The Regular Meeting of the Gilroy City Council was called to
order by His Honor Norman B. Goodrich at 8:00 p.m.
Present: Council Members: Cunningham, Hughan, Link, Pate, Stout,
and Goodrich. Absent: Council Member: William E. Childers.

The Mayor presented said resolution to Officer Horta.
City Administrator Wood noted a letter from the F.B.I. also
commending Police Officer Horta listed under Informational Correspon-
dence of the Agenda.
The Mayor introduced new employee, Steven A. Morrow, Police
Officer Trainee.
Motion was made by Councilman Link seconded by Councilman Cun-
ningham that the following items under the Consent Calendar be approved
by the following Roll Call Vote: AYes: Council Members: Dunningham,
Hughan, Link, Pate, Stout and Goodrich. Absent: Council Member:

the Council and presented a flag donation on behalf of said organization.

A letter from the League of California Cities endorsement of
Gas Transportation System for the proposed Alaskan Route was noted.
City Administrator Wood noted that Mr. Dave Sorenson, Manager of
P. G. & E. was unable to attend this meeting to comment on his company's
support of the Arctic Route. Said matter was tabled to await Mr. Sorenson's
presence at a future meeting.
League Bulle- The League of California Cities Legislative Bulletin #23 - 1977
tin #23 was noted informing the City of SB 164 re: Compulsory and Binding Arbi-
tration being defeated on the floor of the Senate.

Councilman Stout requested that letter of appreciation be
forwarded to Senators Alquist and Richardson thanking them for sup-
porting the City's request.

The Minutes of the Parks and Recreation Commission Meeting of
June 28, 1977, were noted.
The Minutes of the Library and Culture Commission Meeting of
June 7, 1977, were noted.

The Summary of Monthly Reports of May, 1977, was noted and
discussed.
The Report of Disbursements from June 1, 1977, through and
including June 30, 1977, was noted and discussed.
The Police Chief's Report on Ro1ling Blackouts was noted.
A Report on a meeting in regard to ABAG Corridor Study was
noted and discussed.
Mr. Jim Roberts, Secretary-Manager of the Gilroy Chamber of
Commerce, addressed the Council noting a public hearing on July 28,
1977, regarding the city's concern about said issue.
Director of Public Works-City Engineer Hansen recommended ap-
proval of the plans and development agreements for Fortino Apts. on
Wren Avenue and for Monier Tile Company.
Motion was made by Councilman Link seconded by Councilman
Hughan and carried that the plans and development agreements for
Fortino Apartments and for Monier Tile Company be approved as pre-
sen ted.

Planning Director Bedaux presented and explained the land use
in the vicinity of the proposed IIMurray Avenue Annexation 77-3.11
Councilman Stout did not enter into the discussion nor vote on
said matter; however, did present an explanation of the history of
said lands for Council information requested on same.
Mr. Bob Kishimura addressed the Council, opposing residential
zoning in said area.
Mrs. Jean Beno addressed the Council noting that she owns
property that she is unable to develop in said area.
Mrs. Vivian Chiesa, owner of the lands of the proposed annexa-
tion, addressed the Council noting that she has not received an offer
from any prospective industry for her property since 1926.
Discussion was had on the matter by Council.
Motion was made by Councilman Link seconded by Councilwoman
Hughan and carried that said matter be referred to the Planning Com-
mission requesting that a public hearing be set for possible amend-
ment to the General Plan regarding the properties on the easterly
portion of the land use map presented and discussed; specifically, the
Kishimura property on the easterly portion of said map, and the pro-
perties of Chiesa, Pitney, Costello, Torres and Tomey.

Planning Director Bedaux presented an up-dated Sewer Plant
capacity report for informational purposes. Councilman Link requested
that the Council Sewer Advisory Committee meet and discuss same.

Director of Public Works-City Engineer Hansen requested approval
of the Traffic Speed Zone Survey previously submitted to Council. Motion
was made by Councilman Stout seconded by Councilwoman Hughan and carried
that Council accepts the Survey as presented, noting that accepting same
is not a condition to become an ordinance at this time.
The Mayor's request for an Executive Session following the regular
agenda was noted.

Zoning-Swanston Councilman Stout inquired of any action required by Council re-
Lane area garding the zoning in the Swanston Lane area between Swanston Lane and
Forest Street, south of Leavesley Road.

Proceedings
Planning Director Bedaux noted that said area will be scheduled
for a public hearing before the Planning Commission regarding rezoning
same, with various types of uses excepting industrial use.
Councilman Stout noted that the City has formed some prior assess-
ment districts and not included an option for advanced maturities and
that, in future assessment districts, the City should include Section 11.1
of the Streets and Highways Code which allows an option procedure for same.
School Impact Councilman Cunningham inquired about the proposed School Impact
Ord. Fee Ordinance.
City Administrator Wood noted that the County has continued the
matter to allow a meeting with the Home BuHders Association who claim
that they were not notified of recent meetings on same. He further
noted that the City will issue permits if the property has been cleared
by the School District with a letter agreement for same being presented
to the City Building Department.
Budgeted Items Purchasing Agent Reinsch requested Council direction on presenting
budgeted item expenditures to Council.

Adjournment
Council had no objection for Staff to proceed in presenting same
to them as has been done in the past; specifically, purchasing budgeted
items exceeding $1,500 and reporting same to Council.
City Administrator Wood repouted that he received word from
Congressman Mineta's Office that the Bureau of Reclamation has ver-
bally approved the $1,000,000 interest free loan for the Water Re-Use
Project along Uvas Creek. He advised Council of a meeting July 6, 1977,
at 7:30 p.m. in the Council Chambers with the potential users regardi~
said program. He further noted that the Water District, who is acting
as administrators of the project, indicates that based on the rulings
of the Bureau of Reclamation, we are going to have to go to outside
contract on this rather than have any of the three (3) agencies contri-
but in-kind services other than engineering services; further that the
prior plan to use CETA services apparently cannot be utilized.
The Mayor noted the Inter-City Council Meeting of July 7, 1977,
at the Capri Restaurant in Morgan Hill. Councilman Pate noted that
he would attend same.
At 9:51 p.m., the Mayor adjourned the meeting to an Executive
Session of the Council.
At 10:23 p.m., the Mayor re-opened the meeting.
Salaries- City Motion was made by Councilman Stout seconded by Councilman Pate
Admin. & City and carried that annual salaries of $32,500 for the City Administrator
Attorney and $12,000 for the City Attorney be approved.
At 10:25 p.m., the Mayor adjourned the meeting.
