Roll Call
The Adjourned Regular Meeting of the Gilroy City Council was called
to order by His Honor Norman B. Goodrich at 5:07 p.m.
Present: Council Members: Sharon Albert, Brian D. Cunningham, Roberta
H. Hughan, Marion T. Link, John E. Pate, Robert E. Taylor and Norman B.

Councilman Pate noted that he would be absent during discussion and
action regarding the proposed Parking District No.2 due to an interest in
same.

Land Acq.
#2 City Administrator Wood reported on the land acquisition figure
received for Parking District No. 2 noting that same was in the amount of
$127,000.00 and that the previous figure received and what the assessments
were based upon was $86,000.00. He noted that Council could adopt a
Resolution of Preliminary Determination and of Intention to Make Changes
and Modifications; increase the City's contributions or condemn the property
under Eminent Domain proceedings.
Discussion was had by Council on the matter.
Motion was made by Councilman Cunni~gham to proceed to condemn the
land and proceed with eminent domain proceedings. Motion died for lack of
a second.
Res. #80-20 Motion was made by Councilman Link seconded by Councilwoman Hughan
that the reading of Resolution No. 80-20 be waived and that it be adopted
of Preliminary Determination and of Intention to Make Changes and Modifica-
tions setting a Public Hearing date of March 3, 1980, re: said Parking
District No.2.

A RESOLUTION OF PRELIMINARY DETERMINATION AND OF INTENTION TO MAKE
CHANGES AND MODIFICATIONS - PARKING DISTRICT NO.2.
PASSED AND ADOPTED this 11th day of February, 1980, by the following vote:
AYES: COUNCIL MEMBERS: ALBERT, HUGHAN, LINK, TAYLOR and GOODRICH
NOES: COUNCIL MEMBER: CUNNINGHAM
ABSENT: COUNCIL MEMBER: PATE
Johnson Way Councilman Link presented a petition containing forty-nine (49)
signatures of local residents requesting installation of an island on the
north opening of Johnson Way as recommended by a proposal of the Director
of Public Works-City Engineer.
Discussion was had by Council on the matter.
Motion was made by Councilman Link seconded by Councilman Pate and
carreid that an island be constructed on Johnson Way as recommended and a
budget amendment be authorized if needed for said project.

Wastewater Councilman Link explained the status of Wastewater Treatment Plant
Treatment flow and recommended that a moratorium be approved for issuance of any
Plant re: building permits until after February 19, 1980, to allow Staff to obtain
Bldg. Permit figures of the meter data, specifically the Morgan Hill meter flow figures
Moratorium which appear to be in error.
Motion was made by Councilman Link seconded by Councilwoman Hughan
and carried that a moratorium be established for issuance of all building
permits until after February 19, 1980, as recommended by the Council Sewer
Advisory Committee.
Councilwoman Hughan noted that this is the fourth controversial
issue she has heard from other than City Staff.
Councilman Link requested that an Executive Session of the Council
be set following the February 19, 1980, regular Council Meeting.

Project
pirector of public Works-City Engineer Hansen presented a
report :on bids receiVed for aerators' required for the Industrial
Sewer Project recommending award of same to Peabody Wells, Inc., in
the amount of $20,128.50 noting that date of shipment is scheduled
for March 21, 1980.
Motion was made by Councilman Link seconded by Councilman Pate
and carried that the bid of Peabody Wells, Inc. in the amount of
$20,128.50 for aerators required for the Industrial Sewer Project be
awarded as recommended.
Adjournment At 5:48 p.m., motion was made by Councilman Link seconded by
Councilman Cunningham and carried that the meeting be adjourned to
Tuesday, February 19, 1980, at 8:00 p.m.
