Absent: Council Member: Anthony C. Silva. The Minutes of the Regular Meeting of November 6, 1967 were approved as mailed and recorded. .......... Purchasing Agent Reinsch reported on the following bids for a Tractor with loader and backhoe attachments, opened Friday, Novem- ber 17, 1967 - 11:00 a.m. ~ Councilman Silva entered and took his seat at the Council table at 8:01 p.m. (Tractor Bids continued): 1. Carlyle .Trat;:tor - $8,282.00; 2.Farmers Mercantile Co.-Salinas - $8,895.95; 3. Tractor Equipment Sales-San Jose - $10,192.90. Purchasing Agent Reinsch recommended that the low bid of Carlyle Tractor be awarded for the tractor with loader, backhoe and dig cycle attachment in the amount of $367.50, totalling $8,649.50. Motion was made by Councilman Quartiroli sec9nded by Councilman Allemand and carried that .the low bid of Carlyle Tractor for the Tractor, loader, backhoe, and dig cycle attachment be awarded in the amount of$a,649.50 subject to the City Attorney's approval. The City Attorney noted said bid to be in order. The Mayor stated that it was the time and place scheduled for the opening of bids for a Dump truck.Purchasi ng Agent Reinsch opened the following bids received: l~ Bishop Motor Sales-Hollister $5,212.02; 2. Walthard Buick - G~C - $5,621.39. The awarding of a bid was deferred in order for Staff to determine if the low bid met the specifications. ....... -..II The Mayor stated that it was the time and place scheduled for the Continued Public Hearing on the proposal to annex 12.506 acres of Uninhabited Territory to be known as IICastlewood Park Annexation 67-1 to the City of Gilroyll belong to Cugini Propoerties, A General Partnership, said property located on the east side of Westwood Acres - Tract #3500, easterly terminus of Third Street. City Administrator Wood explained the location of the pro- posed annexat i on and dev i ated from the Agenda in order. to report on a proposed letter Agreement)n regard to the extension of Third Street, pertinent to the proposed aneexation. Discussion was had. The Council concurred with said. Letter Agreement subject to the 36 foot street dedication. ,~r. Michael J. Filice, Jr., -present in the audience, repre- senting Cugini Properties, noted th<\lt the additional 6.f~et request:-, ed by the City did not appear to present a problem. Council concurred wit~ the proposal to install the requested laterals. on the developers properties west of the proposed annexa- tion in order that said property owners could maintain their present irrigation operation at the time Third Street is extended. ........., City Administrator Wood noted that the City would recover the s,treet COStS wj1en the propertie!? developed but the cost for fencing and laterals would be at the City's expense. -- The Mayor asked if there was anyone in the audience wishing to speak for or against the proposed annexation. The City Attorney presented and explained Resolution No. 1162 referring to no majority protests. RESOLUTION NO. 1162 RESOLUTION DECLARING THAT NO MAJORITY PROTEST HAS BEEN MADE TO THE ANNEXATION OF TERRITORY DESIGNATED IN THE PROCEEDINGS AS IICASTLE- WOOD PARK ANNEXATION 67-1 TO THE CITY OF GILROylI. The City Attorney presented and explained Resolution No. 1163 annexing said territory to the City of Gilroy. Motion was made by Councilman Duffin seconded by Councilman Kennedy that the reading of Resolution No. 1163 be waived and that it be adopted. RESOLUTION NO. 1163 A RESOLUTION PROVIDING FOR THE ALTERATIONS OF THE BOUNDARIES OF THE CITY OF GILROY BY THE ANNEXATION THERETO OF CERTAIN UNINHABITED TERRITORY DESIGNATED AS IICASTLEWOOD PARK ANNEXATION 67-1 TO THE CITY OF GILROYII AND FOR THE INCORPORATION OF SUCH ANNEXED TERRITORY IN AND AS A PART OF SUCH MUNICIPALITY FOR THE GOVERNMENT AND MUNICIPAL CONTROL THEREOF. He asked if there was anyone in the audience wishing to speak for or against the proposal. There was' no comment from anyone in the audience. Motion was made by Councilman Duffin seconded by Council- man Kennedy and carried that the Public Hearing be closed. Discussion was had by the Council on the proposed ordinance. Councilman Quartiroli objected to the terminology in the ordinance under the subdivisions stating lIto be determined" requesting further clarification of specific parking requirements. Further discussion was had on the matter. Mr. E.H. Duerr, A. I.A., addressed the Counci I and stated that the proposed ordinance is more liberal than the existing ordi- nance but that the terminology lIto be determinedll would in effect present problems that now exist with the present ordinance. He noted that the Planning Commission, had indicated that they would establish a policy for the number of parking spaces required under the proposed ordinance's subdivisions where lito be determinedll existed in order for Staff to administer said ordinance, however no action had been taken on the matter. Further discussion was had on the matter by Planning Commis- sioner Childers. Motion was made by Councilman Kennedy seconded by Councilman Silva and carried that the Public Hearmng on the proposal to revise the IISII Zone Requirements and- related provisions of the Zoning Ord- inance be re-opened and continued to December 18, 1967 at 8:00 p.m. to further hear said matter in order to allow additional time for same to be referred to the Planning Commission requesting that maximum parking requtrements ~e included in said ordinance under the subdivisions stating lito be determinedll for further clarifica- tion. 2728 Gav i I an S tuden ts Bids re: Dump Truck The Mayor acknowledged the presence of Gavilan College Students in the audience. Purchasing Agent Reinsch reported the low bid of Bishop Motor Sales for the Dump Truck to be in order. Said bid was refer- red to the City Attorney for checking. The City Attorney reported that said bid was in accord with the specifications. Motion was made by Councilman Allemand seconded by Councilman Wentworth and carried that the low bid of Bishop Motor Sales in the amount of %5,212.02 for a Dump Truck be awarded. ...... Plan. Com. Meet. City Administrator Wood presented and explained the Report 11/16/67 of the Planning Commission Meeting of Thursday, November 16, 1967 ~ informing the Council of approval of the Tentative Map of Wilfred Gong for an eight (8) lot subdivision on South Church Street; noting approval of the 200 parking spaces proposed for the Elks Lodge Site; noting approval of County of Santa Clara to adopt zoning regulations that would relinquish zoning powers to the cities for those zoning requests in the County which are in close proximity to a city; in- forming Council that they directed Staff to submit tentative sub- division maps to the Council prior to Commission action. City Administrator Wood discussed the matter of Council giving final ap- proval on Tentative subdivision maps with recommendations from the Planning Commission. Prior to taking action on same, Council re- quested that this matter be discussed with the Planning Commission to determine their thinking on said matter. Personnel Com. Meet. 11/14/67 P & R Com. Meet. lOll 7/67 Oct. 167 Monthl, Reports Disbursements Salary Increases Personnel Director Reinsch presented the r~port of the Joint Personnel Commission Meeting of Thursday, November 14, 1967 regard- ing Employee residency requirements; Harvey Scettrini1s request to temporary waiver of present residency requirement; Salary Survey request of Gilroy Police Benefit Association; proposed policy re: Sick Leave & Vacation Credit; and progress on personnel recruit- ment for various City positions open at the present time. Commission Reinsch reported on the Parks & Recreation Commission Meeting of Tuesday, October 17, 1967 informing the Council that a Placque of Recognition would be in- stalled at the proposed park on South Monterey Street at the Southern Pacific Railroad Company property for the Rotary Club's $300.00 contribution, noting that the request of the Rotary Club to name sa i d park IIRotary Park'. was not approved and wou I d on I y be reconsidered if further contribution was received from said service club. Both agencies indicated that they would contact their Boards for further discussion 0' the matter. -- - Miller Ave.-Prince- City Administrator Wood reported on the, Status of Miller valle Storm Avenue Prineevalle Storm Drain Problem noting that Mr. John Stelling Drain Prob- has indicated that his tenant has agreed to construct an open ditch lem on the south side of the property to alleviate the storm drainage waters proposed to be a problem due to the tree removal and chang- ing grade on said property, said ditch to be in the area of the natural channel of said waters. City Administrator Wood noted that Mr. StelJ:ingby agreement is entitled to four (4) drain inlets to be installed to the Princevalle Storm Drain Chabnel by the Santa Clara County Flood Control District and that the City is working in cooperation with said District, specifically designing said inl~ts and will call for informal bids on same, to be sub- mitted to the Flood Control District for their approval and com- pletion of said project. Discussion was had. Representative of tBe Engineer Firm, Consour, Townsend & Assoc., addressed the Council and explained the proposed Agreement sub- mitted to the Council with their Agendas for review, noting minor revisions mad since same were forwarded to each Council Member. Gilroy Mooile A letter from Gilroy Mobile Monitors (REACT) was presented Monitors requesting permission to erect signs ~t north and south entrances (REACT) to the City of Gilroy. Patrolman, Ed Parr, addressed the Council, and explained the purpose of said organization. Council had no ob- j~ction to the erection of the requested signs noting the existence of said service organization in Gilroy. Community Awards City Administrator Wood presented a letter from. I.A. in regard to the 1967 Community Awards Program inviting the Council to the Awards Banquet scheduled in Palo Alto on December 7, 1967. Public Lands Res.#1164 & Res.#1165 City Administrator Wood reported on two-letters from the County in regard to Public Lands, specifically a request of the U.S. Department of Interior for establishment of regulations regarding Public Lands and proposed local use of Public Lands in Santa Clara County. I imi tations Councilman Duffin inquired of the wrecked car dealers at the Sewer Farm not complying with the Contract between the City of Gil- roy and said Junk Vehicle Dealers. City Administrator Wood reported that said operators have not completed the work to be performed as outlined in his letter notice of September 11, 1967 but that he is pursuing same.' The City Attorney presented end read a.proposed emergency ordinance to be known as Ordinance No. 812 regarding signing of Truck Routes. I .......J ORDINANCE NO. 812 AN ORDINANCE OF THE CITY OF GILROY REPEALING SEC. 15.35 OF THE GILROY CITY CODE REQUIRING PLACING OF APPROPRIATE SIGNS UPON PUBLIC STREETS UPON WHICH THE USE OF COMMERCIAL VEHICLES ARE PROHIBITED. Councilman Silva inquired of the Maintenance Program sche- duled for South Monterey Street~ City,Administrator Wood informed the Council that Staff indirectly understands that said work is to be scheduled for next year.. Counci I instructed Staff to contact the State Highways' local maintenance man to attempt to detennine the definite scheduling of same. .... .... Councilman Quartiroli noted complaints received from local merchants regarding double payment of the Cigarette Tax, specifica~ly to the City and to the. State for the same period of time. City Administrator Wood n~ted that he had also received complaints of same and that he would contact the State regardimg said matter because the City followed the States. instructfons in this matter. He also noted that several other cities in the County have exper- ienced the same problem, but indicate they are not going to reim- burse the merchants. The Mayor noted the presence of Commissioner Childers repre- senting the Planning Commission. Chief of Police Laizure reported on the matter of enforcing parking limitations at the Off-Street Parking Lots. ~ 701 Plan. The Quarterly Meeting of the League of California Cities- Peninsula D+vision on November 30, 1967 at Sabella's Restaurant on Fisherman's Wharf in San Francisco was noted. Councilman Wentworth noted that he would attend if the Mayor intended to to to this meeting. Inter=City Council The Mayor noted the Holiday Dinner Meeting of the Inter- City Council on December 7, 1967 at Moffett Field-Officer's Club, and he noted that he would request the City Clerk to make reserva- tions for those wishing to attend.
