The Regular Meeting of the Gilroy City Coun~il was called to
order by His Honor Norman B. Goodrich at 8:00 p.m.
Present: Council Members: Fred P. Batrez, George T. Duffin, John
'E. Pat~, Anthony C. Silva, Everett C. Wentworth, and Norman B. Goodrich.
Absent: Council Member: Mark E~ Kennedy.
The Mayor tabled the presentation of a Certificate of Service
to retiring Parks and Recreation Commissioner, Susie Brunetti to await her
presence.

The Minutes of the Regular Council Meeting of May 4, 1970 were ap-
proved as mailed and recorded with the request of Staff to check the record-
ing of that, portion of said minutes referring to the Second Division of the
General Obligation Bonds of 1969 for the Library Facility; specif~ca11y,
City Administrator Wood.s recommendation to resubmit the Bond issue on the
November 1970 Ballot for a maximum interest rate increase unless the Bond
Market decreased between now and November; that if this occurred to autho-
rize the Bond Attorneys. to have a Short Call Notice for obtaining bids.
Counci 1 did not concur with the recommendation in regard to resubmitting
said Bond Issue on the November 1970 Ballot; it was felt that same was not
the intent of Council approving the recommendation of the City Administra-
tor.

Utility User The Mayor,deviated from, the regular Agenda in order to accomodate
Tax Ord. interested persons in the audience in regard to the pr~osed Utility User
Tax ordinance.
City Administrator Wood presented and explained the proposed Uti lity
User Tax Ordinance previously introduced and published by title and summary.
Mayor Protempore Duffin explained the Councils. reasoning in intro-
ducing said proposed ordinance at the May 4, 1970 Council Meeting.

The Mayor called upon Mr. Roy Westphal inger, Secretary-Manager of
the Gilroy Chamber of Commerce for comment on the proposed Utility Tax
Ordinance. Mr. Westphalinger introduced Mr. James Langdon who addressed
the Council and presented a resolution of the Chamber of Commerce opposing
said Utility User Tax Ordinance; said resolution accompanied by signatures
of 90% of the Chamber Members opposing said ordinance.
Further heard from the following persons opposing.said ordinance:
Mr. George E. Clausen, President of Gilroy Foods; Mr. Phil Dahl, Gentry
Inc.; Mr. Larry Brown, Continental Telephone Company; Mr. James Cl ifford,
Clifford Equipment Co.; Mr. Robert W. English; and Mr. Harold Kelsey.
Mr. Gallagher, District Mamager of P.G. & E., also addressed the
Council and requested deferring adoption of said proposed ordinance to
allow additional time,to review same to determine if the method of collec-
tion as outlined in the ordinance would be feasible by his company, who
wouFd be collecting said proposed tax.
Motion was made by Counci Iman Silva seconded by Counci lman Went-
worth and carried that action on the adoption of said Utility Users Tax
Ordinance be deferred to the June 15, 1970 regular Council Meeting at
8:00 p.m.
Secretary of the Planning Commission Henry presented.and,exp1ained
the Report of.the Planning Commission Meeting of May 7, 1970 noting that
the Commission recommended rezoning from I-Z to,C~1 (Neighborhood Commer-
cial) .District, the Tenth Street Annexation 70-1 belonging to Alfred E.
Berns. Motion was made by Councilman Pate seconded by Councilman Silva
and carried that a Pub1 ic Hearing be set for June 1, 1970 on the proposed
rezoning of the Tenth Street-Annexation property; it was further r.ecom-
mended by the Commission that a Mobile Home Park Ordinance be adopted.
Motion was rrade by Councilman Wentworth seconded by Councilman Pate and
carried that a Public Hearing of June 1, 1970 be set for discussion on the
proposed Mobile Home Parks Ordinance. It was further noted by the Secre-
tary of the Planning Commission that the Planning Commission Pub1 ic Hearing
for Planned Unit Development was set for June 4, 1970 in regard to the
property located at the southeast corner of Leaves1ey Road and Forest Street.
City Administrator Wood recommended a Salary Merit Increase for
Robert Elia, Utility Man, Range 23.5 at Step IID" $617.00 to Step "E" $417.
to become effective June 1, 1970.
Motion was made by Councilman Pate seconded by Councilman Silva and
carried that Robert Elia, Utility Man be granted a salary merit increase
from Step liD I I "';$617'-, to'Step IIEII $647. (Range 23.5) to become effective
June 1, 1970, as recommended.

Annual Jail City Administrator Wood requested deferring the report on the
Agreement Annupl Jail Agreement with Santa Clara County as it had not been re-

City Administrator Wood presented a Resolution approving an
amendment to the Agreement for Northside Park, H.U.D., OSA-274.
Motion was made by Councilman Wentworth seconded by Councilman Duffin
that the reading of Resolution No. 1465 be waived and that it be
adopted.

City Administrator Wood requested to defer the Report on an
Agreement for Engineer,i.ng Consulting Services for the Proposed Regional
Sewerage Treatment Plant Study in order to allow Staff to clarify cer-
tain clauses therein.

City Administrator Wood reported on the Recruitment for DepDty
Police Chief recommending appointment of Mr. Albert L. Williams to
said position at Step "D" of Range 33, $979.00 per month. Motion was
made by Councilman Wentworth seconded by Councilman Silva and carried
that Mr. Albert L. Williams be appointed Deputy Police Chief as recom-
mended.

Code Service City AdmLnistrator Wood reported oc the City Code Printing
Service agreement and requested authorization to renew said Contract
for one year. Motion was made by Councilman Duffin seconded by
Councilman Wentworth and carried that said Contract for the City Code
Printing Service be renewed as recommended.

Jt.Playground City Administrator Wood reported on the Joint Playground Program
Program approved by the Gi Iroy School District. Motion was made by Councilman
Duffin seconded by Councilman Pate and carried that the proposed Joint
Playground Program as presented be approved as to concept and that Staff
prepare a formal agreement for same.
70-75 Cap.lm~. City Administrator Wood reported on the Capital Improvement
Program Program, 1970-75 submitted with the Council Agenda. Council set May 25,
1970 at 7:00 p.m. as a 1970-71 Budget Study Session to include review of
the Capital fmprovement Program 70-75 at said Work Meeting.

Specifications for the City.s Comprehensive Insurance Coverage
were presented to Council for approval and review. Motion was made by
Councilman Wentworth seconded by Councilman Duffin and carried that the
specifications for the City's Comprehensive Insurance Coverage be ap-
proved and that authorization be given for the Call for Bids for same.

Hoey & Reser- City Administrator Wood reported on proposed annexations (Hoey
voir A Annexation 70-2) and (Reservoir A Annexation 70-3) approved by LAFCO and
Annex. requested authorization tofile a petition for annexation with the Board
of Supervisors. Motion was made by Councilman Duffin seconded by Council-
man Wentworth and carried that Staff be,authorized to file a petition for
annexation of territories known ,as "Hoey Annexation 70-2" and "Reservoir

A letter from Mr. I. M. Zubow, et a1 was presented requesting City
Sewer and Water Services for property northeast of Gi 1r9Y, located outside
of the City Limits. Discussion was had on the matter. Council tabled action
on the matter and requested t'1r., Bel1ezza, property owner, to contact adja-
cent neighbors to determine if they would annex to the City of Gilroy in
order to obtain said services.

Sol id Wastes Counci Iman Wentworth reported on a recent tour he attended of
Study Com. Garbage Dumps in the riorth County conducted by the S61idWas~es Study
Committee, of which heis presently a membe~.
The City Attorney noted that he would be absent from Council
Meetings during the,month,of July 1970.
External Audit City Administrator Wood noted that a Council Advisory Committee
Meeting in regard to external Audits of the City has been scheduled for
May 22, 1970 at 2:00 p.m.

re: City Administrator Wood requested Council policy in regard to
allowing tables at Christmas Hill Park and chairs at Wheeler Auditorium
being used by private parties to be'moved' from these premises for use
elsewhere. Council established a policy that said City furniture re-
main at the-i r given locations and private part-ies not be allowed to
rent nor use them at other locations.
County Library Councilman Pate recommended Council to endorse the reappointment
Commis- of Mr. Julius Lustig as Santa Clara County Library Commissioner. Motion
sioner was made by Councilman Pate seconded by Cduncilman Wentworth and carried
that the City recommend the reappointment of Mr. Julius Lustig as Santa
Clara County Library Commissioner.
Annex.Policy Councilman Pate requested that the Planning Commission be reminded
that Council previously requested their recommendation on proposed annexa-
tions to the north of the City Limits.
Service Pins Councilman Silva requested Staff to report on Service Pins for
Volunteer Firemen and Auxiliary Policemen to be presented at the Annual,
City Barbecue.
Local Burglary Councilman Batrez noted recent thefts throughout the City request-
& thefts ing that the City recogniz~ same and attempt to ellminate said problem
suggesting that the City investigate using traine'd pol'icedogs in this
regard.
Methadon Treat- Mr. James Zizzo, local pharmacist, addressed the Council request-
ment Cen- ing support to Supervisor Sig Sanchez in his attempt to locate a Methadon
ter Treatment~Center'in tlie Gilroy area. Council agreed to support said pro~
posa1 and requested Staff to write Supervisor Sanchez <in this regard. '
The Mayor thanked Mayor Protrempore Duff i n for conduct i ng the
Mayor's duties while he was on a recent trip in the Orient.
At 9:45p.m. the Mayor adjourned the meeting.
