Monterey #2 71-4 Gilroy, California August 16, 1971 The Regular Meeting of the Gilroy City Council was called to order by His Honor Mayor Norman B. Goodrich at 8:00 p.m. Present: Council Members: Fred P. Batrez, George T. Duffin, John Hughan, John E. Pate, Anthony C. Silva, and Norman B. Goodrich. Absent: Council Member: David V. Stout Councilman Pate, former Library and Culture Commissioner, presented Mrs. Vance Baldwin, retired Library & Culture Commissioner, with a Certificate of Service. The Minutes of the Regular Council Meeting of August 2, 1971, and the Special Council Meeting of August 5, 1971, were approved as mailed and recorded. The Appeal from Ruth & Going Inc. on behalf of Dan Teresi regarding Planning Commission's Decision Denying a Use Permit to Con- struct a Mobile Home Park at the southeast corner of Leavesley Road and Forest Street continued from the August 2, 1971, Council Meeting was presen ted. Secretary of the Planning Commission Henry reported on action taken by the Commission in regard to said Use Permit application. Mr. Leo Ruth, Engineer, addressed the Council and further ex- plained the proposed Mobile Home Pa k. Council discussion was had in regard to same. Motion was made by Councilman Hughan seconded by Councilman Silva and carried that the request of Dan Teresi for a Use Permit for a Mobile Home Park be referred back to the Planning Commission for further study and that the Appeal before the Council be continued to the September 7, 1971, regular Council Meeting for action on same. A petition from Pasquale LaMacchia requesting annexation of uninhabited territory containing 90.39 acres, located on the east side of Monterey Highway, west of the Southern Pacific Railroad to be known as IISouth Monterey No.2 Annexation 71-4 to the City of Gilroy" was presented. City Administrator Wood explained the location of said territory on the map and noted that there was 100% consent of the property owners in said territory. Ordinance No. 931 annexing said territory was presented. Mr. Frank Cal iri, owner, addressed the Council to present his proposal. Council tabled action on same pending additional information in regard to President Nixon's recent Ifreeze" on increase rates, etc. E's Ranch Mil k- 1 s t St. A petition from residents in the vicinity of E's Ranch Milk on First Street was presented, protesting the operations of said local business. Mr. Mario Balanesi, property owner in the area, addressed the Council and explained the problem of the noise in the neighborhood. Mr. Earl Moore, owner of Ranch Milk, addressed the Council and expJained the necessity for operating the refrigeration trucks at his place of business and further expfained his attempt to a11eviat~ the noise. r Discussion was had in regard to same. The Mayor requested owner, Mr. Earl Moore, to move both of his refrigeration trucks toward the front of the business on the First Street side in order to attempt to alleviate the noise caused by said trucks. Mr. Moore agreed to cooperate and meet with the adjacent residents. ~ Assessed Valuation The Report of the City Administrator on Assessed Valuations 71-72 Tax Yr. for 1971-1972 Tax Year and Recommended Tax Rates was presented and Ord. 932 & explained. 933 Ordinance No. 932 Fixing the Amount of Revenue from Property Taxes Necessary to Support the City Departments was presented. Motion was made by Councilman Batrez seconded by Councilman Pate that the reading of Ordinance No. 932 be waived and that it be adopted. . ORD INANCE NO. 932 ORDINANCE OF THE CITY OF GILROY FIXING AMOUNT OF REVENUE FROM PROPERTY TAXES NECESSARY TO SUPPORT THE DEPARTMENTS OF THE CITY AND TO PAY BONDED OR OTHER INDEBTEDNESS OF THE CITY OF GILROY OR ANY PORTION OR IDtSTRICT OF THE CITY OF GILROY FOR THE FI~CAL YEAR 1971-72. ORDINANCE NO. 935 ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY PREZONING 73 ACRES AS M3, SAID PROPERTY BEING A PART OF A PRO- POSED ANNEXATION TO THE CITY OF GILROY. A request from the Muscular Dystrophy Associations of America was presented for waiver of the Solicitation Permit for the month of November 1971. Motion was made by Councilman Pate seconded by Councilman Duffin and carried that the Solicitation Permit be waived for the Muscular Dystrophy Association of America to solicit in the City during the month of November, 1971. A request from the Association of Monterey Bay Area Govern- ments was presented for a member to represent the Gilroy and Morgan Hill area on the Water Management Policy Committee of said association. The Mayor recommended the nomination of Councilman Silva as a local representative and instructed City Administrator Wood to contact the City of Morgan Hill to determine if this recommendation is acceptable to them. Valley Refuse A letter from the South Valley Refuse Disposal, Inc. was prB265 Temp. Trailer sented requesting a Temporary Use of an On-site trailer for ti1enight watchman's quarters. Motion was made by Councilman Batrez seconded by Councilman Duffin and carried that the South Valley Refuse Disposal Inc. be granted permission to use an On-site trailer for their night watchman's living quarters as a temporary use to be reviewed annually. Cerebral Palsy sol icitation A letter from the United Cerebral Palsy Association for waiver of the solicitation permit was presented. Motion was made by Councilman Hughan seconded by Councilman Silva and carried that the fee for soliciting be waived as requested by the United Cerebral Palsy Association. S.C.Co. Res. #1590 re: ret i remen t The Minutes of the Santa Clara County Transportation Policy Committee Meeting of July 14, 1971, were noted. Discussion was had in regard to the proposed Bicycle Route along Santa Teresa Boulevard. City Administrator Wood informed Council of a meeting on Route 152 Studies to be conducted by the State Division of Highways at the Gilroy City Hall on August 25, 1971 at 7:30 p.m. The Minutes of the South Zone Flood Control Advisory Com- mittee Meeting of June 24, 1971, were noted. Councilman Hughan , representative on Task Force, requested the Mayor to consider appointment of an alternate representative possibly from the Parks and Recreation Commisslon in the event of a meet i ng confl i ct. The Annual Report of the Gilroy Police Department submitted with the Agendas was noted and discussed. Councilman Pate recommended opposing the proposal of Congress to separate the Congressional District of which Gilroy is a part of by using Monterey Street as the dividing line. Council requested Staff to notify the State Legislature Committee and local Assemblyman and Senator that Gilroy is opposed to said re-districting. Councilman Pate inquired of the proposed Federal funding available for extra employees and inquired if the City of Gilroy could qualify for same. City Administrator Wood noted that said funding is under the IIManpower Act", basically for cities of populations of 80,000+; that he would attempt to obtain said program for the City in coopera- tion with Santa Clara County. Councilman Batrez inquired of progress in regard to enforce- ment of the City's Sign Ordinance. Director of Public Works-City Engineer Henry reported on same and recommended that the City Attorney be advised of businesses in violation of same, for enforcement. Personnel Director Reinsch recommmended adoption of a resolu- tion of intention to amend the retirement program for Public Safety employees from 55 years to 50 years of age. He presented said Resolu- tion. Motion was made by Councilman Pate seconded by Councilman Batrez that the reading of Resolution No~ 1590 be waived and that it be adopted. Council re- ferred same to the City Attorney for recommendation at the next regular Council Meeting of September 7, 1971. Mr. Fred Angelino, member of the Water District, addressed the Counc i 1 and i nqu i red ,of porti ons of the I mpact Report regard i ng water use on the LaMacchia property proposed for location of the Allan Meat Packing Plant. ABAG Meet. The Meeting of the Association of Bay Area Governments on August 19, 1971, at the Claremont Hotel in Berkeley at 7:30 p.m. was noted. Proposed Annex. City Administrator Wood presented a request for annexation of property on the east side of the railroad property, 600 feet from 101 highway to the east and noted that proponents had been informed that it would be too costly to service said property and that Tressler Realty had presented a proposed map for said annexation for Council endorsement. Council indicated that they were not in favor of the proposed annexation.
