Present: Council Members: George T. Duffin, Mark E. Kennedy, Jr., Everett C. Wentworth, and Norman B. Goodrich. and Silva. Absent: Council Members: Charles F. Quartiroli and John E,. All'eman d. The Minutes of the Regular Meeting of June 5, 1967 were approved as mailed and recorded. The Mayor stated that it was the time and place scheduled for the Continued Public Hearing on Engineer's Report re: Improve- ment of South Chestnut Street Extensj6n- Project No. 1967-1. City Administrator Wood reported that if the method of assessment was to be on an acreage basis that this would require an agreement among all property owners of the proposed Assessment District. He pre- sented and read a letter from Mr. Donald R. Engle, property owner, dated June 12, 1967 regarding .that he was in agreement with ,the method of assessment being on an acreage basis. The Mayor asked if there .was anyone in the audience wishing to speak for or against the proposed Assessment District. There was no comment from any- one in the audience. Mr. Phi I Assaf, Bonding Attorney for the City, addressed the Council and stated that if there was no fur- ther comment or written communications regarding formation of said proposed Assessment District, that the Public Hearing could be closed and a resolution adopted changing and modifying the proposed Assessment District and setting a Public Hearing date of July 3, 1967, on the Engineer's Report regarding Improvement of South Chestnut Street Extension - Project No. 1967-1. The Mayor asked if there was anyone in the audience wishing to speak for or against the proposed Assessment District. There was no comment from anyone in the audience. Motion was made by Councilman Kennedy seconded by Councilman Wentworth and carried that the Public Hearing be closed. Resolution No. 1124 was presented regarding Changing and Modifying the proposed South Chestnut Street Extension Project No. 1967-1 and setting a Public Hearing date of July 3, 1967 on same. Motion was made by Councilman Wentworth seconded by Council- man Duffin that Resolution No. 1124 be adopted. RESOLUTION NO. LL24 A RESOLUTION OF PRELIMINARY DETERMINATION AND OF INTENTION TO MAKE CHANGES AND MODIFICATIONS - SOUTH CHESTNUT STREET EXTENSION - PROJECT NO. 1967-1. PASSED AND ADOPTED this 19th day of June, 1967 by the following vote: AYES: COUNCIL MEMBERS: Duffin,Kennedy,Jr., Silva,Wentworth, and Goodrich None Allemand and Quartiroli NOES: ABSENT: COUNCIL MEMBERS: COUNCIL MEMBERS: Mr. Assaf, recommended that all other matters regarding formation of the proposed assessment district be taken under con- sideration at the July 3, 1967 Public Hearing. The Mayor stated that it was the time and place scheduled for the Public Hearing on the proposed 1967-68 Budget. City Administrator Wood presented a Report on the proposed 1967-1968 Budget. Councilman Quartiroli entered at 8:13 p.m. and took his seat at the Council table. Discussion was had on the propdsed 1~67-68 Budget. The Mayor a~ked if there was anyone in the audience wishing to speak for or against the proposed 1967-68 Budget. Motion was made by ~ouncilman Kennedy seconded by Councilman Duffin and carried that the Public Hearing be closed. City Administrator Wood presented Resolution No. 1125 approving the 1967-68 Budget. Motion was made by Councilman Wentworth seconded by Councilman Silva that the reading of , Resolution No. 1125 be waived and ,that it be adopted. RESOLUTION NO. 1125 RESOLUTION OF CITY COUNCIL ADOPTING BUDGET FOR SAID CITY FOR FISCAL YEAR 1967~1968 AND APPROPRIATING PROPOSED EXPENDITURES,'FOR PURPOSES SET FORTH IN BUDGET. RESOLUTION NO. 1126 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ALLOCATING THE VARIOUS EMPLOYEE CLASSIFICATIONS IN THE CITY SERVICE TO'APPROPRIATE RANGES AS DETERMINED BY STUDY OF THE PERSONNEL COMMISSION. Motion was made by Councilman Wentworth seconded by Councilman Duffin and carried that the pro- posed ordinance be introduced and published by title,and summary. Gilroy Prodcice re: City Administrator Wood presented and read a lett~r fr9m temporary Gi lroy Produce Distributors Inc. requesting Sewer Co~nection of sewer Temporary Office Trai ler in the Vicinity of Ninth and Railroad Streets. Discussion was had on the matter. Motion was made by Councilman Quartiroli seconded by Councilman Kennedy and carried that Gilroy Produce Distributors Inc. be granted Temporary Sewer Connection for one year, to be review~d yearly, for an Office Trailer located in the vicinity of Ninth and Railraad Streets. Low-Rent Housing , City Administrator Wood noted that the request of Mr. Ray Project Rossi to ex~lain a proposed Low-Rent Housing Project has been continued to the next Regular Council Meeting of July 3, 1967. Injury Claim re: City Administrator Wood presented an Injury Claim of Francis Francis Woods Woods filed June 14, 1967 and reported on Section 1112 of the City Charter regarding the filing of claims against the City. He stated thet said claim was filed after the 90 day Charter requirement. The City Attorney gave his opinion that said claim had been fi led in accord with State law which prevails over the City ,Charter since an injury claim has been declared a State-wide law. Motion was made by Counc i lman Wentworth seconded by Counc i:lman Duff i nand carried that said claim of Francis Woods .be denied as recommended by the City Attorney and that same be referred to the City Attorney. Motion was made by Councilman Wentworth seconded by Coun- cilman Duffin and carried that the Classification for Librarian Assistant be approved as presented and recommended. Waiver City Administrator Wood presented and read a letter from Police Patrolman Edward D. Pari requesting permission to reside outside the City Limits wi~hin Gilroy~sPlanning area. Said letter was accompanied by supporting letters from Judge Klarich, Mr. W.G. Jones, Probation Officer of Santa Clara County, Chief of'Police Laizure, and Lewis Johnson, Vice-Principal of Gilroy High School. Motion was made by Councilman Quartiroli seconded by Councilman Silva and carried that the request of Officer Parr be approved subject to remaining on the Gilroy Telephone System. Council tabled amendment to the Personnel Rules and Regulations regard i ng Res i dency Requ i rement as recommended 'by the Personne I Commission and advised that City Employees requesting to reside outside of the City limits would be reviewed individually and upon merit of the specific case, by the Council. ... Monthly Report City Administrator Wood presented the Summary of Monthly Reports of May, 1967. Said Repor.t was discussed and filed. Disbursements The Report of Disbursements from May 11, 1967 to June 10, 1967 were noted and discussed.' Report-Jt.Meet. City Administrator Wood reported on the Joint Meeting of Gilroy & M.H. Gilroy and,Morgan Hill Sewer Committee. Sewer Com. Write-Off Uncol- City Administrator Wood presented a Report from the Collec - lectable Water tion Section r~questing to Write-Off $323.74 : in Uncollectable Water & Sewer Accts. and Sewer'Accounts for the fiscal year ending June 30, 1967. Discussion was had on the matter. Motion was made by Councilman Quartiroli seconded by Councilman Kennedy and carried that the Un- collectable Water and Sewer Accounts as presented in the amount of $323.74 be written off as recommended Doting that $190.00 of same was covered by Deposits leaving a net loss of $133.74. Salary Increases City Admi.nistrator Wood recommendee step increases in the Salary Pay Plan for the Following employees to become effective July I, 1967; Morris R. Whiting, Water Foref!1an, Range 24, from Step "CII $602. to Step 11011 $631. and Alice Ortega, Account Clerk, Range 16, from Step "C" $407. to Step "D" $427. Motion was made by Councilman Wentworth seconded by Councilman Duffin and carried that step increases be approved as recommended. Budget Amend- ments, etc. 67-68 Budget Amendment City Administrator Wood presented ahd explained a request for Transfers, Amendments and Encumbrances Under the Current 1966- 67 Budget. Motion was mqde by Councilman Wentworth seconded by Councilman' Kennedy and carried that the Transfer, Amendments and Encumbrances as follows under the current 1966-67 Budget be approved: Transfers: From 1966 to 2B2 - $500.00; From 3B6 to '7B6 - $800.00; From 14Al to 8Bl - $1,100.00; From 14Al to ~B12 - $1,800. From 3B6 to 9B7 - $20.00; From 4B6 to 37Bl - $500.00; From 5B6 to 37Bl - $ $QOO.OO; From llB6 to 37Bl - $400.00; From 14Al to 37B12- 560.00; From 15B15 to 37BI2 - $900.00; From 30Bl5 to 37Bl2 - $600. Budget Amendment Increases: To Increase 8C4 - $2,000.00; 12B32 - $1,350~00; 12B60 - $23,137.00; 35C2 - $23,5~5.00; 35C2 - $13,500.00. Encumbrances: $35,146.00 for the Equipment or projects recommended; - and that the 1967-68 Budget be amended in the amount of $1,800.00 to increase Account 23C2 for the Golf Course Improvements as recom- mended. 26'76 Insurance Bids '~City Administrator Wood reported on the Multi-Peril Insurance Coverage Bids. Com.Meet. City Administrator Wood reported on an Application for an On-Sale Beer and Wine License at 36 S. Monterey Street, Gilroy. Motion was made by Councilman Wentworth seconded by Councilman lennedy and carried that Staff notify the Alcoholic Beverage Control Board that the City has no objections to said application. Fire Chief Brittain requested Council to set a Public Hearing date of Monday, July 3, 1967 at 8:00 p.m. for hearing the Report for Assessments regarding Weed and Refuse Abatement. Motion was made by Councilman Wentworth seconded ;by Councilman Silva and carried that said Public Hearing date be set for July 3, 1967 at 8:00 p.m. as requested. Ordinance No. 798 modifytng the Bicycle License Fees was presented for ado~tion. Motion was made by Councilman Wentwo~th seconded by Councilman Silva that the reading of Ordinance No. 798 Modifying the ~icycje Lidense Fees be waived and that it be adopted. ORDINANCE NO. 798 ORDINANCE OF THE CITY OF GILROY AMENDING SECTIONS 5.5, 5.7 and 5.10 OF CHAPTER 5 OF THE GILR~Y CITY CODE BY ELIMINATING FROM SAID SECTIONS ANY CHARGE FOR REGISTERING OR LICENSING OR REREGIS- TERING BICYCLES. The Minutes of the Santa Clara County Planning Policy Executive Committee Meeting of May 25, 1967 and the Agenda for the June 22, 1967 Meeting was noted. Councilman Wentworth noted that he would be attending the June 22, 1967 Meeting and asked if any . of the Council wished to attend with him. Contribution re: A letter from the City of San Leandro was presented and World's Fair ordered filed in regard to Contributions for "Young America" Trip to the Wor~d's Fair. ~ ..... ..... - ...-- ~ ....~... Bethel Church Bldg.Permit 26-77 A letter from E. Rusconi, Attorney, was presented and read in regard to the Bethel Church Building Permit. Said letter' was ordered filed and future coreespondence regarding same to be ~eferred to the City Attorney. It was noted that the Bethel Church had been notified that this Injunction Action was pending. Regional Governm't. A letter from the City of Newark was presented in regard to Regional Government. City Administrator Wood reported on same. So.Co.Airport A letter from the Clerk of the Board of Supervisors in regard to the South County Airport was presented. The Mayor instructed the City Administrator to decide whether a meeting with the Board of Superviso5s was necessary or if a letter to the Boare would suffice. "...... ...... S. Church Ext. Thomas Rd. Sti les at Golf Course N.Church St. Ext. Proj. to City Administrator Wood presented a letter from Gavilan College in regard to Requesting that South Church Street be extended to Thomas Road. Council instructed the City Administra- tor to notify the Board of Supervisors that the City is interested in this matter, requesting that a Reimbursement Agreement regard- ing development fees be proposed. Councilman Kennedy informed that the fence stiles at the Golf Course are in need of maintenance repairs. It was noted that the Golf Course was responsible for maintenance and request- ed that they be notified of same since the City is liable for injuries incurred at the Golf Course. Director of Public Works Henry noted that the City is in the process of removing the dirt in the gutters of the North Church Street E~tension Project. He also informed the Council that the Contractor has been notified and will be repairing the spots in the street that have settled. Co.Library Meet. Councilman Wentowrmh presented and City Administrator Wood read the Summary of the County Library Meeting in San Jose prepared by Chief Librarian Mary Goshert. ...... Lew i s St. Li ne Road to Xmas Hi 11 Park Sewer Director of Public Works Henry reported that the Lewis Street Sewer Line Project would be proposed for installation soon. The City Attorney noted that if the ;quotations exceeded $2,500.00 that same would have to be advertis~d for bids. Direc- tor of Public Works Henry noted that if same exceeded the $2,500. limit that only a portion of the work would be allowed at this time. Councilman Silva informed the Council that the County is having problems obtaining the0proper right-of-way from the pro- pertyowner in regard to the road to Christmas Hill Park. St.lmp.Projects Director of Public Works Henry noted that Granite Constru- ction Cmmpany has started the Street Improvement Projects through- out the City. Med i ca I Ins. re: Counc i I -, ..... League of Conf. Personnel DirectorReinsch requested that Council Members desiring Medical Insurance with the City complete the required forms. The Mayor noted Planning Commission Representative Childers presence, at this meeting. Calif. City Administrator Wood informed the Council of the Announcement received for the Annual League of California Cities Conference to be held in San Francisco on October 15-18, 1967. Council requested hotel reservations be made early in order to receive accommodations at the desired hotel. Secretary of the ~ 0678 Planning Commissron Henry noted that the' Planning Commission would be sending two Commissioners to said Conference.
