Minutes 1965/12/20 2501 Gilroy, Cal ifornia December 20, 1965 The regular meeting of the Gilroy City Council was called to order by Mayor Protempore Everett C. Wentworth at 8:05 p.m. Present: Council Members: John E. Allemand, George T. Duffin, Chester R, Eckard, Norman B, Goodrich, and Everett C, Wentworth. Absent: Council Members: Charles F. Quartiroli and Kenneth L. Petersen. The Mayor Protempore asked if all Council Members present had received copies of the minutes of the regular meeting of December 6, 1965. All Council Members present answered in the affirmative. Mayor Protempore Wentworth asked if there were any errors or omissions:. in the minutes as presented. There were no errors or omissions noted. The Mayor Protempore declared the minutes of the regular meeting of December 6, 1965 approved, The Mayor Protempore stated that it was the time and place scheduled for the Publ ic Hearing re: Sidewalk installation on Miller Avenue. He asked if anyone present in the audience wished to speak for or against the proposed side- walk installation. There was no comment from anyone in the audience, Director of Publ ic Works Kludt explained a request of one owner to curve his sidewalk around an existing Magnolia Tree and thereby reducing the drastic pruning of the tree that a standard installation would require. He fur- ther stated that the Petitioners were not in attendance at thi? Council Meeting. Mayor Petersen entered and took his seat at the Council table at 8:06 p,m. Further discussion was had regarding the Miller Avenue sidewalk Instal- lation. Councilman Quartirol i entered and took his seat at the Council table at 8:10 p.m. Motion was made by Counci lman Duffin seconded by Councilman Goodrich and carried that the Publ ic Hearing be closed, Motion was made by Councilman Duffin seconded by Councilman Wentworth and carried that the Director of Public Works be instrycted to maintain City standards in this regard which would allow the installation of said sidewalk with- out removing the tree, but n~ted said installation would require some tree tri~ ming. The Mayor stated that it was the time and place scheduled for the Publ ic Hearing re: Weed Abatement. He asked if anyone in the audience wished.to speak for or against the Weed Abatement program. There was no comment from any- one in the audience, Motion was made by Councilman Quartiroli seconded by Councilman Good- rich and carried to close the Public Hearing, The City Clerk presented and read Resolution No. 981. Motion was made by Councilman Goodrich seconded by Councilman Eckard to adopt Resolution No. 981. RESOLUTION NO. 981 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY INSTRUCTING THE CHIEF OF THE FIRE DEPARTMENT TO ABATE NUISANCE ARISING OUT OF WEEDS GROWING UPON LOTS OR IN FRONT OF PROPERTY IN THE CITY OF GILROY AS REQUIRED BY SECTION 5 OF ORDINANCE NO. 754. PASSED AND ADOPTED by the City Council of the City of Gilroy at.a regular meet- ing held on the 20th day of December, 1965, by the following vote: AYES: COUNCIL MEMBERS: Allemand,Duffin,Eckard,Goo~rich,Quartirol i ,Wentworth, and Petersen. () '0 .:..; City Administrator Wood requested approval of the specifications to bidders on the Weed Abatement Program, copies of which were iAcluded with the Counc i 1 Agenda. Motion was made by Councilman Quartiroli seconded by Councilman Duf- fin and carried that the specifications for Weed abatement be approved and,that bid opening be scheduled for January 3, 1965, The Mayor noted receipt of a petition from Albert and Arthur Filice requesting annexation of a 33~849 acre parcel of land to be kl10wn as "Southwest Annexation No. 65-2 to the City of Gilroy" located on the South side of Tenth Street between Rosanna Street and the Princevalle Storm Drain Channel. City Administrator Wood further explained the location of the pro- posed annexation. The City Attorney presented and read Resolution NQ. 982. Motion was made by Councilman Eckard seconded by Councilman Allemand to adopt Resolution No, 982, RESOLUTION NO. 982 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF GILROY OF UNINHABitED TERRITORY DESCRIBED HEREIN AND DESIGNATED 'ISOUTHWEST ANNEXATION 65-2 TO THE CITY OF GILROY" AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO. ADOPTED this 20th day of December, 1965, by the following vote: AYES: COUNCIL MEMBERS: Allemand, Duffin, Eckard, Goodrich, Quartirol i, Went- worth and Petersen. NOES: COUNCIL MEMBERS: None ABSENT: COUNCIL MEMBERS: None The Mayor tabled receipt of a petition from several property owners re: proposed annexation of a 52.05 acre parcel of land to be known as "Monterey Northwest Annexation 65-4 to the City of Gilroy" located on the West side of Monterey Highwa~ between Liman and Farrell Avenues ~ecause the petition was not complete. A letter from the National Foundation-March of Dimes, requesting the City to proclaim January 1966 as official "March of Dimes Month" was presented. Motion was made by Councilman Goodrich seconded by Councilman Went- worth and carried that the Mayor be authorized to issue said proclamation. City Administrator Wood presented copies of the Monthly Report of November 1965, which was discussed and ordered filed. The Report of Disbursements from November 11, 1965 to December 10, 1965 was noted and ~rdered filed. City Apministrator Wood presented a report on water samples taken by the Santa Clara County Health Department. Discussion was had re: the condition of Well #4 in re: to the continued presence of colliform. It was suggested that additional tests be made on Well #4 if the present treatment does not prove successful. City Administrator Wood reported on a proposed Agreement Accepting a Trust from the Henry Miller Estate and requested ~uthorization to execute same. Motion was made by Councilman Eckard seconded by Councilman Wentworth and carried that the Mayor and City Admmnistrator be authorized to execute the Agreement re: the Henry Miller Estate. City Administrator Wood requested approoal for Cecil A, Reinsch to carry five (5) days of his vacation time over to the next Calendar Year due to his recent illness. Motion was made by Councilman Goodrich seconded by Councilman Went- worth and carried that Cecil A. Reinsch be authorized to carry five (5) days of his vacation time over to the next Calendar Year as requested. City Administrator Wood reported on a Staff study of the Employees~ Retirement Program and requested approval to contract with the State Employees;! Retirement Fund for an Actuarial Study under the State Retirement Plan in the estimated amount of $500.00. Motion was made by Councilman Duffin seconded by Councilman Wentworth and carried that the City Staff be authorized to contract with the State Emp- loyees Retirement Fund for an Actuarial Study under the State Retirement Plan in the estimated amount of $500.00 as requested. . City Administrator Wood presented and read Resolution No, 983 reques- ting the State Highway Commission to Transfer Certain Access Rights within the C i t Y of G i 1 roy. Motion was made by Councilman Quartiroli seconded by Councilman Duf- fin to adopt Resolution No. 983. [ [ [ 2503 COMMISSION OF THE STATE OF CALIFORNIA TO TRANSFER CERTAIN ACCESS RIGHTS ON STATE HIGHWAY ROUTE 101, WITHIN THE CITY OF GILROY. PASSED AND ADOPTED this 20th day of December, 1965 by the following vote: AYES: COUNCIL MEMBERS: Allemand, Duffin, Eckard, Goodrich, Quartiroli, Went- worth, and Petersen. NOES: COUNC I L MEMBERS: None ABSENT: COUNCIL MEMBERS: None City Administrator Wood reported on the proposed Employees' Christmas and New years H01iday Routine. Motion was made by Councilman Wentworth seconded by Councilman Goodrich and carried that the Employees' Christmas and-New Years Holiday Routine as presented be approved. Copies of the 1964-65 Annual Police Department Report were distributed to each Council Member. Discussion was had. The Mayor commended Chief Laizure for the excellent and comprehensive report. City Administrator Wood reported that Representatives from the Gilroy Jay Cees were present in the audience to request the Citys, endorsement of a Community Attitudes Survey planned throughout the City by the Jay Cees, Mr. Donald Malinoff addressed the Council and requested Councils' endors& ment to conduct their Planned Community Attitudes Survey in January 1966. He dis- tributed copies of the proposed survey to each Council Member. Further discussion was had. Motion was made by Councilman Quartiroli seconded by Councilman Wentworth and carried that the City endorse the Planned Community Attitudes Survey as pre- sented by the Jay Cees and recommended that all citizens cooperate with the Gil- roy Jay Cees in this project. Copies of the Minutes of the Santa Clara County Trafficways Committee Meet- ing of November 10, 1965 were noted. Director of Publ ic Works Kludt presented and explained an Alley Deficiency Report. Discussion was had. Ordinance No. 761 previously introduced and published by title and summary was presented fvr adoption. Motion was made by Councilman Goodrich seconded by Councilman Wentworth to adopt Ordinance No. 761. ORDINANCE NO. 761 AN ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY REZONING A PORTION OF THE FIFTH NORTHERN ADDITION AND OF THE MONTEREY NORTHWEST ANNEXATION NO. 1 FROM Rl DISTRICT TO R3 DISTRICT, AND ANOTHER PORTION OF FIFTH NORTHERN ADDITION FROM Rl TO C2 DISTRICT, AND REMAINING AREA OF FIFTH NORTHERN ADDITION AND MONTEREY NORTHWEST ANNEXATION NO.1 FROM Rl DISTRICT TO.M2 DISTRICT, WITH REZONED AREAS TO BE SUBJECT TO REGULATIONS OF liS" ZONES. NOES: COUNCIL MEMBERS: None ABSENT: COUNCIL MEMBERS: None The Mayor stated that all Commissioners whose terms wilt expire December 31, 1965 bad been contacted and that all Commissioners with the exception of Lawrence Keller had agreed to be reappointed for an additional 4 year term, and that Mr. J. Fred Baker had agreed to serve on the Personnel Commission to replace Mr. Lawrence K~ller. Motion was made by Councilman Wentworth seconded by Councilman Allemand and carried that the following persons be appointed to the respective Commissiol'ls as of January 1, 1966 to December 31, 1969: Planning Commission - Marvin Brodersen & Ben Gutierrez Personnel Commission - Michael A, Filice & J. Fred Baker Recreation Commission - Mrs. Celeste Zamzow & John Kent Library ~ Culture Commission - Mrs. Vernie Cowardin & Mrs. Robert J. Barret. City Administrator Wood presented a letter from the Gil Pop Corp. request- ing City Financial Support on a Deficit Incurred by the Pop Warner Football Team in the amount of $300.00 for the use of the High School Football Field. Discus- sion was had. Motion was made by Councilman Allemand seconded by Councilman Wentworth and carried that the request be approved and the City assume the charges incurred in the amount of $300.00. The Council instructed the City Administrator to arrange a meeting with 2504 the School Board and the Counci 1 Commi ttee (Eckard, Allemand, & Quarti rol i) to discuss the Boards' Philospp~y on use of sch601 facilities for recreational purposes. City Administrator Wood presented and read a letter from the Department of Corrections in regard to the Condition of the Old Jail Facility. City Administrator Wood presented a letter from.the Division of Highways notifying the City of the Sale of an excess parcel of land located on Butchell Road. Council reaffirmed its previous action to again advise the Division of Highways that the City is not interested in purchasing said land. City Administrator Wood presented a letter from the Peninsula Division, League of California Cities in re: to a Telegraph of Holiday Greeting to Presi- dent Lyndon Johnson. A Holiday Greeting from the Mayor of Los Gatos was noted. City Administrator Wood presented a letter from the Gilroy Telephone Company informing the City of the expiration date of the Telephone Company's Franchise of January 1, 1966. The Council set December 27, 1965 at 8:00 p.m. for the Council Advi- sory Committee to meet with the Golf Club Committee to discuss the new lease ag reemen t. Mr. John Hughan, Architect, addressed the Council and requested a change order in the Police Administration and Jail Facility Plans for a steel column to support the radio antenna tower in the amount of $991.00. Discussion was had. Motion was made by Councilman Quartiroli seconded by Councilman Went- worth and carried that the change order to the Pol ice Administration and Jail Facility Plans in the amount of $991.00 as explained be approved. Cqwncilmen Eckard and Quartiroli and City Administrator Wood noted their intention to attend the 1966 Annual Meeting of the General Assembly of ABAG on Februar'y 25, 1966. Councilman Duffin inquired about the lighting at the entrances of the driveway appreaches at the City Offices. The City Staff stated that they would furnish a cost report for such lighting. Discussion was had on the purchase of signs fior the Administration and Jail Facil ity Offices at the City Hall site and signs on Monterey Street and Rosanna Street to indicate the location of the Police Department. Councilman Wentworth inquired about the proposed erection of Signs at both entrances to the City Limits on .Monterey Street regarding excessive traffic through the City of Gilroy. City Administrator Wood recommended dis- cussion with the Co~nty prior to erection of said signs and noted their intent to give an additional presentation to the Highway Commission on the freeway matter, Councilman Quartirol i recommended improving the acoustics in Wheeler Auditorium. It was noted that this is a budgeted item and planned for a future project in addition to remodeling the east room of the Auditorium, for meeting purposes. Director of Publ ic Works Kludt moted that the Comfort Station at Christ- mas Hill Park had been completed and ecected. Oirector of Public Works Kludt reported on a recent Traffic Count Study by the Division of Highways in which it was determined.that signalization on First Street at Miller Avenue was not warranted and that signalization on First Street at Church Street carried one warrant which determines priority in receiv- ing said signals. On this basis it would be two years before our priority would be coming up on the State Budget. He also informed the Council that he requested the Division of Highw,ys to investigate the possib11ity of the City paying the entire cost of signalization at First and Church Streets and when priortty was received the City could then be reimbursed for the States' share. Director of Public Works Kludt reported that the Automatic System for the City's wells was in operation and invited Council Members to view the system after the Council Meeting. Chief of Police Laizure reported that the Pol ice Department will be moving into the new Police Building December 21, 1965. City Administrator Wood noted a letter to the Gilroy Unified School District regarding City procedures in regard to all new construction within the City. Council conc9rred with said letter as presented.
