The Adjourned Regular Meeting of the Gilroy City Council was called
to order by His Honor Mayor Norman B. Goodrich at 8:00 p.m.
Present: Council Members: Sharon A. Albert, Donald F. Gage, Roberta
H. Hughan, Marion T. Link, Robert E. Taylor, Pete Valdez, Jr. and Norman
B. Goodrich.
The Mayor stated that this meeting was scheduled in order to hear
the City Administrator's report of his meeting with the Gilroy Police
Association regarding the 2% at 50 - PERS Plan.
Police Officer Vierra addressed the Council and requested that this
meeting be a closed personnel session.
City Attorney noted that unless the discussion is a personnel matter,
the meeting would have to be an open meeting; that in any event, if a
closed personnel session was held, the meeting would have to be reconvened
for Council action on same.

City Administrator Wood presented and explained a report on his
meeting with the Police Association.
He recommended that the Police Association's proposed amendments
be approved subject to adding the PERS required election for said
amendment to the PERS contract; advise Police Management to attempt to
convince a majority of the sworn personnel to support their position in
this matter; and approve the Fire Department Association's request to
proceed with implementation of the 2% at 50 plan for affected fire
personnel or allow them to withdraw and proceed on the same program as
requested by the Police Association, subject to re-opening the Memoran-
dums of Understanding.
Fire Fighters Lawrence and Covington, respectively, addressed
the Council in regard to Bereavement Leave and the percentage increase
to the Fire personnel if the Police Association did not elect to imple-
ment the 2% at 50 retirement plan.
Police Officer Vierra addressed the Council noting that the in-
tent of the Memorandum of Understanding was negotiated in order to
bring Police and Fire personnel up to parity with the ten (10) surveyed
cities and requested Council approve their proposal submitted.
The City Attorney noted that the issue is whether the Council
desires to open the contract for further negotiations or remain with
the present contract.
Police Commanders Gardner and McCuiston addressed the Council
respectively and noted that they are in agreement with the 2% at 50
plan and Council should concern themselves with the best plan that would
benefit employees intending to retire from the City of Gilroy.
Personnel Director Booth explained the PERS rates for Police
and Fire personnel under the 2% at 50 retirement plan.
Police Officer Timewell addressed the Council and noted that
the Police Association gave much consideration to allowing them to re-
negotiate, and that the majority of the Association memberhsip desires
to utilize their retirement funds under a different plan than the 2%
at 50 plan.
City Administrator Wood reported that he met and conferred with
the Gilroy Police Officers' Association per Council instructions of
February 16, 1982, and that the Association had made concessions which
were brought to Council for their consideration.
Motion was made by Councilman Taylor seconded by Councilman
Gage and carried by the following Roll Call Vote that the Memorandum
of Understanding contracts not be opened for negotiations and that the
retirement plan that is in effect under present contract be followed:
Ayes: Council Members: Gage, Hughan, Link, Taylor and Goodrich. Noes:
Council Members; Albert and Valdez.
There being no further business, the Mayor adjourned the meeting
at 9:18 p.m.
