The Adjourned Regular Meeting of the Gilroy City Council
was called to order by His Honor Mayor Norman B. Goodrich at 5:03 p.m.
Present: Council Members: Dennis L. DeBell, George T.
Duffin, Marion T. Link, John E. Pate and Norman B. Goodrich. Absent:
Council Members: William E. Childers and David V. Stout.
The Mayor stated that the purpose of the adjourned meeting
from February 7, 1977, Regular Meeting was called to hear an appeal
of Mr. Raul Caballero, Tree Climber - Parks and Recreation Depart-
ment regarding the Personnel Commission's decision of December 8,
1976.
City Administrator Wood reviewed the procedure for demotions
and dismissals under the Personnel Rules and Regulations.
The City Attorney recommended that the meeting be closed to
an Executive Session to review the written reports and following in
open meeting Mr. Caballero or his representative could present his
appeal to be followed by a rebuttal from the Recreation Department.
The Mayor closed the meeting to an Executive Session at 5:12 p.m.
The Mayor reconvened the meeting at 5:24 p.m.
Mr. David Looman, Local 101 Union Representative, addressed
the Council and noted that this was an open hearing at the request
of Mr. Raul Caballero. He noted that there were two (2) separate
actions being conducted and neither were supported by the record;
specifically, that Mr. Caballero had been removed from the Tree Crew
and that he had been demoted from the classification of Tree Climber
to Utility Man I. He further noted that there was no record which
addressed the issue as to why he was being removed from the Tree Crew
and demoted to Utility Man I.

The City Attorney noted for the record that Mr. Caballero was
being demoted to Groundskeeper I, rather than Utility Man I.
Mr. Looman stated that he believes the demotion decision should
be reversed.
Personnel Director Reinsch explained the classifications of
Utility Man Trainee in the Tree Maintenance Division had been abolished
and employees in that category have been given the title of Grounds-
keeper I; Utility Men II had been reclassified as Tree Climbers. He
furhter noted that Tree Climbers do not have to complete 4~ years as
Groundskeepers I; however, they cannot be unskilled trainees to qualify
for said position.
Discussion was had by Council on the subject matter.
Mr. Looman requested that Council be provided with the complete
evaluation record documents leading up to Mr. Caballero's demotion action.
Mr. Rudy Quintanar, Park Supervisor, presented, read and explained
the following evaluation memos requested dated May 9, 1975, January 12,
1976, March 12, 1976, and August 23, 1976.
Further discussion was had by Council on the matter.
Motion was made by Councilman Pate seconded by Councilman Link
and carried that the ruling of the Personnel Commission with respect
to Mr. Raul Caballero's demotion action from Tree Climber to Grounds-
keeper I be concurred with and affirmed.
Adjournment At 6:15 p.m., motion was made by Councilman Link seconded by
Councilman Pate and carried that this meeting adjourn to Tuesday,
February 22, 1977, at 8:00 p.m.
