Ord. 3533 January 21, 1974 Gilroy, California The Regular Meeting of the Gl1roy City Council was called to order by His Honor Mayor Norman B. Goodrich at 8:02 p.m. Present: Council Members: Dennis L. DeBell, George T. Duffin, John Hughan, John E. Pate, Anthony C. Silva, David V. Stout amd Norman B. Goodrich. City Administrator Wood requested removal of Item B from the Consent Calendar. Motion was made by Councilman Hughan seconded by Councilman Duffin that Item B be reomoved from the Consent Calendar and that the following items be approved: Passed and adopted by the following Roll Call Vote: Ayes: Council Members: DeBell, Duffin, Hughan, Pate, Silva, Stout and Goodrich. Consent Calendar: Minutes of January 7, 1974, Regular Council Mee t i ng ; Approved request of the American Cancer Society for waiver of a City Solicitation permit for a fund drive from April 19 through April 30, 1974. City Administrator Wood noted that he had recommended approval of salary merit step increases for the following ten (10) City Employees: Karen Rinde and Rose Hurley, Jr. Clerk Typists, Range 22.5 from Step A, $537 to Step B, $565;Eleanor Villarreal, Jr. Clerk Typist, Range 23, from Step A, $552 to Step B, $579; Donald Kludt, Patrolman Trainee, Range 24.5, from Step B, $622 to Step C, $564; Albert G. Wilson, Util ity Man I I, Range 27.5, from Step D, $794, to Step E, $812; James Young, Park Arborist, Range 29, from Step A, $738 to Step B, $774; Steve Brem, Patrolman, Range 32, from Step A, $853 to Step B, $897; Gordon Kilpatrick, Patrolman, Range 32, from Step C, $941 to Step D, $988; Richard Piedmont, Water Fore- man, Range 32.5 Step C, $965 to Step D, $1012; and Dennis Trettin, Patrol- man, Range 32.5, from Step D, $1012 to Step E, $1063. Motion was made by Councilman Pate seconded by Councilman Silva and carried that the ten (10) Salary Merit Step Increases as recommended by the City Administrator be approved. re: The Mayor stated that it was the time and place scheduled for the pub 1 ic hearing on the proposed amendment to Section 68.10 of the Zoning Ordinance. Planning Assistant Lefaver explained the proposed amendment to said Section 68.10 as recommended by the Planning Commission. The City Attorney further explained same. The Mayor asked if there was anyone in the audience wishing to speak for or against the proposal. There was no comment from anyone in the audience. Motion was made by Councilman Pate seconded gy Councilman Hughan that the Publ ic Hearing be closed. 3534 Motion was made by Councilman Pate seconded by Councilman Hughan and carried that the reading of proposed 'ordinance amending Section 68.10)b) (2) and 68.10(d) be waived, that it be introduced and publ ished by title and summary. Pacific Gas A letter from Pacific Gas & Electric Company in regard to & Electric Co.Undergrounding Util ity Services Allocation was noted and discussed. Plan. & Land Dev. E. Dexter, Building Site, #72B23.3318. ..... ,! ...,.j Supervisor Sig Sanchez addressed the Council in regard to County Planning and Land Development Matter Referrals. The Mayor inquired of the County's thinking in regard to the effect of development requir- ing use of septic tanks on polluting the water system throughout the County and the County1s thinking in regard to the street patterns in development in rural areas. The Mayor inquired if Council had any objection to considering all informational correspondence under one motion unless a Council Member had any specific questions in regard to any particular item. Council agreed. The Report of the Planning Commission Meeting of Janury 17, 1974, was noted. City Administrator Wood presented a letter from Francis Crawford, attorney on behalf of A-I Auto Wrecking, appeal ing the decision of the Planning Commission denying a Conditional Use Permit request for an auto wrecking yeard. Motion was made by Councilman Stout seconded by Councilman Silva and carried that a hearing be set for February 4, 1974, on appeal of A-l Auto Wrecking at its present location be approved until such time when the appeal is heard. -. The Minutes of the Library & Culture Commission Meeting of December 3, 1973, were noted. ....... The Minutes of the Parks and Recreation Commission Meeting of January 15, 1974, were noted. City Administrator Wood requested Council to defer action on the proposed Park Ordinance to the next regular Council Meeting in order for Staff to further check requirements of said ordinance. Meeting 3535 The Letter Agreement from Garfinkel and Kimura for additonal work at Christmas Hill Park for architectural and landscape consultation for same was noted and discussed. Parks and Recreation Director Ayer further explained said proposed project. Motion was made by Councilman Pate seconded by Councilman Duffin that the proposed project be approved and that the Mayor be authorized to execute said agreement on behalf of the City. A report on expanding a Beautification Lease at Southern Pacific Depot Property was presented. Motion was made by Councilman Duffin seconded by Councilman Silva and carried that the Beautification Lease at the Depot Property be approved as presented. A report on Land Conservation Contracts under the Will iamson Act was noted. Motion was made by Councilman Hughan seconded by Council- man Duffin and carried that Council had no objection to said contracts and that the County be advised of Council's action regarding same. A report on the Joint Gilroy-Morgan Hill Councils' Study Session of January 15, 1974, was noted and discussion was had on the following topics of discussion at said meeting: (1) Loma Prieta Soil Conservation District - Removing annexed territories from said District. Council requested the City Attorney to determine if it would be possible to include the original city 1 imits under the District and the legal requirements to accompl ish this; (2) South County Treatment Plant Study - City Administrator recommended that no action be taken at this time in order to receive cost estimates from the Consultant proposed to be avail- able at the next regular Council meeting. Oil "Crisis" A report in regard to the Oil "Crisis" was noted. Motion was made by Councilman Hughan seconded by Councilman DeBell and carried that the City Administrator contact State and Federal representatives to express ir~ the City's concern in this regard. ... A report on a request to join into an Inter-Jurisdictional Youth Services Bureau was noted. Said request was further explained by Chief of Pol ice Laizure and Mr. R. R. Seymour, representing the Juvenile Probation Department of the County in developing a new service bureau for this area. Motion was made by Councilman Pate seconded by Councilman Silva and carried that the City of Gilroy endorse the proposed program and the City gives tentative commitment to the said program. A report on Comprehensive Manpower Act Provisions was noted. Motion was made by Councilman Hughan seconded by Councilman Silva and carried that the Mayor be autorized to advise the I.C.C. Mayors' Committee that the City would 1 ike a representative of South County on the Manpower Board. A report on an Industrial Effluent Pump Station and Outfall 1 ines Project 74-2 was noted and discussed. City Administrator Wood noted that a copy of the proposed resolution establ ishing rates for industrial sewerage service charges was included within the Council packet for informational purposes and recommended that same be tabled to the next Council Meeting. Motion was made by Councilman Stout seconded by Councilman Silva and carried that authorization be given for the call for bids for said project to be opened February 14, 1974. A report on Monterey Street Beautification Project was noted. Discussion was had on the matter. Council requested the State to par- ticipate in removing the median strip on Monterey Street from Fourth Street to Hornlein Court, and the Council delay action in this regard to ~wait the State's answer regarding same. City Administrator Wood noted that said plans and speCification should be available on January 23 for bid opening on February 14, 1974 at 1 :00 p.m. Council instructed the City Administrator to have the Doyle House removed from the new library site property. City Administrator Wood noted that an appl ication for annexation of "Stelling 73-8" had been filed with LAFCO. Council had no objection to same. City Administrator Wood reported that he was unsuccessful in his efforts to combine the two Senior Citizens' Nutrition Programs previously discussed by Council. Civic Apprecia- The Mayor reminded Council that reservations for Civic tion Day '74 Appreciation Day ~974 had to be made by February 1, 1974. The following Council Members indicated their desire to attend same: Mayor Goodrich, Councilmen Pate, Duffin, Hughan, and DeBell. Adjournment At 10:42 p.m., the Mayor adjourned the meeting.
