Pub.Hear.re: Serpa Prop. sidewalks 2689 Gilroy, California August 7, 1967 The regular meeting of the Gilroy City Council was called to order by His Honor Mayor Protempore Everett C. Wentworth at 8:02 p.m. Present: Council Members: John E. Allemand, Mark E. Kennedy, Jr., Charles F. Quarti rol i, Anthony C. Si lva, and Everett C. Went- wor th. Absent: Council Members: George T. Duffin and Norman B. Good- ri ch. The Minutes of the Regular Meeting of July 17, 1967 were ap- proved as mailed and recorded. The City Attorney presented and read Resolution No. 1136 in Memory of George E. Pierce. Motion was made by Councilman Allemand seconded by Councilman Quartiroli that Resolution No. 1136 be adopted. Said Resolution was signed by all Council Members present and presented to George E. Pierce ,Jr. by Mayor Protempore Everett C. Wentworth. RESOLUTION NO. 1136 RESOLUTION ADOPTED BY THE CITY COUNCIL OF THE CITY OF GILROY FOR THE PURPOSE OF MAKING A PERMANENT RECORD UPON THE OCCASION OF THE PASSING OF GEORGE E. PIERCE, A LONG TIME DEDICATED MEMBER OF THE GILROY VOLUNTEER FIRE DEPARTMENT. PASSED AND ADOPTED this 7th day of August, 1967, by the following vote: AYES: COUNCIL MEMBERS: Allemand, Kennedy,Jr., and Wen twor th. None Duffin and Goodrich. Quartiroli ,Silva, NOES: ABSENT: COUNCIL MEMBERS: COUNCIL MEMBERS: The Mayor Protempore stated that it was the time and place scheduled for the Public Hearing on the proposed rezoning of Joe F. Filice 4.865 acre parcel of land located on Ninth Street and Pacheco Pass Highway from R-l to M-2. City Administrator Wood explained the location of said proposal. Director of Public Works Henry explained the recommendation of the Planning Commission on the proposed rezon-' ing. Mayor Protempore Wentworth asked if anyone in the audience wished to speak for or against the proposal. There was no comment from anyone in the audience Motion was made by Councilman Allemand seconded by Councilman Kennedy and carried to close the Public Hearing. The City Attorney presented and read a proposed ordinance rezoning said property. Motion was made by Councilman Kennedy seconded by Councilman Quartiroli and carried that the proposed ~rdinance be introduced and published by title and summary. The Mayor Protempore stated that it was the time and place scheduled for the Public Hear.ing to consider requirement of sidewalk installation at 597 North Hanna Street, property belonging to Mr. 96fJO Self-Help Project (Hous i ng) Recess Plan. Com. Report 8/3/67 Design Award Program Salvation Army proposal re: purchase of City Prop. Elmer J. Serpa. The Mayor Protempore asked if there was anyone in the audience wishing to speak for or against the proposed sidewalk installation. Mr. Elmer J. Serpa, 1402 Brookdale Drive, San Jose asdressed the Council indicating that he had no objection to said sidewalk installation but requested payment to the City for said installation on June 1968. Discussion was had. Motion was made by Councilman Kennedy seconded by Councilman Allemand and carried to close the Public Hearing. Motion was made by Councilman Quartiroli 6econded by Councilman Silva and carried that the Director of Public Works be instructed to proceed with installation of sidewalk at the above property belonging to Elmer J. Serpa as required by ordinance and that payments be arranged as per discussion which was that Mr. Serpa furnish a Bond guaranteeing payment to the City of Gilroy in June of 0968 for said sidewalk installation, and if not paid on the date agreed that same would be applied to Mr. Serpa's tax bill. Mr Joseph'Sarsoza, Area Service Center Director, addressed the Council and requestedthe City of Gilroy to. officially endorse the proposed Self-Help Housing Project, and further explained the proposed project in detail. Mr. George Hoenck, Denton Wolfe, and Mrs. Jean Bino property owners from the general area of the Housing Project addressed the Council respectively, and opposed the proposed location of said Housing Project. Discussion was had. Mr. Paul Gallegos, General Contractor~ for said project addressed the Council and further explained the type of housing proposed. Motion was made by Councilman Quartiroli seconded by Councilman Allemand and carried that the proposed Self-Help Housing Project as presented be approved subject to such conditions as conditions may arise or present them- selves to the City hereafter and agreed that the City will provide Sewer and Water facilities for said projeft at the outside-city rates. Mr. Donald Malinoff, representing the Planning Commission, addressed the Council and stated that the Planning Commission would judge the proposed Self-Help Project on its own merits. At 9:40 p.m. the Mayor Protempore declared a recess. Said meeting was reconvened at 9:Y5 p.m. Secretary of the Planning Commission Henry presented and ex- plained the report of August 3, 1967 meeting informing the Council of a Public Hearing held to consider the petition of Mr. M. Chiesa for a Conditional Use Permit to construct and operate a Mobile Home Park in a 16.44 acre parcel of land fronting Monterey Highway, north of Farrell Avenue, granting said Conditional Use Permit: informing Council of the following Public Hearings set for September 7, 1967 proposed rezoning of the Lutheran Church Property on Hecker Pass Highway from an "I-ZI1 Zone to 'IR_l" Zone amendment to Section 53.2< of the Zoning Ordinance regarding expansion of existing Church build-' ings and structures hear the request of Radio Station KPER to erect a 110 ft. radio tower at property located at 59 North Monterey St.; informing Council of off-street parking requirement studies present- ed by Planning Consultant, Mr. Warren Jones, to be further studied by Commission for possible amendments to the Zoning Ordinance. The Mayor Protempore deviated from the Agenda in order to ac- comodate interested persons in the audience regarding the following items: City Administrator Wood presented a letter from the American Institute of Architects in re: to 'ICommunity Design Award Program." Mr. Paul Bosholm, Representative, addressed the Council and further explained said program. Said matter was referred to Staff for study to determine noteworthy projects to be submitted for said Design Award Program. City Administrator Wood presented and read a letter from the Salvation Army proposing to purchase City property on South Monterey Street for $15,000.00. Discussion was had. Council noted that they did not wish to sell said property for less than the original purchase price of $20,000.00. Capt. H. Hall, San Jose, representing the Sal- vation Army, addressed the Council and noted that he believes that his organization could come to terms with the City of Gilroy for said property and that they would submit another offer at a later date. - ..., - ..- f' - ..... 2691 Water Samples City Administrator Wood presented a Report on satisfactory Water Samples taken by the Santa Clara County Health Department and same was ordered to be filed. Burglar Alarm Panel City Administrator Wood presented a Report on the Annual Meet- ing with the Board of Directors of the Gilroy Golf and Country Club in regard to improvements (tollet-storage building and resurfacing the parking area) and membership rates at the Golf Course. Means of financing these improvements were discussed. The Golf & Country Club are to make recommendations on these matters to the City Council. City Administrator Wood presented a Report on an Application to the Alcoholic Beverage Control Board to Transfer an Off-Sale Li~uor License at 731 First Street recommending no objections to said transfer. Council had no objections to same and ordered Staff to notify the Alcoholic Beverage Control of said action. City Administrator Wood presented a Report on Street Closures at Citizens Request for Organizational and Neighborhood Functions. Motion was made by Councilman Kennedy seconded by Councilman Silva and carried that a policy be established to charge the following fees for closing of certain streets: $10.00 minimum charge for closing streets for neighborhood functions and $25.00 fee for closing of certain streets that require additional service such as washing and sweeping. City Administrator Wood presented a Report re: 1940 American LaFrance Pumper in regard to rebuilding the engine. Council had no objections to said report. City Administrator Wood presented a Report on Traffic at 6th & Monterey Streets noting that the situation at said location was improved due to the opening of 7th Street and that said intersec- tion will be reviewed periodically. City Administrator Wood presented and explained a Report on the Burglar Alarm Panel. Discussion was had. Motion was made by Councilman Quartiroli seconded by Councilman Silva and carried that Alternate No.3 of said report which would authorize installation of the backboard and terminal board at $175.00 cost to the City be authorized and that a $10.00 per alarm service charge be establ ished. Water Pressuri- City Administrator Wood presented a Report on the Water zation Proj. Pressurization Project. Motion was made by Councilman Quartiroli seconded by Councilman Silva and carried that Staff be authorized to proceed with the first phase of the Water Pressurization Project as outlined and that the 1967-68 Budget be amended to allow for the Engineering Fees not to exceed $5,000.00. Library Grant City Administrator Wood reported on an Application for a Grant Under the Library Services and Construction Act. Chief Lib- rarian Goshert further explained the proposed Grant. Library Conf. Chief Librarian Goshert reported on her. recent attendance to the Library Conference in Sacramento. - Shell Oi 1 Co. Bulk Plant relocation .... Mr. William Chaffee, representative of Shell Oil Company, addressed the Council regarding the relocation of their distribu- tion plant to Ronan Avenue requesting use of a temporary Mobile trailer for the office building at said location. Discussion was had. Motion was made by Councilman Quartiroli seconded by Council- man Silva and carried that said request be allowed for use of a temporary mobile trailer as presented for a one year period up to a maximum of two years and that same be referred to Staff to determine if said mobile trailer could be brought up to code to use said trailer as a permanent structure during the next year. Cigarette Tax City Administrator Wood reported on the increase in Cigarette Tax and recommended that prior to October 1, 1967, the City rescind their present ordinance on collection of same and allow the State of California to collect said tax. Council instructed the City Attorney to proceed to prepare an ordinance to rescind the present Cigarette Tax Ordinance prior to October I, 1967. 0692 Ord.#801 re: Taxicab Park- ing Ordinance No. 801 was presented for adoption. Motion was made by Councilman Kennedy seconded by Councilman Silva that Ordin- ance No. 801 be adopted. ORDINANCE. The Santa Clara Valley Plans Newsletter, No. 47, May~June 1967 was noted. A letter from the California Society of Professional Engineers in re: to "Governmental Responsibility Committeell was noted. .... A letter frmm Dale B. Connell was presented in regard to South Church Street and same was ordered to be placed on file as Gavilan College is working on the matter with the City and County. Director of Public Works Henry reported that the Planning Commission had requested that a letter be forwarded to the Council recommending proceeding with the extension of Church Street. - A letter was presented from Gilroy Foods, Inc. thanking the City for the facility and services provided for their annual Picnic. At 11: 15 p.m. the City Attorney was excused from the Council Mee t i ng. Director of Public Works Henry reported on a proposed resolu- tion to be presented to the Council at a later date regarding the 1967-68 Gas Tax Maintenance Funds. Rep. Director of Public Works Henry requested to proceed with Plans and Specifications and call for bids for the 1967-68 Alley Repair Projects, and explained the proposedalleys to be repaired. Councilman Silva requested that the alley located between Church & Rosanna Streets by the Richfield Service Staion, if funds permit, scheduled for 1968-68 be reviewed for possible inclusion in the 1967-68 Projects. Council condurred that Staff proceed with the Plans ana Specifications and Call for bids for the 1967-68 Alley Repair Projects as presented to include the.alley between Church and Rosanna Streets if funds permitted. - """",,a Oirector of Public Works Henry presented a request of Mr. Jack Kazanjian for a Variance to construct a 6 foot fence at his property at the Northwest corner of Third and Rea Streets. Discus- . sion was had. Motion was made by Councilman Kennedy seconded by Councilman Quartiroli and carried that said Variance for the pro- posed 6 foot fence at J. Kazanjian's property be denied. Overtime parking violations Gentry's Meter Parking Lot Li m i ta t i on C.Silva leave of absence 269R City Administrator Wood presented the 1967-68 Assessed Valua- tions received from the current tax year. City Administrator Wood reported that the Gilroy Grange sub- mitted Mr. Merle Wolf's name as their representative in regard to the 701 Planning Study. He reported that all of the representatives of the local organizations have scheduled a meeting on August 16, 1967 at 8:00 p.m. in the Wheeler Auditorium. He suggested that additional citizens of the Community at large interested in City planning be appointed to said Committee. The following names were suggested: Dr. E.J. Chesbro, Goerge Procella, Fenton O'Connell, John Stelling, Otmar Silberstein and T.Obata. The Council agreed to recommend one additional citizen per member to include on the Citizens' Committee selected from the local organizations and the names suggested by City Administrator Wood. Councilman Kennedy inquired of the City's property line located in the creek along Christmas Hill Park property and re- ported that Mr. iohn Stelling has indicated that the City is res- stricting the chanel at that location. Said matter was referred to Staff. Councilman Kennedy requested a legal opinion on the matter from the City Attorney. Councilman Allemand inquired of the Police Department marking vebicles parked in the downtown area in violation of the parking time limit. Chief of Police Laizure noted that said vehicles were given warning notices only. He noted that the downtown area had been checked due to complaints received from local business owners indicating that the customers had no place to park. Councilman Silva inquired of the erroneous meter reading from Gentry's flow meter. City Administrator Wood reported that same was corrected based on production records and the previous years service. Chief of Police Laizure reported that the vehicles in viola- tion of the 2 hr. parking limit in the City Parking Lots have not been issued citiations. Council agreed that same should not be enforced until the lots were completely filled at all times. Councilman Silva requested permission to leave the State for the next two regular Council Meetings of August 14, 1967 and September 5, 1967. Motion was made by Councilman Kennedy seconded by Councilman Allemand and carried that Councilman Silva be excusoo from the meetings requested. Mayor Protempore Wentworth noted Planning Commission Repre- sentative, Donald Malinoff's attendance at the meeting. At 11:55 p.m. Mayor Protempore Wentworth declared the meeting adjourned.
