Election Res. #77-15 Gilroy, California March 15, 1977 The Adjourned Regular Meeting of the Gilroy City Council was called to order by His Honor Mayor Norman B. Goodrich at 8:00 p.m. Present: Council Members: Dennis L. DeBell, George T. Duffin, Marion T. Link, John E. Pate, David V. Stout and Norman B. Goodrich. Absent: Council Member: William E. Childers The City Clerk presented the Registrar of Voters' Certificate of the Official Returns of the General Municipal Election of Tuesday, March 8, 1977. Motion was made by Councilman Link seconded by Councilman Duffin that the reading of Resolution No. 77-25 be waived and that it be adopted. RESOLUTION NO. 77-25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING AND ADOPTING THE REGISTRAR OF VOTER~S CANVASS OF THE GENERAL MUNI- CIPAL ELECTION AND DECLARING RESULT OF SUCH ELECTION HELD IN THE CITY OF GILROY ON MARCH 8, 1977. 3905 RESOLVED, by the City Council of the City of Gilroy, California, that .~...... WHEREAS, by order of this Council, a general municipal election was held and conducted in the City of Gilroy and consolidated with the Biennial Governing Board Member Election, Gavilan Joint Community Col- lege District and County Board of Education on Tuesday, the 8th day of March, 1977, as required by law and the Charter of said City as amended; WHEREAS, it appears that notice of said election was duly and legally given; voting precincts were properly established; election officers were appointed and election supplies furnished; and in all respects, the election was held and conducted and the votes cast thereat received and canvassed, and the returns thereof made, determined and declared in time, form and manner as required by the tharter of said City as amended and the general laws of the State providing for and regulating municipal elections in said City; - WHEREAS, the Registrar of Voters did conduct the canvass of the returns of said municipal election and did count the absentee ballots cast thereat, pursuant to direction and order of the City Council of said City; and WHEREAS, said canvass was duly completed and the results thereof were certified by the Registrar of Voters and submitted to this Council. NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, as follows: 1. Said municipal election was held and conducted in the City of Gilroy, County of Santa Clara, State of California, and consolidated with the Biennial Governing Board Member Election held in Gilroy Unified School District, Gavilan Joint Community College District and County Board of Education, Trustee Area held on Tuesday, March 8, 1977, in the time and in the form and manner as required by law. 2. That there were established six (6) voting precincts for the purpose of holding said municipal election consisting of either regular election precincts established for holding state or county elections, or a consolidation of some or all of such precincts, as follows: CONSOLIDATED PRECINCT NO. 3953, comprising state and county precincts designated Precinct Numbers 3953, 3956 and 3965 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3954, comprising state and county precincts designated Precinct Numbers 3952 and 3954 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3955, comprising state and county precinct designated Precinct Number 3955 as established by the Santa Clara County Board of Supervisors. ,--- CONSOLIDATED PRECINCT NO. 3957, comprising state and county precincts designated Precinct Numbers 3957, 3959, 3960 and 3968 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3961, comprising state and county precincts designated Precinct Numbers 3958,3961, 3962 and 3963 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3969, comprising state and county precincts designated Precinct Numbers 3951 and 3969 as established by the Santa Clara County Board of Supervisors. ..... 3. The canvass of the returns of the votes cast and the counting of absentee ballots cast in said City for the offices of City Council- members was duly held by the Registrar of Voters in accordance with the order of the Council and in accordance with law and said Registrar of Voters has executed a certificate certifying to the results of such canvass, which certificate is hereto attached, marked Exhibit I'A" and by this reference is made a part hereof. Said certificate has been examined and is hereby approved and adopted by this Council as the offi- cial canvass of said municipal election. 3906 4. The whole number of votes cast in said City of Gilroy at said municipal election was 2,533 (including absentee votes). 5. The names of the persons voted for, the offices for which they were voted, the number of votes received by each of said persons in each of said precincts and by absentee votes, together with the whole number of votes which they received in the entire city, are shown on said Exhibit II A" , hereto attached. 6. At said general municipal election held in the City of Gilroy and consolidated with the Biennial Governing Board Member Elec- tion held in Gilroy Unified School District, Gavilan Joint Community College District and County Board of Education, Trustee Area, held on March 8, 1977, the following persons were elected to the follow- ing offices: ....... I ".'~ BRIAN CUNNINGHAM was elected a member of the City Coun- cil to hold office for a term of four years, from and after Tuesday, March 15, 1977, and continuing until his respective successor shall qualify. ROBERTA HOWSON HUGHAN was elected a member of the City Council to hold office for a term of four years, from and after Tuesday, March 15, 1977, and continuing until here re- spective successor shall qualify. JOHN IIJACKII E. PATE was elected a member of the City Council to hold office for a term of four years, from and after Tuesday, March 15, 1977, and continuing until his respective successor shall qualify. 7. The City Clerk is hereby directed to make out and deliver to each of the persons elected a certificate of election signed by her and duly authenticated. She shall also impose the constitu- tional oath of office and have them subscribe thereto. 8. That the City Clerk be, and she is hereby, instructed to ... enter this resolution in full in the minutes of this Council as a statement of the result of said general municipal election. .... Roll Call Mayor Pro- tempore Adjournment The Ci~y Clerk gave the oath of office and issued certificates of election to the Council Members elect. Present: Council Members: Brian D. Cunningham, Roberta H. Hughan, Marion T. Link, John E. Pate, David V. Stout and Norman B. Goodrich. Absent: Council Member: William E. Childers The Mayor welcomed Council Members elect: Brian D. Cunningham and Roberta H. Hughan and Incumbent John E. Pate. The new Council Members said a few words. The Mayor presented certificates of service, name plates and gifts from the City to retirinq Council Members Duffin and DeBell. Council Members Duffin and DeBell gave their farewell speeches. The Mayor recommended that Councilman Pate be appointed as Mayor Protempore to replace Councilman Duffin. Motion was made by Councilwoman Hughan seconded by Councilman Cunningham and carried that Councilman Pate be appointed ~1ayor Protempore. At 8:15 p.m., the Mayor adjourned the meeting.
