Gilroy, California July 18, 1966 The regular meeting of the City Council was called to order by His Honor ~enneth L. Petersen at 8:05 P.M. Present: Council Members: John E. Allemand, George T. Duffin, Chester R. Eckard, Norman G. Goodrich, Charles F. Quart- irol i, Everett C. Wentworth, and Kenneth L. Petersen. The minutes of'the regular Council Meeting of July 5, 1966 were approved as mailed and recorded. City Administrator Wood presented and explained the report of the Planning Commission meeting of July 7, 1966 informing the Council of a Public Hearing date set before the Commission of August 4, 1966, for a rezoning request of Mr. & Mrs. John Stelling and Dr. TakiAnaghoston to rezone a 3.54 acre parcel of land located at the Southwest corner of Sixth and Princeva11e Streets from IIR_l", Single Family Residence District to rrCO", Commercial Office District. City Administrator Wood presented and explained a report of the Personnel Commission meeting of July 12, 1966 recommending approval of the establ ishment of the new classification of City Engineer at Salary Range 33, $846.00 to $1,028.00. Monthly Report City Administrator Wood presented the Summary of Monthly Reports of June 1966. Discussion was had on said Reports. Disbursements City Administrator Wood presented the Report of Disburse- ments from June 11,1966 to July 10,1966. The reports as presented were ordered to be placed on file. Water Samples The report of Water Samples taken by the Santa Clara County Health Department were presented and ordered filed. Div.of Hwys. re: Murray Ave. Ext. Sewer Serv. On-Sale Beer &WineLic- ense re: Mexico Cafe Final Map Westwood Acres Unit #3 ' Ord. #770 re: 165 Fire Code Cigarette Tax Ord. City Administrator Wood presented a Report on a meeting with the Division of Highways in re: to the Extension of Murray Avenue. City Administrator Wood recommended that the matter of Official Plan Lines on Chestnut Street be referred to the City Engineer as he is presently working on Official Plan Lines forthe extension of Murray Avenue and that same be referred to the Planning Commis- sion for study and that property owners in the area be notified in regard to future development. Council concurred with referring the matter of Official Plan Lines on Chestnut Street in connection wi th Route "B" as presented. City Administrator Wood presented an additional report on Sewer Service rates. Motion was made by Councilman Goodrich seconded by Councilman Wentworth and carried to approve a change in the proposed Sewer Service Charge for Duplexes to not exceed a maximum charge of $2.00. The City Attorney presented a proposed ordinance establ ishing Sewer Service Charges for introduction. Motion was made by Councilman Goodrich seconded by Councilman Alle- mand and carried that the proposed ordinance establishing Sewer Service Charges with correstions be introduced, the reading waived, and that it be publ ished by title and summary. Council set October 1, 1966 as the effective date of Sewer Service Charges to become effective and set no service charge for connection or disconnection of said service. City Administrator Wood presented a Report on an Appl ication to the Alcoholic Beverage Control Board for a Temporary On-Sale Beer and Wine License at the Mexico Cafe, 139 South Monterey Street. Motion was made by Councilman Goodrich seconded by Councilman Went- worth and carried that Staff be instructed to notify the Alcohol ic Beverage Control Board that the City has no objections to said appl ication. Director of Public Works Kludt resubmitted the Final Map of Westwood Acres, Unit #3 for approval. Motion was made by Council- man Wentworth seconded by Councilman Quartiroli and carried that the final map of Westwood Acres, Unit #3 be approved as resubmitted subject to execution of the Agreement, adequate Publ ic Utility Easements, and proper bonding. Ordinance No. 770 was presented for adoption regarding the 1965 Fire Prevention Code. Motion was made by Councilman Goodrich seconded by Councilman Wentworth that the reading of Ordinance No. 770 be waived and that it be adopted. ORDINANCE NO. 770 AN ORDINANCE ADOPTING A FIRE PREVENTION CODE PRESCRIBING GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR EXPLOSION , AND ESTABLISHING A DIVISION OF FIRE PREVENTION AND PROVIDING OFFICERS THEREFOR, AND DEFINING THEIR POWERS AND DUTIES. PASSED AND ADOPTED this 18th day of July, 1966, by the following vote: AYES: COUNCILMEMBERS: Allemand, Duffin, Eckard, Goodrich, 4uairirol i, Wentworth, and Petersen None None NOES: ABSENT: COUNCILMEMBERS: COUNCILMEMBERS: Mr. Cal LeNeave, addressed the Council, and opposed the adoption of the proposed Cigarette Tax Ordinance, and briefly dis- cussed his reasons of opposition to said ordinance. Councilmembers were given copies of the proposed ordinance. The Mayor appointed a Council Committee (Wentworth, Goodrich, and Eckard) to study the present license tax for Vending Machines. Housing Authority City Administrator Wood reported on the Organizational Meet- Com. ing of the Gilroy Housing Authority Commission and recommended al- location of $500.00 in order to proceed with processing of the application. Motion was made by Councilman Wentworth seconded by Councilman Duffin and carried that $500.00 be allocated for process- ing of the appl ication as recommended. Cal i f' s. Bicentennial Yr. Correc- re: report on City Jail Safety Award Golf Club Agreement Xmas Hill Park Dona- tion City Administrator Wood presented and read a letter from the Assembly California Legislature requesting the City to adopt a similar Resolution accompanying said letter, commemorating the history-making establishment of California's first permanent settlement in California on July 16, 1769 and concurring with proclaiming the year 1969 as Cal ifornia's Bicentennial Year. Motiop was made by Councilman Wentworth seconded by Councilman Allemand to adopt Resolution No. 1046 commemorating Cal ifornia1s Bicentennial Year. RESOLUTION NO. ]b~6 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY, STATE OF CALIFORNIA, GIVING CONSIDERATION TO COMMEMORATING THE HISTORY- MAKING ESTABLISHMENT OF CALIFORNIA.S FIRST PERMANENT SETTLEMENT. PASSED AND ADOPTED this 18th day of July, 1966 by the following vote: A YES: COUNCILMEMBERS: NOES: ABSENT: CO~NCILMEMBERS: COUNCILMEMBERS: Allemand, Duffin, Eckard, Goodrich, roli, Wentworth, and Petersen None None Quarti- City Administrator Wood presented and read a letter frmm the Gilroy Historical Society, Inc. requesting use of the Old City Hall as a Museum. Councilman Goodrich suggested that the ~ity sell the Old City Hall to the Historical Society for $1.00 with an Agreement that said Society renovates the Old City Hall within a specific time I imit subject to an annual review of the Council. Council instructed Staff to contact the Historical Society to determine when they could meet with the Council at a Work Study Session to discuss Councilman Goodrich's suggestion. City Administrator Wood presented a memo from the League of California Cities requesting the establishment of a Mayor1s Non- Partisan Voter Registration Committee. The Mayor took said matter under advisement. City Administrator Wood presented and read a letter from the Department of Corrections in regard to the 1966 Health Officer Report on the City Jail. Discussion was had on the matter. City Administrator Wood stated that he would contact the firm of Akol & Hansen to determine the estimated engineering cost involved in obtaining an independent engineering report on the matter of two additional bunk beds to be allowed in the City Jail. City Administrator Wood presented and read a letter from the California State Automobile Association in regard to a Pedes- trian Safety Citation Award to the City of Gilroy. City Administrator Wood recommended the Council meet with the Gilroy Golf and Country Club Pro to discuss the present Agree- ment to establish an understanding in regard to the increase of Golf Club Fees. Discussion was had. Council requested Staff to contact the Golf Club President, Mr. Ducoty, to first determine if the Board of Directors wish assistance in interpreting said Agreemen t. City Administrator Wood reported that he is in receipt of the $100.00 donation from Gilroy Foods, Inc. for improvements at Christmas Hill Park to be matchew with $100.00 of the new City of Gilroy funds as agreed by Council at the July 5, 1966 Council Meet i ng. (') Joa , Councilman Wentworth suggested that Council be thinking about some type of celebration in the year 1969 to commemorate Gilroy.s first establishment of a government in 1869. It was ~oted that the City of Gilroy was officially incorporated on March 12, 1870. Councilman Goodrich inquired about why the Bell & Griffin Building & Saccullo Building occupied by the NH3 Plant was not required to improve the street in front of said businesses. Director of Publ ic Works Kludt reported that the slurry-seal paving was all that was required. He also noted that in the future any development weuld be required to post a bond to cover one-half of the street paving cost when said street is paved by the City. Council instructed Staff to notify the present and future developers on Ninth Street that they would be required to pay one-half of the street paving cost when the paving is com- pleted by the City. The City Attorney presented and read Emergency Ordinance No. 771 Changing the Period of Time During which a Train May Block Traffic on a street from 5 minutes to 10 minutes. Motion was made by Councilman Wentworth seconded by Councilman Duffin to adopt- Ordinance No. 771. ORDINANCE NO. 771 AN ORDINANCE OF THE CITY OF GILROY AMENDING SECTION 15.14 OF THE GILROY CITY CODE BY CHANGING FROM 5 MINUTES TO 10 MINUTES THE PERIOD OF TIME DURING WHICH A TRAIN MAY BLOCK TRAFFIC ON A STREET. PASSED AND ADOPTED AND ORDERED PUBLISHED by title and summary within 15 days after the day of adoption as provided for in the City Charter by the following vote, this 18th day of July, 1966: AYES: COUNCILMEMBERS: Allemand, Duffin, Eckard, Goodrich, Quartirol i, Wentworth, and Petersen NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None Mayor Petersen inquired about City pol icy in regard to property owners installing sidewalk~, curbs and gutter on North Forest Street if the City will pay the cost of paving a portion of the street. It was noted that said work:would require estab- lishment of an Assessment District. The Mayor stated that he would contact the property cwners in this regar'd.
