Plan ., ' 4295 October 22, 1979 Gilroy, California The Adjourned Regular Meeting of the -Gilroy City Council was called to order by His Honor Mayor Norman B. Goodrich at 8:00 p.m. Present: Council Members: Brian D. Cunningham, Roberta H. Hughan, r,1arion T. Link, John E. Pate, David V. stout and Norman B. Goodrich. Absent~ Council Member: William E. Childers. The Mayor stated that the purpose of this meeting was to discuss comments made at the Planning Commission and City Council meetings on the Modified Draft General Plan. City Administrator Wood noted Staff's summary of comments made at these hearings and specific policy changes recommended by the Planning Commission and suggested Council review and discuss these comments at this time. The following suggested changes and comments were made: 1. Page 9, line 33 - Delete the wording, "self-sufficiene from II A ba 1 anced self-sufficient commun i ty.. . . . II 2. Page 10, Line 5 - As a policy, Phase I area and Urban Service Area lines should be con~ruent and Phase II and Transition Zone lines should be congruent. 3. Page 11, Line 8 - Opposes deletion of wording, "and south of Leavesley Road....." 4. Page 12, Line 3 - Leave in preservation of character of downtown....... 5. Page 18, Line 19 - No discussion re: Policy 5. 6. Page 19, Line 23 - Agrees with addition of "actions which should not unnecessarily delay the project." 7. Page 22, Li ne 26 - Del ete the word elm from II stands of elm trees....." 8. Page 23, Line 2 - Agrees to addition of "Both passive and active solar systems will be encouraged, and new homes should be designed (instead of oriented) for the best possible solar access." 9. Page 23, Line 29 - Agrees to deletion of maximum probable earthquake and adding in accord with the Uniform Building Code. 4296 Demo 1 iti on of Historical Structure Adjournment 10. pate 28, Ch. III - No obJection to including comment that a Master Beau ification Plan is desirable (instead of needed). 11. Page 31, Line 34 - Agrees to adding sex or disability characteristics. 12. Page 31, Line 36 - Agrees to adding, a community-wide mix in housing types..... 13. Page 32, Line 8 - Deferred comments re: residential uses east of the South Valley Freeway south of Leavesley Road. 14. Pages 31-40, Ch. IV - Incorporate a sentence, "to improve jobs/housing balance." 15. Page 35 - Deferred action re: Planning Commission's recom- mendation to delete Rural Residential designation. 16. Page 35, Line 22 - Refer to minimum site area of 16 dwelling units per net acre. 17. Entire context - Delete all utility company names and refer to them only as "utility companies." 18. Page 42, Line 10 - Agrees to deletion of agricultural use and use the term, "Agriculture will be encouraged as an interim use in vacant areas designated for industrial use." 19. Pa~e 51, Line 32 - Agrees with substitution of could for "will" and ellminating "under one roof." 20. Page 53, Ch. VI - Add policy to General Plan that City and School District should establish a joint liaison. 21. Page 53, Line 34 - Motion was made by Councilwoman Hughan seconded by Councilman Pate and carried to approve the Planning Com- mission's recommendation to add the following statement to Policy 16: "Verification of remaining capacity in local schools will become a part of the review process for residential subdivisions assigned a buildout schEidul e. II 22. Page 54, Line 33 - Agrees to adding new policy, liThe City will encourage the use of drought resistant landscaping and low-flow irrigation systems." 23. Page 55, Line 31 - Agrees to addition of new policy but eliminate complete design from, liThe City will undertake a complete design study....." 24. Page 65 - Agrees to adding historic preservation element to the matrix. City Administrator Wood noted that on October 1, 1979, the City developed a policy under the EIR approval that all developments con- cerning historical structures within the community would have to have initial studies. He noted that Mr. Joe Espinoza began demolition of a building included in the inventory for historical structures without obtaining a permit and that the City had stopped the demolition. Mr. Joe Espinoza addressed the Council and stated he has al- ready paid plan check fees for development of the property. Discussion was had on the matter. Motion was made by Council- man Link seconded by Councilman Stout and carried that Mr. Espinoza be instructed to obtain a demolition permit and be aHowed to proceed with the demolition of the building.
