Minutes 1971/11/01 3283 November 1, 1971 Gilroy, California The Regular Meeting of the Gilroy City Council was called to order by His Honor Mayor Norman B. Goodrich at 8:00 p.m. Roll Call Present: Council Members: George T. Duffin, John Hughan, John E. Pate, Anthony C. Silva, and Norman B. Goodrich. Absent: Council Members; Fred P. Batrez, David V. Stout. Intro. New Emp. The Mayor introduced Stephen Covington, new employee, and Joseph Young, transferring from the Publ ic Works Department, who have been appointed to fill the positions of Firemen. Report 10/5/71 The Mayor stated it was the time and place for the public hear- ing on the application of G. L. Standish to rezone property located approximately 825 feet west of Wren Avenue south of, and adjacent to, the extension of Welburn Avenue, from R-l (Single Family) to R-3 (Low Density Multiple). ..... Director of Publ ic Works Henry explained the location and re- vised map of the proposed subdivision, noting the Planning Commission had approved the plan and recommended Council's approval of the rezon- ing. Discussion was had in reference to a provision for a future through street at the end of "Irish Courtll as shown on the subdivision map. - The Mayor asked if anyone in the audience wi~hed to speak for or against the proposal. Mr. Bob Standish, .representing G. L. Standish Companies, addressed the Council noting it was his company's intention to dedicate "Irish Court" for a possible through street, if required in the future. Motion was made by Counci'lman Duffin seconded by Councilman Silva and carried that the public hearing be closed. Dis- cussion was had. The City Attorney presented a proposed ordinance rezoning said property, subject to a stipulation regarding a possible future through street. Motion was made by Councilman Duffin seconded by Councilman Silva and carried that the reading of the proposed ordi- nance be waived and that it be published by title and summary. ~ .... Councilman Batrez entered and took his seat at the Council table at 8:08 p.m. The Planning Commission Report of the October 21, 1971, meeting was presented and explained by Secretary Henry. It was further noted that the Planning Commission passed Resolution 562 recommending that Sections 43.1 and 43.2 of the Zoning Ordinance for Requirements of Conditional Use Permits in "M-311 (Heavy Industrial) Zone be amended. Motion was made by Councilman Pate seconded by Councilman Silva and carried that a public hearing date of November 15, 1971, be set for sa i d matter. The Report of the Personnel Commission Meeting of October 28, 1971, was presented and explained by Personnel Director Reinsch noting the abolishment of eight (8) eligibility lists and requested adoption of a resolution amending Section I I I, h, of the Personnel Rules and Regulations regarding transferring from one department or division to another. The City Attorney noted a change in the wording in said resolution. Motion was made by Councilman Pate seconded by Councilman Silva and carried that Resolution No. 1602, Amending Section I I I, h, of Personnel Rules and Regulations be adopted and the reading be waived. .... .... It was further noted that the City is ordering the Preliminary Title Reports for the acquisition of the new library site. .... .... Monthly Reports The Summary of Monthly Reports for September 1971 was noted and Sept. 171 discussed. Disbursements Sept. 171 The Report of Disbursements from September I, 1971, through September 30, 1971, was noted and discussed. .... .... 3285 Emerg. Communi- Fire Chief Brittain addressed the Council in reference to the cations Emergency Communications Study and explained the operations of the Study/Fire present system; recommending the merger of emergency communications Dept. within the City and the Gilroy Rural Fire District when the new fire headquarters station becomes operational. Discussion was had and the matter referred to the Fire District Study Committee (Pate, Silva, and ...,..... Batrez) for report back to Counc i I. Notice of Completion- Fire Hdqtrs. Security req. for license City Administrator Wood stated that the contractor has completed the major portion of work on the new fire headquarters station, noting there Were still some minor items to be finished, and recommended a Notice of Completion be filed for said facility. Motion was made by Councilman Duffin seconded by Councilman Hughan and carried that the Mayor be authorized to execute the Notice of Completion for the new fire headquarters station. Patrol City Administrator Wood presented a request for a private patrol service license from Thomas's Merchant Patrol, and noted recommendation for approval by the Chief of Police. Mr. Lowell Thomas, owner, addressed the Council and briefly ex- plained the services of his company. City Administrator Wood noted a report from the City Engineer regarding the possible loss of TOPICS funds. City Engineer Henry ad- dressed the Council and explained the difficulty Gilroy, and other smaller cities, are having in obtaining these funds and recommended an agreement be executed between the City of Gilroy and the City of Campbell to exchange our TOPICS funds for a portion of their ~as tax funds. Motion was made by Councilman Duffin seconded by Councilman Silva and carried approving the City Engineer's recommendation for the execution of said agreement. The City Attorney explained a proposed ordinance repealing and amending out-moded and pre-empted provisions of Chapters 15 and 16 of the Gilroy City Code. Discussion was had. Motion was made by Council- man Pate seconded by Councilman Hughan and carried that the proposed ordinance be introduced and published by title and summary and the reading be waived. The City Attorney further recommended that stop signs at desig- nated intersections be established by resolution rather than by ordinance. re: The City Attorney explained a proposed ordinance modifying the Gilroy City Code to incorporate the County1s requirements pertaining to raw milk sales to be introduced and published by title and summary. Motion was made by Councilman Duffin seconded by Councilman Pate and carried that said ordinance be introduced and publ ished by title and summary and the reading be waived. The City Administrator presented a request of Hillside Children1s Home of Felton, for waiver of a solicitation permit recommending denial of said request on the basis that the City is obligated to support its own local organizations. Motion was made by Councilman Duffin seconded by Councilman Hughan and carried that the request of the Hillside Chil- renfs Home be denied and that they be advised of the City's policy re: outside solicitations. The City Administrator presented a request of the Epilepsy Society of Santa Clara' County requesting waiver of a solicitation per- mit for a fund-raising campaign during November. Motion was made by Counci lman Pate seconded by Councilman Silva and carried that said request be granted. 3286 Annex. req. (Karnan & Assoc.) for KOA Campground Req. for Tan p. Mobile Home Permit PPC Minutes 9/23/71 Ins. Com. Mee tin g 10/29/71 The City Administrator presented a request of Karnan and Associ- ates of Los Altos, for annexation of property located on North Monterey Highway to be used for a KOA Campground. Mr. Dick Karnan addressed the Council and explained the proposal ... in reference to the General Plan, stating that this will primarily be an overnight campground for travelers. Discussion was had. Motion ... was made by Councilman Hughan seconded by Councilman Silva and carried denying the request for annexation of Karnan and Associates on the basis that the City does not look with favor on annexation of this area for the proposed use at this time. City Administrator Wood presented a request of the Gilroy Drive- In Theatre for a permit for a watchman's mobile home on the theatre property in an effort to decrease break-ins and vandalism. Discussion was had. The Mayor recommended that this matter be carried over to the next Council meeting to give Mr. Jack Peters an opportunity to speak. .. .... The Minutes of the Planning Policy Committee Meeting of September 23, 1971, were noted. Councilman Pate reported on the Urban Development Sub-Committee meeting of October 13, 1971, noting recommendation of a moratorium for one year to prevent land division of property less than 100 acres and no developmentof property under five acres. Councilman Pate also noted the PPC approved a reorganization of the Housing Com- mittee to include one PPC representative (or alternate) from each jurisdiction, and one person designated by the PPC representatives from each ~~risdiction. Motion was made by Councilman Pate seconded by Councilman Silva designating Planning Commissioner Chiesa and Coun- cilman Hughan as representatives to the Housing Advisory Committee. Councilman Duffin reported on the Insurance Advisory Committee Meeting of October 29, 1971, recommending the City continue with the existing coverage and to review new proposals in six months. Discussion was had in reference to a possible wrecking yard ... operation at 8787 Monterey Street rather than an auto repair business. The City Attorney was instructed to investigate said matter. ... City Administrator Wood reminded Council of the I.C.C. meeting to be held in Gilroy on November II, 1971, at the Gilroy Elks Lodge. Councilman Pate noted that Christmas Hill Park was locked the past Sunday around 12:30 - 1:00 p.m. Councilman Pate also noted a continued problem regarding a South Monterey Street fruitstand. Director of Public Works Henry stated he would investigate same. Councilman Pate inquired as to the status of the sign ordinance. Councilman Silva stated he had received comments that the Gar- bage company was not covering the refuse at the dump. The City Adminis- trator stated he would investigate the situation. Councilman Batrez inquired as to when the rough grading would begin at Northside Park. It was noted that the City is waiting com- pletion of the contract documents by the contractor. .. ..... The Mayor noted the presence of Planning Commissioner Chiesa who commented briefly on the Planning Policy Committee meeting in reference to the moratorium on land division previously discussed.
