The regular meeting of the City Co~ncil was called to order by
His Honor Kenneth L. Petersen at 8:04 p.m.
Present: Council Members: John E. Allemand, George T. Duffin,
Chester R. Eckard, Norman B. Goodrich, Everett C. Wentworth, and
Kenneth L. Petersen.
Absent: Council Member: Charles F. Quartiroli
The minutes of the regular Council Meeting of April 18, 1966
were approved as mailed and recorded.
The Mayor stated that it was the time and place scheduled for
the Publ ic Hearing on the proposed "Hecker Pass-Morey Avenue Annexa-
tion 66-1, to the City of Gilroy". City Administrator Wood explained
the location of the, proposed annexation. The Mayor asked if anyone
in the audience wished to speak for or against the proposed annexa-
tion. There was no comment from anyone in the audience. Motion was
made by Councilman Eckard seconded by Councilman Wentworth and car-
ried to close the Publ ic Hearing. The City Attorney presented and
read Resolution No. 1012.
Councilman Quartiroli entered and took his seat at the Council
table at 8:07 p.m.
Motion was made by Councilman Duffin seconded by Councilman
Wentworth to adopt Resolution No. 1012

1013. Motion was made by Councilman Eckard seconded by Councilman
Duffin that the reading of Resolution No. 1013 be waived and that it

Portuguese Society City Administrator Wood presented a request from the I.F.D.E.S.
Annual celebra- Portuguese Society of Gilroy to conduct their annual celebration and
tion parade on May 15, 1966. Motion was made by Councilman Duffin seconded
by Councilman Wentworth and carried that the I.F.D.E.S, Portuguese
Society of Gilroy be granted permission to conduct their annual cele-
bration and parade as requested.
Jr.Chamber Survey City Administrator Wood reported that Representatives Mr. Don
re:Community Malinoff and Mr. Gary Hughes of the Jr. Chamber of Commerce were present
facilities in the audience to explain the completed Questionnaire Survey of Com-
munity Facil ities. Mr. Don Malinoff addressed the Council and answered
questions regarding said Survey. The Mayor thanked the Jr. Chamber
for their report on said survey and adtised the Representatives that
the Council would take the Survey under advisement and study.

The Mayor stated that Representatives of the Southern Pacific
Railroad Company were present in the audience to report on Traffic De-
lays at the local Railroad Crossings. Mr. Harold Fulkerson, Train Mas-
ter of Watsonville; Mr. J. J. Tierney, Train Master of San Jose and Mr.
Paul Wilsen, Assistant Train Master of San Jose addressed the Council
and reported and explained the Company.s reasons why delays occur at
local Railroad Crossings. The Southern Pacific Representatives assured
the City that the I.O.O.F. Railroad Crossing would be kept open for
emergency vehicles at all times. Discussion was had regarding instal-
lation of an electronic system at the Fire Station alerting personnel
of trains approaching and leaving the City Limits. This matter was
referred to Staff for a feasibility study.
The Mayor thanked the Southern Pacific Company's Representa-
tives for their attendance at the Council Meeting and report on Traffic
Delays at local Railroad Crossings.
Director of Public Works Kludt presented and explained the re-
port of the Planning Commission Meeting of April 21, 1966 informing the
Council of no action taken on a Use Permit Ap~lication to the County
from Gerald Jones to construct a rest-home on the West side of Kern
Avenue between Vickery A~enue and Day Road. (In answer to the County's
request for comment the Commission pointed out to the County that the
property should be annexed to the City of Gilroy'within a one year
period and hopefully in an improvement district within eighteen months.)
The Planning Commission report also informed the Council that it recom-
mended against the request of J.R. Musso to rezone 11.538 acres from
R-I-A: B-4 to "A", exclusive Agriculture on the East side of Morey'
Avenue between Day and Hecker Pass Roads due primarily to the effe2t
on future street patterns; requesting the Council to go on record with
the County as being opposed to "Greenbelt'l Zoning for smaller parcels
and n~ting that the request for a Use Permit to construct a mfgrant
labor camp was withdrawn by the Progressive Growers Association&

Greenbelt Zoning Motion was made by Councilman Wentworth seconded by Councilman
Policy Eckard and carried that Staff notify the County Planning Commission that
the City Council is opposed to "Greenbelt" Zoning for smaller parcels as
recommended by the City Planning Commission. Councilman Allemand voted
"no" on the motion. It was also noted that the City conduct an educational
program regarding future proposed annexations in notifying property owners
that they will not lose their farming operations when they become a part
of the Ci ty.

Meet.
City Administrator Wood reported on the Parks and Recreation
Commission recommendation that the City acquire a parcel of property
immediately adjoining the eastern boundary of Elliot School for play-
ground and park purposes. Mr. Carmen Filice, representing the Commission,
addressed the Council and further explained the Parks and Recreation
Commissions' proposal. The Council took the matter under advisement
and study.

City Administrator Wood reported on an application to the Alco-

City Administrator Wood also reported that all reports regarding
the appl!c~tion for a Card Room License at Gilroy Bowl had not been
received7~nat Staff did not have recommendations on this matter at this
time. Motion was made by Councilman Allemand seconded by Councilman
Goodrich and carried that Staff be authorized to notify the Alcoholic
Beverage Control Board tha.t the City has no objections to said "On Sale
Genera 1 Li quor Li cense" at G i 1 roy Bowl.
Fun Fair Shows City Administrator Wood reported on a Request of Fun Fair Shows
for Amusement Rides at Town Plaza Shopping Center, June 1-5, 1966.
Motion was made by Councilman Wentworth sec~ded by Councilman Duffin
and carried that the request of Fun Fair Shows for Amusement Rides for
a license at Town Plaza Shopping Center on June 1st through 5, 1966 be
approved subject to proper indemnification, adequate police and fire
protection and that they adhere to operating hours establ ished in the
past and ps explained by the City Administrator.
701 Plan.Grant City Administr.ator Wood reported on the Progress of the 701
application Planning Grant Appl ication. City Administrator Wood also noted that the
Open-Space Grant for Miller Park had been approved.

Camp Tour
The City Administrator reported on a recent Tour of the Migrant Labor
Camp at Indio, California by City Officials. Discussion was had regard-
ing support by the City regarding Migrant Labor Camp.s. Motion was made
by Councilman Duffin seconded by Councilman Eckard and carried that the
City take no action on the proposed Migrant Labor Camp and to not consider
entering into a program for a Migrant Labor Camp at this time, to request
County cooperation on a future program, and to refer the matter to the
Local Housing Authority. CO,uncilman Allemand voted "No" on the motion.
Cap~lmp.Program' City Administrator Wood reported on the Council Study Session
1966-1971 and Revisions to the Capital Improvement Program for 1966-1971. Discus-
sion was had.

City Emgineer Hanna reported on the Sixth Street Overpass Study
recommending that said overpass be proposed for Tenth Street rather than
Sixth Street. Discussion was had. Council agreed and instructed Staff
to proceed with proposals and sketch designs for submission to the State
regarding an Overpass at Tenth Street.
Motion was made by Councilman Goodrich seconded by Councilman
Eckard. and carried that the 1966-1971 Capital Improvement Program as
presented with revisions be approved.

The City Engineer reported on the Miller Avenue Crossing at
Uvas Creek to be estimated in the amount of $163,000.00 for Engineering
and Contingencies.

Funds
The City Engineer reported on the proposed Assessment District
for the Extension of North Church Street. The Council requested a
meeting with the property owners affected in the proposed Assess-
ment District to determine if the property owners from Welburn to
Ronan Avenues would agree to said Assess-ment District to complete the
entire project as presented and subsequently determine the interest
of those owners between Ronan and Farrell Avenues.
Director of Public Works Kludt presented and explained a petition
for accumulation of Section 186.1 Gas Tax Fund~. Motion was made by
Councilman Wentworth seconded by Councilman Allemand and carried to
approve the Petition to accumulate the total apportionment of Section
186.1 Funds for the 1963-1964 fiscal year; the required matching
funds in the amou~t of $21,340.00 will be provided from the City's
General Fund and the Directo~ of Publ ic Works, Max D. Kludt, is here-
wit~ authorized to execute the petition.
Appointment of The Mayor presented the following names for Commissioners to
Housing the Housing Authority: Mr. Arch Finney, Chairman - 1 year term; Mr.
Authority Arch Finney, Chairman - 1 year term; Mr. Fred Sanchez - 2 yrs.;
Commissioners Rev. William Sanford - 3 yrs.; Mr. Trevis Berry - 4 yrs.; and Mr.
Frank Aldridge - 4yrs. Motion was made by Councilman Goodrich
seconded by Councilman Allemand and carried that the names selected
by the Mayor for Commissioners to the Housing Authority be confirmed
and approved by the Council.

Motion was made by Councilman Goodrich seconded by Councilman Went-
worth to adopt Ordinance No. 766.

AN ORDINANCE OF THE CITY OF GILROY AMENDING SUBDIVISION 4 OF SECTION
13.40 OF THE GILROY CITY CODE BY PROVIDING THE LICENSE FEE TO BE PAID
BY AUCTIONEERS MAINTAINING A FIXED PLACE OF BUSINESS IN THE CITY OF
GILROY, DIVIDING SAID SUCTIONEERS INTO TWO CLASSES, AND PROVIDING FOR
A LARGER FEE TO BE PAID BY AUCTIONEERS HAVING NO FIXED PLACE OF
BUSINESS IN SAID CITY, DECLARING THE ORDINANCE TO 6E JW EMERGENCY

City Administrator Wood presented and read letters from S~aators
Kuchel, Murphy, Bradley, Governor Brown and Congressman Gubser in re:
to their support on the Freeway Bypass at Gilroy.
The Mayor Noted the 9th Biennial Mayors and Councilmen Institute
in Monterey on May 22-25, 1966.
The Mayor noted the Inter-City Council Meeting on Thursday, May
5, 1966 at the Sakura Gardens in Mt. View at 8:00 p.m.
Councilman Duffin inquired of the progress of installation of
barbecue pits at Christmas Hill Park. Director of Public Works
Kludt reported that the small barbecue pits had been installed and
that the large pit is anticipated to be installed soon by the Agri-
culture students of the High School. Discussion was had regarding
signing Xmas Hill Park and dedication of the grounds. Discussion
was also had regarding a part-time Supervisor at the Xmas Hill Park
grounds on week-ends.
Councilman Eckard inquired about the exceptionally large dip
in the street for drainage purposes at First and Miller. Director
of Public Works Kludt reported that a pipe invert is planned for
this location next budget year.

. Councilman Allemand requested that the clock at the Old City Hall
be corrected to Day Light Savings Time. Director of Public Works Kludt
reported that he had made the correction today.
Councilman Eckard reported that the lights on the West Side of the
Old City Hall Clock were out. Director of Public Works Kludt indicated
that this would be corrected.
Councilman Wentworth inquired about the 2 hr. parking limit sign
installed at the Parking Lot at the Old City Hall site.
