Minutes 1967/01/25 l I q 6:) (') -- )..;.; Roll Call Relocation of house at 186 N.Eigleberry St. Gilroy, California January 25, 1967 The Special Meeting of the City Council was called to roder by His Honor Kenneth L. Petersen at 5:15 p.m. Present: Council Members: John E. Allemand, George T. Duffin, Chester R. Eckard, Norman B. Goodrich, Everett C. Wentworth, and Kenneth L. Petersen. Absent: Council Member: Charles F. Quartiroli. The Mayor stated the reason for this Special Meeting to review the Ordinance for House Moving Permits as a result of a request to move the house at 186 North Eigleberry Street. City Administrator Wood reported that it was his understand- ing that a House Moving Permit for the house at 186 North Eigle- berry Street had been issued, and then subsequently determined late this afternoon that an application for a House MovJng Permit had been obtained by the Contractor but had not been received by the City to date. He explained the previous action taken by the Council regarding moving of said house located at 186 North Eigle- berry Street. Mr. John O'Brien, Attorney representing sixty-three (63) residents in the vicinity of Fourth Street and Miller Avenue (site for proposa I to move Lawton House), addressed the Counc i 1 and 're-- viewed Section 6.2 of the Gilroy City Code requesting that same be followed regarding issuance of a moving permit for the resident at 186 North Eiglberry Street and particularly that an architect- ual plan be submitted including elevation plans for same prior to issuance of said permit; further that the Building Inspector grant or deny said permit and that Council act on an appeal if submitted by either party (any residents opposing moving of said' house or the applicant) depending upon conclusion of the Building Inspector. Council further discussed same. The City Attorney reversed his previous decision regarding issuance of moving permits and stated that the City must follow the procedure outlined in Section 6.2 of the Gilroy City Code in issuing moving permits. Council referred the proposed ordinance for House Moving Permits to the Planning Commission for study and recommendation. 0G2J Mr. Philip Lawton, addressed the Council, and stated that during the interim period of studying a new proposed ordinance that this would prohibit him from moving his house at 186 North Eigleberry Street to any location in the City. There being a time limitation required ending February I, 1967. City Administrator Wood stated that because of Mr. Lawton's sincerity and efforts expended in this matter that he would request the Mayor to call a Special Council Meeting if necessary, to facilitate moving of this house after architectual plans, including elevations, etc., were provided. City Administrator Wood reported that if a request for a house moving permit accompanied by elevation plans was presented to Staff that same would be presented to the Council, if necessary under Section 6.2 of the City Code. Council concurred and request- ed that this action be taken by Staff until a new Ordinance is adopted.
