Minutes 1979/11/13 l 4309 November 13~ 1979 Gilroy, California The Adjourned Regular Meeting of the Gilroy City Council was called to order by His Honor Norman B. Goodrich at 8:05 p.m. Roll Call Present: Council Members: William E. Childers, Roberta H. Hughan~ John E. Pate~ David V. Stout and Norman B. Goodrich. Absent: Council Members: Brian D. Cunningham and Marion T. Link. Res. Dev. Ord. The Mayor noted the continuance of Council deliberation on the proposed Residential Development Ordinance. Planning Director Dorn reported on the Council Advisory Committee1s meeting to review the proposed ordinance and noted the following revisions recommended by the Committee: 1. Page 1, A - Change last sentence to read, "Recently, substantial fluctuations above six percent have occurred in the City's growth .rate." 2. Page 1~ D - Change the work~ "critical" to "limited." 3. Page 5~ #4 - Change to read~ "Any residential development projects sponsored and funded by government are exempt if: a. Approved by a referendum vote, or b. The project consists of 20 units or less and the project is specifically approved for exemption by the City Council. 4. pafie 6, A - In middle of paragraph, change sentence to read~ "In setting t e Numerical Limit, the City Council shall also consider the number of units previously issued permits under assigned build-out schedules and units previously permitted as exception to this ordinance." 5. Page 7 ~ #3 - Next to last sentence~ omit the word, "solely". Neg. Declaration Motion was made by Councilman Pate seconded by Councilman Childers and carried that a Negative Declaration be issued regarding the environ- mental impact of the proposed ordinance. Intro. Ord. Motion was made by Councilwoman Hughan seconded by Councilman Chil- ders and carried that an ordinance regulating new residential development within the City be introduced, the reading waived, and that it be published by title and summary. Councilman Stout voted "no" on the motion. Res. #79-91 11/6/79 Election Resu 1 ts re: The City Clerk noted the Registrar of Voters certification of the official returns of the General Municipal Election of November 6, 1979. Motion was made by Councilman Stout seconded by Councilman Pate that Resolution No. 79-91 declaring the total vote and elected officers of the City be adopted and the reading waived. 4310 RESOLUTION NO. 79-91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING AND ADOPTING THE REGISTRAR OF VOTERS' CANVASS OF THE GENERAL MUNI- CIPAL ELECTION AND DECLARING RESULT OF SUCH ELECTION HELD IN THE CITY OF GILROY ON NOVEMBER 6, 1979. RESOLVED, by the City Council of the City of Gilroy, Cali- fornia, that WHEREAS, by order of this Council, a general municipal elec- tion was held and conducted in the City of Gilroy and consolidated with the Special Statewide Election on Tuesday, the 6th day of November, 1979, as required by law and the Charter of said City as amended; and WHEREAS, it appears that notice of said special election was duly and legally given; voting precincts were properly established; election officers were appointed and election supplies furnished; and in all respects the election was held and conducted and the votes cast thereat received and canvassed, and the returns thereof made, determined and declared in time, form and manner as required by the Charter of said City as amended and the general laws of the State providing for and regulating municipal elections in said City; and WHEREAS, the Registrar of Voters did conduct the canvass of the returns of said municipal election and did count the absentee ballots cast thereat, pursuant to direction and order of the City Council of said City; and WHEREAS, said canvass was duly completed and the resul ts there- of were certified by the Registrar of Voters and submitted to this Council. NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, as follows: 1. Said municipal election was held and conducted in the City of Gilroy, County of Santa Clara, State of California, and consolidated with the Special Statewide Election held throughout Santa Clara County on Tuesday, November 6, 1979, in the time and in the form and manner as required by law. 2. That there were established seven (7) voting precincts for the purose of holding said municipal election consisting of either regular election precincts established for holding state or county elections, or a consolidation of some or all of such pre- cincts, as follows: CONSOLIDATED PRECINCT NO. 3951, comprising state and county precincts designated Precinct Numbers 3951, 3953 and 3955 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3952, comprising state and county precincts designated Precinct Numbers 3952 and 3954 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3956, comprising state and county precincts designated Precinct Numbers 3956, 3957, 3965 and 3968 as established by the Santa Clara County Board of Super- visors. CONSOLIDATED PRECINCT NO. 3958, comprising state and county precincts designated Precinct Numbers 3958, 3961, 3962 and 3963 as established by the Santa Clara County Board of Super- vi sors. The canvass of the returns of the votes cast and the counting of absentee ballots cast in said City for the office of Mayor and for the offices of City Council members was duly held by the Registrar of Voters in accordance with the order of the Council and in acco~dance with law and said Registrar of Voters has executed a certificate certifying to the results of such canvass, which certificate is hereto attached, marked Exhi bit "A" and by thi s reference is made a part hereof. Sai d certificate has been examined and is hereby approved and adopted by this Council as the official canvass of said municipal election. - ...... 4. The whole number of votes cast in said City of Gilroy at said municipal election was 3,549 (including 92 absentee votes). 5. The names of the persons voted for, the offices for which they were voted, the number of votes received by each of said persons in each of said precincts and by absentee votes, together with the whole number of votes which they received in the entire City, are shown on said Exhibit "A", hereto attached. 6. At said general municipal election held in the City of Gilroy and consolidated with the Special Statewide Election held throughout Santa Clara County on November 6, 1979, the following persons were elected to the following offices: NORMAN B. GOODRICH was elected Mayor of the City Council to hold office for a term of four years, from and after Tuesday, November 13, 1979, and continuing until his respective successor shall qualify. ROBERT E. TAYLOR was elected a member of the City Council to hold office for a term of four years, from and after Tuesday, November 13, 1979, and continuing until his respective successor shall qualify. MARION T. LINK was elected a member of the City Council to hold office for a term of four years, from and after Tuesday, November 13, 1979, and continuing until his respective successor shall qualify. SHARON ALBERT was elected a member of the City Council to hold office for a term of four years, from and after Tuesday, November 13, 1979, and continuing until her respective successor shall qualify. 7. The City Clerk is hereby directed to make out and deliver to each of the persons elected a certificate of election signed by her and duly authenticated. She shall also impose the constitutional oath of office and have them subscribe thereto. 8. The City Clerk gave the oath of office and issued certificates of election to the Council Members elect. The Mayor called the meeting of the new Council to order. Present: Council Members: Sharon Albert, Roberta Hughan, John E. Pate, Robert E. Taylor and Norman B. Goodrich. Absent: Council Members: Brian D. Cunningham and Marion T. Link. Mayor Goodrich gave an acceptance speech, thanking everyone for re-electing him to office and welcomed new Councilmembers Sharon Albert and Robert Taylor. - - The new Councilmembers spoke and expressed their appreciation for being elected to office. The Mayor presented Certificates of Service, name plates and gifts from the City to retiring Councilmembers Stout and Childers. Committees Adjournment , . , . 4313 :Councilman Taylor 'spoke regarding the South County Task Force Advisory Committee. The Mayor instructed same to be placed on the agenda for the meeting of November 19, 1979. The Mayor stated that new appointments to the various Council Advisory Committees would be made at the next meeting. At 8:33 p.m., the Mayor adjourned the meeting.
