Hear. re: San Martin Winery re- zoning Gilroy, California March 16, 1970 ...... The Regular Meeting of the Gilroy Ci ty Counci 1 was called to order by His Honor Norman B. Goodrich at 8:00 p.m. .... Present: Council Members: Fred P. Batrez, George T. Duffin, Mark E. Kennedy, John E. Pate, Anthony C. Silva, Everett C. Wentworth, and Norman B. Goodrich. The Mayor presented Miss Lori Anne Bada the "Junior Fire Marshal Initial Silver Medal Award for Juvenile Fire Heroismll, sponsored by the Hartfo~d Insurance Group. Mr. Ray Probert, repre- senting the local insurance company, addressed the Council and ex- plained same prior to this presentation. ...... ..... Receipt of a Petition from Post Development, Inc. requesting annexation of uninhabited territory located on the south side of Tenth Street between Alexander Street and the proposed South Valley Freeway, was noted, contai n i ng 1. 256 acres to be known as IITenth Street Annexation 7,0-1 to the City of Gilroyll. The City Attorney presented and explained Ordinance No. 884 annexing said territory to the City of Gilroy. Motion was made by Councilman Wentworth seconded by Councilman Kennedy that the reading of Ordinance No. .884 be waived and that it be adopted. ~. 01" ORDINANCE NO. 884 AN ORDINANCE PROVIDING FOR THE ALTERATIONS OF THE BOUNDARIES OF THE CITY OF GILROY BY THE ANNEXATION THERETO OF CERTAIN UNINHABITED TERRITORY DESIGNATED AS IITENTH STREET ANNEXATION 70-1 TO THE CITY OF GILROyl1 AND FOR THE INCORPORATION OF SUCH ANNEXED TERRITORY IN AND AS A PART OF SUCH MUNICIPALITY FOR THE GOVERNMENT AND MUNICIPAL CONTROL THEREOF. NOES: ABSENT: A letter appeal from Douglas Oil Company was noted in regard to the Planning Commission1s Decision to deny a Conditional Use Permit for a proposed Service Station at First and Church Streets. Motion was made by Councilman Pate seconded by Councilman Kennedy and carried that a Publ icHearing date of April 6,1970 be set to hear said appeal. Secretary of the P1c;lnning Commission Henry presented and ex- plained the report of the Planning Commission meeting of March 5, 1970 noting a recommendation proposal to rezone a parcel of undeveloped property containing 20 acres from C-1 and R-3 to R-1. A letter from San Martin Winery in regard to same was noted. Mr. Michael Filice, Jr. addressed the Council and further explained the proposed development of a Mobile Home Park at said location proposed for a future date. Secretary of the Planning Commission Henry noted that the Planning Commission is studying a proposed ordinance for Mobile Home Parks re- quiring a Conditional Use Permit for same which would be applied to all types of zoning. Motion was made by Counci 1man Pate seronded by Councilman Duffin and carried that a Public Hearing date of April 6, 1970 be set for rezoning of said undeveloped property. ~lt ....... The Planning Commission Report further noted a continued Public Hearing before the Commission on a petition of Warde D. Watson Real ty Co. fora Conditional Use Permit to allow a Service Sta tion located at the northwest corner of Leaves1ey Road and Murray Avenue, noting Com- mission1s proposal to revise service station standards in conjunction with County Service Station Standards; and noted declaration of a 60 I - ... o. - Fire Head- quarters preliminary plans 3087 day Moritorium on Mobile Home Park applications to allow Staff and Planning Commission Committee time to implement a Mobile Home Park Ordinance. Mr. Robert Wong, Architect, presented Preliminary Plans for the new Fire Headquarters Station. Discussion was had. Council re- ferred same to Staff to attempt to reduce the estimate proposal $35,696 in excess of the $200,00 Bond Issue. ;.,..... Parade ~ - 10th St. temporary openings (Pacific Central) City Administrator Wood requested Salary Merit Increases for the following employees to become effective April 1, 1970: Elaine Codiga, Clerk-Typist, Range 21-C $520 to 21-D $546; Betty J. La- Macchia, Clerk-Typist, Range 21-B $495 to 21-C $520; William Alex- ander, Fireman-Engineer, Range 27.5-D $749 to 27.5-E $786; E. John Arde and Gary L. Lester, Patrolmen, Range 28.5-D $786 to 28.5-# $825; Billie J. McCuiston, Patrolman, Range 28.5-B $713 to 28.5-C $749; and Barnabe Muniz, Utility Man, Range 23.5-B $560 to 23.5-C $587. Motion was made by Councilman Pate seconded by Councilman Silva and carried that the Salary Merit Increases for the seven (7) employees requested by approved to become effective April 1, 1970. An additional report on the Burglar Alarm Panel at the Pol ice Department was presented and discussed. Motion was made by Councilman Kennedy seconded by Councilman Wentworth and carried that Alternate Proposal for the 58 terminals be approved to include a subscriber.s cost of $30.00 fee. Motion was made by Councilman Pate seconded by Councilman Silva and carried that $725.00 be transferred within the 1969-70 Budget from Account 14A1 to 14B6 to allow for said Burglar Alarm Panel maintenance for this fiscal year. City Administrator Wood requested appointment of a Review Committee for the 1969-70 External Audit Contract. The Mayor appointed Councilmen Duffin and Pate to review same with the City Administrator. City Administrator Wood requested approval of Water Charge Rates as outlined by the Director of Pub1 ic Works, for Public Works. Projects. Motion was made by Councilman Pate seconded by Councilman Silva and carried that the Water Charge Rates for Pub1 ic Works' Projects as outlined by the Director of Public Works' be approved. The Minutes of the Transportation Policy Committee Meeting of February 11', 1970 were noted and further reviewe.d by Representative Batrez. The letter from San Martin Winery in regard to Hecker Pass Zoning Application was noted that same had been discussed earlier this date under Petitions. A letter from the I.F.D.E.S. Portuguese Society of Gilroy was presented requesting permission to conduct their Annual Parade on May 3, 1970. Motion was made by Councilman Wentworth seconded by Council- man Kennedy and carried that the request of the I.F.D.E.S. Portuguese Society of Gilroy to conduct a parade on May 3, 1970 be granted. A letter from Pacific Central Company requesting an opening for right-hand turn for vehicular access into Tenth Street was noted. Motion was made by Councilman Kennedy seconded by Councilman Wentworth and carried that a temporary encroachment for a right-hand turn open- ing to Tenth Street for Pacific Central Company be approved in accord with a Council Pol icy previously adopted, subject to plans for same being approved by the Director of Pub1 ic Works. 3088 County-wide Housing Element Nursery School Tour-Fire Dept. Councilman Duffin inquired of the disposition of traffic signal 1 ights presently being replaced by new signal 1 ights, suggesting that the City might be able to use them on City streets other than those of a State Highway. Director of Publ ic Works Henry noted that he would attempt to determine if these said signal 1 ights could be purchased by the City; however, noted that the major cost of signal installation is within the signal controller. .... -.... City Administrator Wood requested Council approval to a pro- posal of the County Housing Authority in regard to use of transite pipe available to them through the State,for use in the Harvest Housing Project on Luchessa Avenue. Discussion Was had on the matter. Council had no objection to said proposal of transite pipe for use in the Harvest Housing Project. City Administrator Wood requested appointment of a Council Member on the Landscape Architect Review Committee for the Creek area at Christmas Hill Park. The Mayor appointed Councilman Silva to said Landscape Architect Review Committee. It was noted that the Committee is scheduled to meet March 24, 1970 in the Council Chambers. City Administrator Wood noted that HUD had approved the $20,000 grant for certain relocation costs under the Northside Park Acquisition Project. .... Director of Public Works Henry informed Council of pumping operations at the City reservoirs. ..... Fire Chief Brittain invited Council and the Press to observe a house burning project on East Sixth Street adjacent to the Sixth Street Bridge on March 22, 1970 at 8:30 a.m. City Administrator Wood noted HUD approval of a $30,000 advance loan for the Regional Sewerage Treatment Plant Study. City Administrator Wood requested Council approval of waiver of the 1 icense requirements to Bonanza Day Committee refreshment stands during the next Bonanza Day Celebration. Council had no objec- tion to same. City Administrator Wood noted a proposed AB430 in regard to Disclosure of Assets modification. Council agreed that Staff urge local legislatures to support AB430.
