Minutes 1972/08/14 Roll Ca 11 Con t I d Pub. hear. re: Ronan Ave.- S.Chestnut Proj.71-1 3381 Gilroy, California August 14, 1972 The Adjourned Regular Meeting of the Gilroy City Council was called to order by His Honor Mayor Norman B. Goodrich at 7:07 p.m.. Present: Council Members: Fred P. Batrez, George T. Duffin, John Hughan, John E. Pate, Anthony C. Silva, David V. Stout and Norman B. Goodrich. The Mayor announced that this was the time and place scheduled for the continued public hearing for 'IRonan Avenue - South Chestnut Street Project No. 1971-1" Assessment District. City Administrator Wood reported that he was in receipt of the fully executed agreements and deeds for dedication of all property owners on Chestnut Street south of Tenth Street and recommended approval of same. Mot i on was made by Counc i lman Duff i n seconded by Counc i lman Hughan and carried that the agreements be approved as presented, the Mayor be authorized to execute same on behalf of the City, and that recordation of the deeds for same be authorized. City Administrator Wood thanked the Mayor for obtaining the required signatures on the agreement of Fletcher and Anderson. Mr. Philip D. Assaf, attorney, noted that all of the acquisi- tions had been made on Chestnut Street south of Tenth Street. City Engineer Henry recommended that the contract for said improvement project be awarded subject to obtaining a written agree- ment from the contractor in regard to his permission to delay construc- tion on that portion of the assessment district where right of way has not been negotiated with Buzzini and Mondelli, property owners. City Administrator Wood reported that these property owners were not in agreement with the appraisal of their properties, and that he would further attempt to negotiate with them. Res. #1668-1674 Resolution No. 1668, A Resolution Overruling Protests on Resolution No. 1647 of Prel iminary Determination and of Intention, was read. On motion of Councilman Hughan seconded by Councilman Silva and unanimously carried, said resolution was adopted. RESOLUTION NO. 1670 A RESOLUTION FINDING AND DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE PROPOSED ACQUISITIONS AND IMPROVEMENTS - RONAN AVENUE - SOUTH CHESTNUT STREET - PROJECT NO. 1971-1. On motion of Councilman Hughan, seconded by Councilman Silva and unanimously carried, said Resolution was adopted, subject to receipt in writing from Eilert & Smith, Inc., San Jose, in regard to delay of the construction on that property yet to be negotiated with for right of way purposes.
