. A letter is read from the I.F.D.E.S. requesting permission to hold their annual parade on May 27, 1962. Motion by Councilman Goodrich second by Councilman Jordan an carried that the I.F.D.E.S. organization be granted permission to hold their annual parade on May 27, 1962, and that the route requested be approved. The Mayor states that the Gilroy Evening Dispatch will be publishing a 16 page Special Edition to celebrate the formal opening of the hospital. He states that the Council has been a~ked if it wishes to participate in this edition. He states that the price for 1/4 page is $57.40 and t page is $114.80. Motion by Councilman Jordan second by Councilman WBntworth and carried that the Council participate in the Special Hospital Edition by purchasing a 1/4 page advertisement for $57.40. ~ ~ 2-10"'" ,-.LO' The Mayor reports that he has received requests for the City to provide boccie ball facilities and betieves that accomodatlons for this project can be had at the north end of the Forest Street Playground. He states that if the City will furnish the materials that the people Interested in this project wi II do the work involved in the project. Discussion is had. Motion by Councilman Duffin second by Councilman Wentworth and carried that the City Administrator and D.irector of Public Works be allowed ,to make arrangements for boccie ball facilities at the Forest Street Playground. The Mayor reports that he has discussed possibility of the C'ty acquir- ing water rights at the little Arthur Creek with the Water Conservation District and they have no objections. Discussion Is had. Motion by Councilman Duffin second by Councilman Goodrich and carried that the City Attorney determine what proceddress are necessary to file for water rights <1m the Li tt I e Arthur. The Mayor states that he has received complaints regarding the holes in the street at the intersection of Sixth and Elgleberry Streets and instructs - Director of Public Works Kludt to investigate the situation. City Clerk Payne states that she hopes to have a written report of the results of the license survey in the mall to all Counci I members before the next Council meeting. The City Attorney presents and reads Resolution No. 681. Discussion is had. Motion by Counci I man Petersen second by Counci lman Duffin that Resolu- tion No. 681 be adopted. RESOLUTION NO. 681 A RESOLUTION OF THE COUNCil OF THE CITY OF GILROY DECLARING ITS INTENTION TO VACATE A SMALL PARCEL OF LAND CONSTITUTING A PORTION OF WAYLAND LANE, A PUBLIC STREET IN THE CITY OF GILROY.
