order by His Honor Mayor Protempore Everett C. Wentworth at 8:00 p.m.
Pre-sent: CouncLl Members: John E. Allemand, George T. Duffin,
Mark E. Kennedy Jr., Anthony C. Silva, and Everett C. Wentworth.
Absent: Council Members: Norman B. Goodrich.Also present:
Charles Quartiroli.
The Mayor Protempore introduced new City Employees, Jacqueline
Martin, Account Clerk; Robert Waters Police Patrolman; and Michael
Larsen, Police Cadet.
The Minutes of the Regular Meeting of July 3, 1967 were
approved as mailed and recorded.
City Administrator Wood reviewed conditions set down in propos-
al of Elks Lodge to purchase City owned property and verified
publication of public notice in newspaper on July 5 and 12, 1967,
inviting other bids from interested persons.
Mayor Protempore asked if anyone in the audience wished to
submit additional proposals regarding same. There was no comment
from anyone in the audience. Motion was made by Councilman Allemand,
seconded by Councilman Kennedy, and unanimously carried that thebid
from the Elks Lodge No. 1567 be accepted subject to the City's Con-
ditions and others set down in the publication.
Mayor Protempore appointed Councilmen Kennedy, Silva, and
Allemand to a committee to work with the Elks on their building
program.
City Engineer Henry presented and read a letter from Elmer J.
Serpa requesting acceptance of payment for installation of curbs and
gutters on his property at the wests ide of Hanna Street between First
and Broadway, less interest which was added for non payment. Mr.
Serpa stated that he had never received a bill for payment and be-
levied the charges had been added to his property tax bill. On
motion by Councilman Quartiroli, seconded by Councilman and unani-
mously carried to Accept Mr. Serpa's payment less interest'1\
(sedonded by A. Silva.)
Set a public hearing for August 7, 1967 to consider require-
ment of installation of sidewalks at Elmer Serpa property on North
Hanna Street.
The request of Mr. Ray Rossi to explain a proposed Low-Rent
Housing Project was tabled because Mr. Rossi was not present.
Request of Director of Public Works presented and explained the request
Jack & Vicky's of Jack and Vicky's Fruit Stand to install 3 signs at the Southeast
Fruit Stand corner of Monterey and Ninth Streets.

Motion by Councilman Allemand seconded by Councilman Silva and
unanimously carried to grant request of Jack and Vicky's Fruit Stand
to erect three portable signs at the south-east corner of 9th and
Monterey Streets subject to presentabnityofthe signs to be deter-
mined by the Director of Public Works periodically.
Secretary of the Planning Commission presented and explained
the report of the Planning Commission meeting of Thursday, July 6,
1967 informing the Council of a public hearing held before the Com-
mission on the request of Joe F. Filice for rezoning of his property
located at Ninth and Pacheco Pass from IIR_l", Single Family Residence
to IM-2", Light Industrial District; Reviewed and Recommended final
Map 'INorthwood" Subdivision of Morey Avenu~ subject to completion of
necessary easements as outlined by City Engineer; Re-approved the
Tentative Map of Westwood,Subd,ivision Units 3 and 4 and the approval
of the Final Map of Unit 3; The Tentative Map was re-submitte~ for
approval due to the expiration of the one year limitation; the Com-
mission unanimously approved the Tentative Map of Unit 3 and 4 and
the final map of Unit 3 subject to the same requirements as were on
Units I and 2; Review of a preliminary map submitted by Mr. Fenton
O'Connell for a 21 lot subdivision on the westerly side of Miller
Avenue from the Castlewood Subdivision tothe curve on South MilleT
Avenue. The Commission directed the Staff to work out street
patterns in the area with Mr. Walter Hanna the developers Engineer,
prior to formal submittal of the Tentative Map.

Council set Monday, August 7, 1967 as Public Hearing date to
hear the rezoning request of Joe F. Filice to re20ne his property
located at Ninth and Pacheco Pass from "R-l'l, Single Family to IM-2",
Light Industrial District.
The Summary of Monthly Reports of June 1967 were noted and
discussed.
Council discussed complaints received due to City spraying of
trees on private property. Motion by Councilman Quartiroli seconded
by Councilman Silva and carried to spray only City Trees in the
future. Mayor Protempore Wentworth votes No.

The Report of Disbursements from June 11, 1967 to July 10, 1967
were noted and discussed.

recommended.
City Administrator Wood reported on Miller Avenue Crossing at
Uvas Creek.
Council instructed Staff to Study the possibility of install-
ing a cement slab ecross the Uvas Creek and report to Council at the
next regular meeting.
City Administrator Wood reported on ~e Second Draft of the
Joint Sewer Agreement.

Mr. Walter Hanna, Addressed the Council, and asked if he could
submit a proposal on the hydraulic study discussed for the sewer
treatment plant. Council invited Mr. Hanna to submit a proposal.
The City Administrator requested guidance as to how many engineering.
firms shpuld be invited to submit proposals.

Council indicated that fbrsthis small study Carollo and Asso-
ciates, who did a previous study and Mr. Hann's firm would be
sufficient.

Chief Laizure reported on Vehicular Accidents at Fourth and
Hanna Streets. Chief Laizure stated that in his opinion installa-
tion of stop signs at Fourth and Hanna Streets is not warranted at
th i s time.
Council co~curred with Chief Laizure's opinion.
City Administrator Wood reported on the Service Agreement
with Title Insurance and Trust Company
Motion was made by Councilman Duffin seconded by Councilman
Allemand and unanimously carried authorizing the execution of said
Agreement.
City Administrator presented and read a letter from
County Housing Authority. He noted a meeting has tentatively been
set for Friday, July 21, 1967 to discuss the matter with the
Housing Authority and request their recommendati on to Council.
Mayor Protempore noted that he would contact Mr. Jim Worley
to determine if he would accept an appointment to the Local Housing
Author i ty.
A proposed Ordinance was presented and read amending Sec.
23.7 of the Gilroy City Code pertaining to the parking of Taxi Cabs,
Rent Cars and Busses in certain areas of the City. Motion was made
by Councilman Kennedy Seconded by Councilman Allemand and carried
that the proposed Ordinance be introduced and published by title and
summary.
Cirector of Public Works presented and reviewed the Tentative
Map of Westwood No.3 and 4. He explains that due to expiration of
one year limitation it was necessary to re-submot the Tentative Map.

Kennedy and carried that the Tentative Map of Westwood No. 3 and 4
be approved as presented.
Director of Public Works presented and explained the Final Map
of Westwood Unit No.3.
Motion by Councilman Quartiroli, seconded by Councilman Kennedy
and carried that the Final Map of Westwood Unit 3 Subdivision be
approved as presented.
Director of Public Works presented and explained the Final Map
of "Northwood" Subdivision Tract 4351.

as submitted.

Fire Chief Brittain presented plans and specifications for one
new Fire Pump~r and requested authorization to call for bids.
Discussion was had and Council concurred that whereby name
brands are listed in bid form it state~ that equal or better may be
substituted providing bidder clearly identifies item.
Motion by Councilman Quartiroli, seconded by Councilman Duffin
and carried to approve specifications with corrections and authorized
call for bids for one new Fire Pumper.

Ordinance in re: to Sec. 53.2 of the City Code providing that the
Expansion of Existing Church Buildings and Structures shall not in-
clude a Building or Structure that takes the place of an Existing
Structure or Building.
Resolution No. 1135 was presented regarding instituting pro-
ceedings to amend Sec. 53.2 of the City Code and proposal to be re-
ferred to the Planning Commission to take steps required by the Zon- '
ing Ordinance relating to such amendment.

Motion was made by Councilman Allemand, seconded by Councilman
Duffin and unanimously carried, said Resolution was adopted.
RESOLUTION NO. 1135
RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF GILROY TO
CAUSE PROCEEDINGS TO BE INSTITUTED, AND NOW INSTITUTING SUCH PRO
CEEDINGS, FOR THE AMENDMENT OF SEC. 53.2 OF THE GILROY CITY CODE-
TO PROVIDE THAT THE EXPANSION OF EXISTING CHURCH BUILDINGS AND
STRUCTURES SHALL NOT INCLUDE A BUILDING OR STRUCTURE THAT TAKES
THE PLACE OF AND IS USED INSTEAD OF AN EXISTING STRUCTURE OR
BUILDING.

Sity Administrator presented and explained landscaping plans
of the depot property and noted that a presentation would be made
to the Parks and Recreation Commission.
City Administrator Wood noted a meeting with the Council-Golf
Committee at the Golf and Country Club on July 24, 1967, 8:00 P.M.
at the Country Club.
City Administrator Wood presented a letter mailed to Mrs.
Fazio re: to street improvements.
Mayor Protempore Wentworth reported Mrs. Fazio's offer to
sell the property to the City.
Councilman Kennedwasks if a reply was received from the
County in re: to Extension of South Church Street to Thomas Road.
City Administrator noted a meeting with the County on Friday, July,
21, 1967 at 2:00 P.M. in the Council Chambers.
City Administrator Wood reported on the meeting in Sacramento
on July 19, 1967 in re: to 101 By-pass.
Councilman Allemand asked what was being done about trees
that block view of stop signs at the corner of Lewis and Forest, and
3rd and Eigleberry Streets.
Councilman Allemand asks for explanation of the Retirement
Plan being offered by the State. City Administrator Wood explains
that the State made its presentation and another meeting is scheduled
to explain our present plan and adjustments thereto.
Councilman Silva asks what is being done about grass and
weeds growing around the building at 6th & Railroad. Fire Chief
reports that the City Crew will be removing weeds on Thursday and
if the property owner hasn't abated by that date the City Crew will
remove and assess the property owner.
City Librarian notes that she will attend a Library Convention
from July 22 to 26th, 1967.
FireChief noted that the Department attended funeral services
for George E. Pierce on July 11, 1967 who was a member of the Volun-
teer Fire Department for 41 years. A Resolution in his memory is to
be submitted at the next regular Council Meeting.

City Barbecue Assistant City Administrator noted that the City Barbecue
will be held on August 19, 1967.
Mayor Protempore noted Planning Commissioner Don Malinoff's
presence at this meeting.
At 10:45 P.M. motion was made by Councilman Allemand seconded
by Councilman Quartiroli and carried to adjourn.
