The Regular Meeting of the Gilroy City Council was called to order
by His Honor Norman B. Goodrich at 8:00 p.m.
Present: Council Members: Sharon Albert, Roberta H. Hughan, Marion
T. Link, John E. Pate, Robert E. Taylor and Norman B. Goodrich.
Absent: Council Member: Brian D. Cunningham.
City Administrator Wood presented and explained a proposed Resolution
supporting Industrial and Commercial Growth.
(Councilman Cunningham entered at 8:01 p.m. and took his seat at the
Council table.)
Motion was made by Councilman Link seconded by Councilman Cunningham
that the reading of Resolution No. 79-107 be waived and that it be adopted.

RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY SUPPORTING INDUSTRIAL AND
COMMERCIAL GROWTH.
PASSED AND ADOPTED this 3rd day of December, 1979, by the following vote:

Councilman Pate noted that there were typographical errors on the
minutes of the November 19, 1979 Regular Council Meeting, specifically
indicating Councilman Taylor absent in the Roll Call Votes of Resolutions
No. 79-101, 79-102, and 79-103 when, in fact, Councilman Pate was absent
during said Roll Call Votes.
Motion was made by Councilman Pate seconded by Councilman Link that
the following items under the Consent Calendar be approved by the following
Roll Call Vote: Ayes: Council Members: Albert, Cunningham, Hughan, Link,
Pate, Taylor and Goodrich;
Approved the Minutes of the Regular Council ~1eeting of November 19,
1979, with corrections as noted;
Def.Dev. Agree. Approved a Deferred Development Agreement with Foremost Gentry Corp.

RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY DECLARING CERTAIN WEEDS
GROWING IN THE CITY OF GILROY TO BE A PUBLIC NUISANCE, DESCRIBING WEEDS
WHICH CONSTITUTE SUCH NUISANCE AND PROVIDING FOR GIVING NOTICE OF THE
ADOPTION OF THE RESOLUTION BY PUBLICATION THEREOF.

5th St. Storm Director of Public Works-City Engineer Hansen presented and
Dr.Proj. explained a report on bids received for the Fifth Street Storm Drain
1979-8 Project 1979-8. Motion was made by Councilman Link seconded by Coun-
cilman Pate and carried that the bid of William Caprista in the amount
of $97,400.00 be awarded for the Fifth Street Storm Drain Project
1979-8 as recommended.

City Administrator Wood recommended that the 1979-80 Budget
not be amended to allow for this project; that the Storm Drain Fund
show a deficit until future fees are collected for this area. Council
concurred.

The Mayor asked if there was anyone in the audience wishing to
speak on any matter not on the agenda.

Mr. James Payton, Business Agent for the Sanitary Truck Drivers
and Helpers Local Union 350 addressed the Council and requested Coun-
cil to meet with the Garbage Negotiators in regard to the present
garbage strike.
The Mayor noted that this matter is between the Garbage Company
and Union and that the City does not intend to participate or interfere
with the matter.
City Administrator Wood recommended and encouraged an early
settlement of the garbage strike.
The Mayor noted a request from Falcon Cable TV for continuance
of the scheduled hearing to consider their rate increase proposal. The
Mayor continued said hearing to December 17, 1979, as requested.
The Council Advisory Committee Meeting of December 4, 1979, at
9:00 a.m., with Falcon Cable TV representatives was noted.
An invitation was noted from PACE (PREVENT ALCOHOL ABUSE) to
a Non-Alcoholic Beverage Contest.

A letter from the Board of Supervisors was noted requesting
a meeting on Transition Zones.
Director of Planning Dorn presented a memorandum for presenta-
tion of same to the Board of Supervisors at their December 17, 1979,
meeting recommending abandoning the Tentative Zone Line and requesting
that the General Plan Area be respected by the County.
Discussion was had on same by Council. Councilman Link noted
that he will be meeting with Supervisor McCorquodale on December 13,
1979, at 11:00 a.m. in regard to the County's confusion of said transi-
tion line.
Council agreed to revise the City's proposed memorandum to the
County to include what the Board of Supervisors previously approved
in regard to Transition Zones approximately 1~ years ago and that
Councilman Link and Planning Director Dorn present said memorandum
to the County at their December 17, 1979, meeting in regard to said
matter.
An announcement of the City's Annual Christmas Arts and Craft
Show was noted.

November 5, 1979 were noted.
The Minutes of the Parks and Recreation Commission Meeting of
November 27, 1979, and of the Senior Advisory Council's Meeting of
October 16, 1979, were noted.

Intra. Amend. The City Attorney presented and explained' a proposed ordinance
Park Ord. amending Chapter 18.6 of the City Code regarding the Park Ordinance. Motion
was made by Councilman Link seconded by Councilman Cunningham and carried
that the proposed ordinance be introduced and published by title and summary.

Director of Parks and Recreation Ayer presented a revised Master
Tree List for Council approval, same approved by the Parks and Recreation
Commission. Motion was made by Councilman Pate seconded by Councilman
Cunningham that the reading of Resolution No. 79-109 be waived and that
it be adopted.

for final viewing of the El Roble Park Project at 11:00 a.m. on December

Reports

The Summary of Monthly Reports of October, 1979, was noted and
disucssed.
Councilman Taylor requested that the monthly receipts of Fines
and Forfeitures (Traffic Fines) be included on future monthly reports.
Council concurred.

Disbursements The Report of Disbursements from November 1, 1979, through
November 30, 1979, was noted and discussed.
701 Plan. Study City Administrator Wood presented a report on 701 Planning Study.
Council had no objection to the recommendation and consented to a revised
area of concentration for said Study, specifically, to generally study
the General Plan area with a detailed study of the General Plan Phase II
growth area.

Force
A proposed meeting date of January 28, 1979, with the County on
Housing-Industry Task Force report was noted. Council requested that same
be scheduled for 8:00 p.m. on the suggested date.
Classification A Report on the Classification Study, Salary and Fringe Benefits
study, etc. Study was noted and a request for a Council Executive Session on same on
December 13, 1979. Council ordered same to be scheduled for 8:00 p.m.
on the requested date.

Director of Public Works-City Engineer Hansen presented and explained
a report recommending establishment of a Special Storm Drain District within
Storm Drain Zone IIAII. Discussion was had by Council on the matter.
Motion was made by Councilwoman Hughan seconded by Councilman Link
and carried that Staff be authorized to prepare the plans and specifications
for said project and advertise bids for same as recommended.
Director of Public Works-City Engineer Hansen presented and explained
a recommendation for adoption of the 1978 National Electrical Code. Motion
was made by Councilman Link seconded by Councilman Cunningham that the
reading of Resolution No. 79-110 be waived and that it be adopted approving
the 1978 National Electrical Code.

Commissioners' The Mayor noted the Report on City Commissioners' terms expir-
Terms ing January 1, 1980, for appointment at the December 17, 1979, regular
Council Meeting. He advised the .Council Members Elect of the procedure
to submit names of interested citizens to him for consideration.
Ind. Sewer Com. City Administrator Wood noted a scheduled meeting of December
6, 1919, at 3:00 p.m. for the Industrial Sewer Committee.
M.H. Task Force City Administrator Wood noted a scheduled me~ting of December
11, 1979, at 5:30 p.m. of the Morgan Hill Task Force.
Golf Course Councilman Taylor requested the Council Golf Course Advisory
Committee Committee meet with the Golf Course Board of Directors on December
10, 1979, at 9:00 a.m. and requested that the City Administrator and
Parks and Recreation Director be present at said meeting.
Adjournment At 9:06 p.m., the Mayor adjourned the meeting.
