Link at 8:00 p.m. Present: Council Members: Sharon A. Albert, Donald F. Gage, Marion T. Link and Pete Valdez, Jr. Absent: Council Members: Roberta H. Hughan, Robert E. Taylor and Norman B. Goodrich. Mayor Protempore Link noted introduction of new employee, Karen Pogue, not present for introduction. Motion was made by Councilman Gage seconded by Councilman Valdez that the following items under the Consent Calendar be approved by the fOllowing Roll Call Vote: Ayes: Council Members: Albert, Gage, Valdez and Link. Absent: Council Members: Hughan, Taylor and Goodrich. Approved the Minutes of the Regular Council Meeting of September 7, 1982 ; Adopted Ordinance No. 82-21 prezoning 32.45 acres to M2 (General Industrial) District located southeast of the intersection of the South Valley Freeway and Monterey Road, Nab Hill Foods, Inc., applicant. ORDINANCE NO. 82-21 ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY PREZONING A 32.45 ACRE PARCEL ADJOINING THE CITY OF GILROY SOUTH- EAST OF THE INTERSECTION OF HIGHt~AY 101 AND MONTEREY STREET AS r12 (GENERAL INDUSTRIAL) DISTRICT. PASSED AND ADOPTED this 20th day of September, 1982, by the following vote: AYES: COUNCIL MEMBERS: ALBERT, GAGE, VALDEZ and LINK NOES: COUNCIL MEMBERS: NONE ABSENT: COUNCIL MEr1BERS: HUGHAN, TAYLOR and GOODRICH; Approved salary achievement increases for the following four (4) City Employees, effective October 1, 1982: Raymond Hansell, Police Officer, Range 32 from Step B, $2,162 to Step C, $2,270; James Lear, Jr. Civil Engineer, Range 36 from Step D, $2,500 to Steo E, $2,625; Charles Speight, Auto Equipment Mechanic, Range 30.5 from Step C, $1,821 to Step D, $1,914; and Norman Garcia, Groundskeeper II, Range 29.5 from Step D, $1,821 to Step E, $1,914; Approved the Minutes of the Adjourned Regular Council Meeting of September 8, 1982; Denied a Claim from the City of Morgan Hill; and Noted a complaint for damages of the Housing Authority of Santa Clara County in re: to School Impact Fees, being informational. 4790 Bids re: Vehicle City Administrator Wood oresented a report of bids received for one (1) new conventional chassis-cab truck from r1arx Chevrolet- Buick in the amount of $9,591.69. Motion was made by Councilman Gage seconded by Councilman Valdez and carried that the bid of Marx Chevrolet-Buick in the amount of $9,591.69 for one new conventional chassis-cab truck be awarded to include the additional $435.00 warranty ootion, as recom- mended. Bids re: \~ord Pro- cessors City Administrator Wood presented a report of bids received for word processors for the City Clerk and Department of Parks and Recreation. Motion was made by Councilman Gage seconded by Councilman Valdez and carried that the bid of A. B. Dick for Magna Writers in -- the amount of $14,498.54 be awarded and that the 1982-83 Budget be amended in the amount of $1,000.00 for inter-connector as recommended. Fence Variance- Mayor Protempore Link asked if there was anyone present in the Filice Est. audience wishing to speak on any item not on the agenda. Vi neyards Mr. John M. Filice, attorney, addressed the Council in regard to the Council approved fence variance of Filice Estate Vineyards, applicant, Mira Lama Plaza, noting that the Bureau of Reclamation must reserve the right to close the gates previously conditioned by Council that said gates remain open during business hours. Motion was made by Councilman Gage seconded by Councilman Valdez and carried that the condition requiring gates to remain open during business hours regarding the fence variance of Filice Estate Vineyards be removed with the stipulation that an additional driveway will be installed for ingress and egress for access to and from the property if said gates are closed. Intra. New Employee Mayor Protempore Link noted that Karen Pogue, Clerk-Typist I, Department of Public Works, was present and he introduced her. Add'l Dwelling, A request to add a second dwelling unit to a 7,100 sq. ft. lot 7190 Church at 7190 Church Street was noted. St. - The Mayor Protempore asked if there was anyone present in the audience wishing to speak for or against the request. Mr. Medrano, representing the applicant, addressed the Council and further explained the request. The City Attorney noted that Council could approve the below minimum square footage requirement, however, the applicant would have to apply for a variance regarding the rear yard setbacks. Motion was made by Councilman Gage seconded by Councilman Valdez and carried that an addition of a second dwelling unit at 7190 Church Street be anproved with the understanding that the appli- cant must apply for a variance regarding the rear yard setbacks. HCD Committee Motion was made by Councilman Valdez seconded by Councilman Nominations Gage and carried that action on the County's request for nominations to the Housing and Community Development Citizens' Advisory Committee be deferred to await the Mayor's recommendation on same. .....~ So. Flood Control Motion was made by Couniclman Gage seconded by Councilman Zone Advisory Valdez and carried that Councilmenber Link be reappointed as the ~ Committee City's representative to the South Flood Control Zone Advisory Com- mittee and Council Member Hughan, Planning Director Darn, and Direc- tor of Public Works Hansen be reappointed as alternates to said com- mittee. Secret Witness Program City Administrator Wood presented a request of the Gilroy Cham- ber of Commerce Secret Witness Program to reinstate $500.00 in the current budget, previously approved in the 1981-82 Budget. r1otion was made by Councilman Gage seconded by Councilman Valdez and carried that the 1982-83 Budget be amended to include $500.00 for the Gi 1 ray Chamber of Commerce Secret ~li tness Program as requested. 4791 The following informational item was noted with no separate dis- cussion on same: Letter of Appreciation from Grubb & Ellis. Monthly Reports ,... -- Fi re Hydrant Fee Council reviewed A/S 82-20 Fence Variance in a Planned Unit Develop- mente Motion was made by Councilwoman Albert seconded by Councilman Valdez and carried that the A/S 82-20 Fence Variance in a Planned Unit Development (El Dorado Plaza Merchants) be approved removing the recommended condition that the fence be painted. The Minutes of the Library and Culture Commi ssi on Meeting of August 3, 1982, were noted. The Report of the Personnel Commission Meeting of September 13, 1982, was noted. Motion was made by Councilman Gage seconded by Councilman Valdez and carried that the revised Rules and Regulations of the Gilroy Fire Department be aprpoved as recommended. City Administrator Wood presented and discussion was had on the Summary of Monthly Reports of July 1982. The progress of Well No.7 at Las Animas Technology Park ann Well No. 5's nitrate level were noted. Councilman Valdez inquired about the Tenth Street railroad tracks. City Administrator Wood reported that he has requested Staff to prepare estimates on the cost of the heavy rubber crossings to determine if same would be feasible at said location and also at the Leavesley Road Crossing as well. City Administrator Wood presented a recommendation of a $100 Fire Hydrant Stand-by Charge recommended by the Fire Chi ef. Motion was made by Councilman Gage seconded by Councilwoman Albert and carried that the $100 Fire Hydrant Standby Charge be aprpoved as recommended. El Noa Noa Club City Administrator Wood presented a report of the Police Chief re:Dance regarding the El Noa Noa Club, 7747 Monterey Street. Permit ~ .. Police Chief Cowart addressed the Council in regard to same, noting that he is working with the owners and operator in an attempt to alleviate the noise disturbance to the residents in the area; that, if necessary, the Council can revoke the dance permit. The City Attorney noted that if there is a hearing on same before the Council, the owners and residents should be notified. t.10tion was made by Councilman Gage seconded by Councilman Valdez and carried that a hearing be set for October 18, 1982, to consider the revocat i on of the dance hall permit at the El Noa Noa Cl ub, 7747 Monterey Street, Gil roy. Personnel -Dept. City Administrator Wood presented a report analyzing proposed of Pub.Wks. engineering positions for the Department of Public Works. Personnel Director Booth and Director of Public Works Hansen addressed the Council and further explained the matter. Motion was made by Councilman Gage seconded by Councilwoman Albert and not carried (3-1 vote) to approve the Personnel Commission's recom- mendation to establish the four (4) positions and Assistant City Engineer. 4792 Council Member Link voted "no" on the motion. Said matter would be agendized at the next regular meeting. Tree Planting City Administrator Wood presented a report on tree planting N.Monterey St. on the east side of North Monterey Street. Council referred same to the City Administrator to thank Mr. Al Gagliardi for his efforts. Softball Fields City Administrator I~ood presented a progress report on Gavilan College Softball Field. Parks and Recreation Director Ayer presented photos of the work in progress. Councilman Valdez noted that Dr. Rudy Melone will oresent a formal presentation to Council at some future date.~, Softball Games City Administrator Wood presented an informational renort on night softball games. I - El Noa Noa Club Councilman Gage inquired if the owners of the El Noa Noa Club would be notified of the scheduled hearing on their dance hall permit. City Administrator Wood noted that they would be notified. Management Group Councilwoman Albert inquired if the meeting between Council re: Salaries and Management Group had been scheduled. City Administrator Wood noted that same would be set at the October 4, 1982, Council Meeting and that October 11, 1982, appears to be the first date available with a Council quorum. Chri stmas Hill Park Big Bros./Big Sisters Adjournment Mr. John Locastro, resident of Yorktown Drive, addressed the Council informing Council that he is pleased with the cooperation of the Softball Leagues at Christmas Hill Park. He inquired about the lighting at said park and requested that one of the lights at the park be turned down or adjusted because it presently lights up the entire neighborhood in back of Uvas Parkway and is a nuisance. He further requested that some of the noise making events scheduled for Christmas Hill Park be scheduled at a different location occa- sionally. He further commented that the Softball Leagues have been controlled and rock music arrived. He noted that 10:00 o'clock p.m. closing at the Park should be sufficient for any event. The City Attorney noted that the closing of the Park could remain at 11:00 p.m. and loud music, etc., could be eliminated at 10:00 p.m. as a condition of the permit. ...... ........ Mr. Peter Boyd, resident of Hoxett Street, addressed the Council and confirmed the specific Christmas Hill Park event of approximately two (2) weeks ago when the loud noise from the park at 11:30 p.m. caused the windows of the residents in the area to vibrate; and was further informed by the Police Department that the event was a city function and would continue to midnight. He noted that the original permit had the 11:00 p.m. condition for closin9 and was altered at the last moment. Staff confirmed that the event was conducted by the Garlic Festival Committee. Council referred the matter to Parks and Recreation Director Ayer to determine if the closing conditions of the permits are ad- hered to and investigate the possibility of requiring the music events to end earlier than the closing condition. Parks and Recreation Director Ayer noted that he could provide Council with a list of the large group users of Christmas Hill Park utilizing the park until 11:00 p.m., noting that very rarely the Park is open beyond 11:00 p.m. He further noted that he would notify all interested parties of the time Council would be reviewing this matter. ..... ..... City Administrator Wood presented a request of Big Brothers/ Big Sister of Santa Clara County welcoming them to this City. Motion was made by Councilman Valdez seconded by Councilman Gage and carried that the Mayor issue a Proclamation welcoming Big Brothers/Big Sisters of Santa Clara County to Gilroy.
