Goodrich, Mayor. Present: Council Members: Sharon Albert, Roberta H. Hughan, Marion T. Link, John E. Pate, Robert E. Taylor and Norman B. Goodrich. Absent: Coucnil Member: Brian D. Cunningham. Library Budget Set Tuesday, September 8, 1981, as a Public Hearing date on a prezoning request of Ernest Filice, applicant, to $3 (Low- Density Multiple-Family) District on 5.65 acres located west of Thomas Road and north of Uvas Creek; Approved a budget amendment for the 1981-82 expenditures as recommended; and Set Tuesday, September 8, 1981, as a Public Hearing date to consider a Negative Declaration for a {lean Water Grant Application. The Mayor stated that it was the time and place scheduled for a Hearing on an appeal of the Housing Authority of the County of Santa Clara regarding School Impaction Fees. y';"''f-~ I ! I -- The Mayor asked if there was anyone present wishing to speak on the matter. Mr. John Burns, Executive Director of the Housing Authority, 999 W. Taylor Street, San Jose, addressed the Council further explaining the request for waiver of said impaction fees for the Senior Project on Wren Avenue and Third Street. The Mayor asked if there was anyone present in the audience wishing to speak on the matter from the School District. Mrs. Joan Harrison, representing the Special Counsel to the Unified School District, addressed the Council urging denial of the request for waiver of said school impaction fees. City Administrator Protempore Reinsch presented a letter from Mr. Darrel E. Shuck, Terra-Sol, Ltd., urging waiver of said school impaction fees for the Senior Project proposed for Wren Avenue and Third Street. Motion was made by Councilman Link seconded by Council~an Pate and carried that the Hearing be closed. Discussion was had by Council on the matter. Motion was made by Councilwoman Hughan seconded by Councilman Pate and carried by the followin0 Roll Call Vote that the request of the Housinq Authority of the County of Santa Clara be denied waiver of the school impaction fees for the Wren Avenue-Third Street Project: Ayes: Council Members: Albert, Hughan, Pate and Goodrich. Noes: Council Members: Link and Taylor. Absent: Council Member: Cunningham. A request from Joe Kerley, was noted for water service for two (2) residences outside the City Limits, Santa Teresa Boulevard (Martin Ranch). Mr. Carl Hizer, representin~ Mr. Kerley, further explained said request, and further agreed to temporary service at the requested locations. Discussion was had by Council on the matter. Motion was made by Councilwoman Hughan seconded by Councilman Pate and carried that a 60-day temporary water service for the two (2) residences of Mr. Joe Kerley, Santa Teresa Boulevard (Martin Ranch) be approved, expirinqOctober 16, 1981. """-'"", I ! I........ A petition in opposition to the proposed Airport, east of Gilroy, was noted. Council referred the petitioners to Mr. James Hunter of the Transportation Agency of Santa Clara County, noting that the City has not taken any action on the proposed airport loca- tion. A report from the County Librarian regarding their 1981-82 Budget was noted and further explained by June Hymas, Community Library Supervisor - Gilroy Granch, requesting use of City funds -- ...... Plan. Com. Report 8/6/81 Disbursements Street Tree Est. & Hi- Ranger I'- -- ........ -- Hi -Ranger Equipment 4615 allocated for Library Staff to be used for the purchase of library materials, books, etc. approximately $6,252.00. Discussion was had by Council on the matter. Motion was made by Councilwoman Albert seconded by Councilman Taylor by the following Roll Call vote that the request to use said funds for library materials be approved. Ayes: Council Members: Albert and Taylor. Noes: Council Members: Hughan, Link, Pate and Goodrich. Absent: Council Member: Cunningham. Motion failed. Motion was made by Councilman Pate seconded by Councilman Link and carried that the City accepts the return of the $6,252.00 Library Staff allocated funds and that the 1981-82 City of Gilroy budget be amended accordi ngly. Counc il man Taylor voted IIno" on the moti on. The Report of the Planning Commission Meeting of August 6, 1981, was noted. The Report of Disbursements from July 1, 1981, through and including July 31, 1981, was noted. Councilman Taylor suggested that said report indicate funds and balances of accounts or that said report be discontinued and fund and balance of each account be shown on a previously requested Quarterly Financial Report. Discussion was had on the matter. Council took no action regarding same. A Parks and Recreation Department report regarding Street Tree Estimate and Hi-Ranger was noted. Discussion was had by Council on the matter. Councilman Taylor requested a report from Staff previously requested by Council at their June 15, 1981, meetin0 in regard to tree trimming, etc. in order for Council to make a decision on the present matter. Parks and Recreation Director Ayer explained the matter noting that equipment and personnel would be at stake if the City contracted all the work out and later found that the level of service is less than what the City has maintained. He suggested that a Task Force be appointed to fully understand the ramifications of such an undertaking. City Administrator Protempore Reinsch noted that the existing budget for tree maintenance is for a fifteen (15) year program and that to prepare specifications to advertise bids for this program would be time consuming; requesting Council to have sufficient time to prepare such specifications. Councilwoman Hughan noted that the City should be prepared to award bids to private contractors if it was determined that the work could be done at a lower price than what the City could perform said work. Motion was made by Councilman Taylor seconded by Councilman Link and carried that Council previous action of June 15, 1981, be restated, specifically that Staff be instructed to prepare a cost proposal for Council on contracting tree trimming and lawn mowing vs. the City per- forming same, and contracting all municipal buildings for janitorial services at the Senior Center, Wheeler Auditorium, Police Department, etc. and Council further added that said proposal be for the present level of service as provided for in the 1981-82 Budget, and that speci- fications for said proposals be subject to Council approval prior to advertising bids for same. Motion carried unanimously. A report on the Hi-Ranger equipment of the City was noted and discussed. Monterey St. Interim Drainage Channel Historic Heritage Committee Adjournment City Administrator Protempore Reinsch presented a report on the 1981-1982 Assessed Valuations anG request to set Tax Rates for Bonded Indebtedness and Parking District No. 1 - First and Second Divisions. Motion was made by Councilman Link seconded by Councilman Taylor that the reading of Ordinance No. 81-26 be waived and that it be adopted. ORDINANCE NO. 81-26 ORDINANCE OF THE CITY OF GILROY FIXING AMOUNT OF REVENUE FROM PROPERTY TAXES NECESSARY TO PAY BONDED OR OTHER INDEBTEDNESS OF THE CITY OF GILROY OR ANY PORTION OR DISTRICT OF THE CITY OF GILROY FOR THE FISCAL YEAR 1981-1982. ORDINANCE NO. 81-27 ORDINANCE OF THE CITY OF GILROY FIXING THE AD VALOREM ASSESSMENT FOR THE CURRENT FISCAL YEAR 1981-1982 NECESSARY TO PAY BONDED INDEBTEDNESS OF THE CITY OF GILROY AND THE CITY OF GILROY PARKING DISTRICT NO. 1 - FIRST AND SECOND DIVISIONS. "",,,,",,, Director of Public Works-City Engineer Hansen presented and explained a report on costs to relocate curb on Monterey Street by the Gilroy Dispatch Office requesting Council direction on same. Discussion was had by Council on the matter. Motion was made by Councilman Taylor seconded by Councilman Link and carried that the subject curbing on South Monterey Street from Thomas Road to Tenth Street be moved back five (5) feet from its present location and that same be completed as soon as possible. Motion was made by Councilwoman Hughan seconded by Councilman Link and carried that the City would be responsible for the $12,414.0p cost of the curb realignment and that the Dispatch be thanked for agreeing to pay their recommended share of $2,880.00. A progress report for an interim drainage channel project was noted and further explained by Arnold Brunetti, representing W. J. Hanna & Son. He further noted that the orooerty owners willinq to participate in the proposed project would like a reimbursement agree- ment to be administered by the City for future use of the channel until completion of the 566 Project. The Minutes of the Historic Heritage ComMittee Meeting of August 11, 1981, were noted. 11 ....J City Administrator Protemrore Reinsch presented Council with the Tree City USA publication and a copy of the 1981-1986 Capital Improvement Program.
