The Special Meeting of the Gilroy City Council was called to
order by His Honor Mayor Norman B. Goodrich at 8:00 p.m.
Roll Call
Present: Council Members: William E. Childers, Roberta H. Hughan,
John E. Pate, David V. Stout and Norman B. Goodrich.
Absent: Council Members: Brian D. Cunningham and Marion T. Link.
Urban Service The Mayor stated that this is the time and place scheduled to
Area review Urban Service Area filed applications.
A letter from Paul E. Sagers, Local Agency Formation Commission,
to the Mayor and City Council re: annual review of City Urban Service
Areas was noted.
A letter from Mr. Jack Y. Wong to Michael Dorn, Planning Director,
re: inclusion into the Urban Service Area was noted.
Councilman Link entered at 8:03 p.m. and took his seat at the
Council table.
A letter in regard to the lands of Marcella Avenue Annexation
was noted. Council further clarified previous action that they will
accept the recommendation of the Planning Commission for inclusion of
parcels in the Urban Service Area to be recommended to the Local Agency
Formation Commission for approval of same and at this meeting further
study additional Urban Service Area requests on file that are within
the City Limits.
Planning Director Dorn presented and explained the Staff
Report.
Councilman Stout del cared himself absent during the discussion
and action regarding the applications referred to in the Staff Report,
specifically, Items No.5 and 6.
Mr. Ted Schaal representing Larry Essary, addressed the Council
and explained the proposal for 132 acres located north of Mantelli
Drive and west of Morey Avenue, specifically, Item #7 within the Staff
Report.
Mr. Tom Herrington, representing Eileen Wu for Tin Investments,
addressed the Council and spoke to 38.8 acres located north of Santa
Teresa Boulevard and west of Thomas Road, specifically, Item #10 within
the Staff Report.
Mr. Bob Dyer, representing Kent Enterprises, addressed the Council
requesting inclusion of nine (9) parcels containing 54.9 acres to be
included in the Urban Service Area, specifically, Items 12, 13, 26, 29,
30, portion of 31, and 33 within the Staff Report.
Mr. John M. Filice, Jr., representing Filice Estate Vineyards,
addressed the Council requesting inclusion of 12.9 acres located approxi-
mately 300 feet south of UvasjCarnadero Creek, west of Thomas Road.

It was noted that the Planning Commission has recommended the
inclusion of property of Lloyd E. Martin for 0 & E Development, 3
acres located east of Kern Avenue, approximately 250 feet north of
Ramona Way and no need for discussion of same.

Mr. S. Stephen Nakashima, addressed the Council requesting
inclusion of 233~ acres located west of Morey Avenue, approximately
2500 feet north of Mantelli Drive, specifically, Item No. 40 within
the Staff Report.

Mr. Louis Masoni, representing Masoni Brothers, addressed
the Council requesting inclusion of 54.9 acres located north of
Santa Teresa Boulevard, approximately 1200 fe~t west of Thomas
Road, APN 808-21-001 (not within the City Limits); 808-20-003,
northwest corner of Santa Teresa Boulevard and Thomas Road (within
the City Limits); 808-21-001 (not within the City Limits) located
east of Thomas Road, west of Uvas/Carnadero Creek, approximately
250 feet north of Santa Teresa Boulevard and 810-23-002 and 003
(within), 810-23-004 (not within the City Limits) north of Miller
Avenue (Mesa Road), south of Santa Teresa Boulevard, specifically,
Item No. 44 included in the Staff Report.
Mr. Harold Packard, addressed the Council representing nine
(9) parcels containing 7+ acres, specifically, Item L5 under the Staff
Report noting that each property owner wishes to construct one (1)
single family residence on each parcel requesting inclusion in the
Urban Service Area.

Director of Public Works-City Engineer Hansen noted that
said properties could be service by gravity to the Lift Station.
It was noted that property of Mr. & Mrs. John W. Dollar, containing
10 acres located at the northwest corner of Mantelli Drive and Morey
Avenue, specifically, Item L1 under the Staff Report was included
by previous action.
It was noted that the request of Kenneth W. Bell for 36.38
acres located south of Hecker Pass Highway, approximately 800 feet
west of Santa Teresa Boulevard is not located within the City Limits.
City Administrator Wood recommended inclusion of 66.19 acres
belonging to Ernest S. Filice located east of the South Valley Free-
way at Luchessa Avenue, since same is proposed for industrial develop-
ment.

Discussion was had in regard to completion of Pnoject 566.
City Administrator Wood noted that said project has been deferred.
Council took the following action on the 1978 Urban Service
Area application requests which include approximately 540 acres into
the Urban Service Area in addition to the acreage recommended by
the Planning Commission and approved by Council.
Councilman Stout declared himself absent during the discussion
and action on Item No.5 and 6 within the Staff Report. Motion was
made by Councilman Pate seconded by Councilwoman Hughan and carried
that properties under Item No.5 and 6 of A. M. Lollar and Dr. Horace
H. Bertelsen, respectively, not be included in the Urban Service
Area at this time.
T.Schaal Prop. Motion was made by Councilman Childers seconded by Councilman
Link and carried that 132 acres located north of Mantelli Drive
and west of Morey Avenue of Ted Schaal under Item 7 be included in
the Urban Service Area.

Ting Investments- Motion was made by Councilman stout seconded by Councilman
Filice Est. Childers that 38.8 acres located north of Santa Teresa Boulevard and
Vyds., & west of Thomas Road, Eileen Wu for Ting Investments, specifically
Masoni Bros. Item 10; 12.9 acres located approximately 300 feet south of Uvas/
Carnadero Creek, west of Thomas Road, John M. Filice, Jr., for
Filice Estate Vineyards, specifically Item 16; and 54.9 acres

located in the vicinity of Thomas Road and Santa Teresa Boulevard,
Masoni Brother, specifically Item 44, be included in the Urban Service
Area, by the following Roll Call Vote: Ayes: Council Members: Childers,
Link, Stout and Goodrich; Noes: Council Members: Hughan and Pate;
Absent: Council Member: Cunningham.
Rd. Motion was made by Councilman Childers seconded by Councilman
Link and carried that north Monterey Road properties, specifically Item
No. 12, 13, 26, 29, 30, portion of 31, and 33, including those parcels
in the area that are in the City but not applying for Urban Service Area,
be approved for inclusion in the Urban Service Area. (Dorothy Kroeger,
8 acres located approximately 200 feet west of Monterey Road, north of
Farrell Avenue); (Olive Old, 1 acre located approximately 300 feet west
of Monterey Road, north of Farrell Avenue); (Salvatore & Elena Oliveri,
5 acres located west of Monterey Road approximately 375 feet north of
Farrell Avenue); (Marvin S. Ueki, 1/3 acre located north of Farrell
Avenue, approximately 200 feet west of Monterey Road); (Joseph Gomes,
16.5 acres located west of Monterey Road, approximately 900 feet south
of Day Road); (Jack Y. Wong, portion of 23 acres in the City Limits,
11.6 acres, west of Monterey Road approximately 500 feet. south of Day
Road); and (Violet Delgado, .64 acres located west of Monterey Road,
approximately 50 feet north of Farrell Avenue); and approximately 25
acres in the area that are in the City not applying for Urban Service
Area.
Motion was made by Councilman Stout seconded by Councilman
Childers and carried that the request of S. Stephen Nakashima for 233.5
acres located west of Morey Avenue, approximately 2500 feet north of
Mantelli Drive, specifically Item No. 40 be included in the Urban
Service Area. Council Members: Hughan and Pate voted "noli on the motion.
& Motion was made by Councilman Link seconded by Councilwoman
Hughan and carried that nine (9) property owners under Item L5 of the
Staff Report in the vicinity of Miller Avenue and Santa Teresa Boulevard
be authorized to develop their lands as proposed for one (1) S.ingle
Family Residence on nine (9) separate parcels but that said properties
not be included in the Urban Service Area, noting that all properties
are presently in the City Limits.
Council referred the applications of Ernest S. Filice, 66.19
acres east of the South Valley Freeway at Luchessa Avenue and of Donald
E. McMurray for the First Assembly of God, 8 acres located south of
Uvas/Carnadero Creek, approximately 1000 feet west of Thomas Road to
the Planning Commission for their recommendation. It was noted that
the City's requests for inclusion of properties in the Urban Service
Area can be presented to the Local Agency Formation Commission in late
November, 1978.
At 9:45 p.m., the Mayor adjourned the meeting.
