Minutes 1963/04/04 2268 Gilroy, Cal ifornia April 4, 1963 This special meeting is called to order by His Honor Kenneth L. Petersen. Present: Council Members: George T. Duffin, Chester R. Eckard, Wilford E. Jordan, Everett C. Wentworth, and Kenneth L. Petersen. Absent: Council Members: Norman B. Goodrich. The Mayor states that this is the time and place for the recessed pub- lic hearing for the the proposed IIFifth Northern Addition" annexation. He asks if anyone in the audience wishes to speak for or against the proposal. There is no comment from the audience. The City Attorney states that this is the time and place to determine if there are majority protests from property owners against the annexation. Councilman Goodrich enters and takes his seat at the Council table. The Mayor asks for the names of the property owners protesting the annexation. City Administrator Carr presents and reads all of the protests stating that the total 'amount of protests in land assessed valuation totals $13,890.00. Protests are as follows: Norman Chapman - $400.00; Ferdinand and Anna Tomey $500.00; Hermann H. and Irma Schwabel - $1,600.00; Alfred and Eleanor Tomey _ $500.00; Anthony and Ella Silva - $300.00; Valley Title Company - $5,570.00; Irwin and Thelma Holl ister - $4,460.00; Elizabeth Williams - $200.00; and D. L. and Frances Taylor - $200.00. City Administrator Carr states that the total assessed valuation of land only in the entire territory is $44,870.00 and that the amount of protests is not 50% of the assessed valuation of land. The City Attorney states that it is necessary to adopt a resolution determining the number of protests. The City Attorney presents and reads Resolution No. 748. Motion by Councilman Jordan second by Councilman Duffin that Resolution No. 748 be adopted. RESOLUTION NO. 748 RESOLUTION DETERMINING THAT PROTESTS AGAINST PROPOSED ANNEXATION OF TERRITORY IN IIFIFTH NORTHERN ADDITION" ARE INSUFFICIENT. PASSED AND ADOPTED this 4th day of Apri I, 1963, by the following vote: AYES: COUNCIL MEMBERS: Duffin,Eckard,Goodrich,Jordan,Quartiroli ,Wentworth, and Peters en. NOES: COUNCIL MEMBERS: None ABSENT: COUNCIL MEMBERS: None The Mayor declares that there are not sufficient protests to terminate annexation proceedings. The City Attorney states that at this time the Council may reduce the area proposed to be annexed by not more than 5%. ' It is the Councilsl wish to annex the territory as originally proposed. The City Attorney presents and reads Ordinance No. 699. Motion by Counci Iman Jordan second by Councilman Duffin that Ordinance No. 699 be ado~ted. ORDINANCE NO. 699 AN ORDINANCE OF THE CITY OF GILROY CALLING A SPECIAL ELECTION TO BE HELD ON THE 4TH DAY OF JUNE, 1963, PERTAINING TO THE ANNEXATION OF "FIFTH NORTHERN ADDITION" TO THE CITY OF GILROY. SIGNED AND APPROVED this 4th day of Apri I, 1963 by the following vote: AYES: COUNCIL MEMBERS: Duffin,Eckard,Goodrich,Jordan,Quartiroli ,Wentworth, and Petersen. NOES: COUNCIL MEMBERS: None ABSENT: COUNCIL MEMBERS: None Mr. Gus Steele addresses the Counci I and asks the registration quali- fications of voters for the June 4th, Special Annexation Election. It is stated that all voters living in the area as of April 11,1963 and properly registered as of that date are el igible to vote in the June 4th e I ec t i on .
