The Regular Meeting of the Gilroy City Council was called to order
by His Honor Mayor Protempore Marion T. Link at 8:00 p.m.
Present: Council Members: Sharon A. Albert, Donald F. Gage, Marion
T. Link, Robert E. Taylor. Absent: Council Members: Roberta H. Hughan,
Pete Valdez, Jr. and Norman B. Goodrich.
Motion was made by Councilman Taylor seconded by Councilman Gage
that the following items under the Consent Calendar be approved by the
following Roll Call Vote: Ayes: Council Members: Albert, Gage, Taylor
and Link. Absent: Council Members: Huqhan, Valdez and Goodrich.
Approved the Minutes of the Re0ular Council Meeting of October 4,
1982 ;
Approved the following Salary Achievement Increases for four (4)
City Employees, effective November 1, 1982: Mike Duke, Groundskeeper II,
Range 30 from Step C, $1,777 to Step D, $1,870; Kay Abruzzini, Records
Clerk, Range 23.5 from Step C, $1,507 to Step D, $1,582; Robert Lewis,
Public Works Maintenance II, Range 29.5 from Step A, $1,575 to Step B,
$1,655; and Ray Gonzales, Wastewater Treatment Plant Operator I, Range
28 from Step B, $1,537 to Step C, $1,613;

Set November 1, 1982, as a Public Hearing date on a rezoninq
request of Woodworth Associates of California, Inc. on .85 acres
located at 8985 Monterey Street, north of Liman Avenue, from HC (High-
way Commercial) District to CM (Commercial/Industrial) District;
Set November 1, 1982, as a Public Hearing date on a Tentative
Map request of Longmeadow, applicant, for 256 residential lots and 6
common green lots on property located on the west side of Morey Avenue,
north of Mantelli Drive, 132 acres; and
Approved March of Dimes Tri-City Walkathon Permit.

Mayor Protempore Link noted that the hearing on the dance permit .J

November 1, 1982.
A request of Gilroy Unified School District was noted for declara-
tion and confirmation by resolution that the schools are impacted and
impaction fees to remain the same.
t~r. Rodney Kelley, Superintendent of Schools, addressed the
Council and further exnlained their recommendation.
Mr. Jess Stacey, representing Arcadia Develonment, addressed the
Council and recommended that Council appoint a six (6) member committee
to review the City's School Impact Ordinance with two (2) members from
the City Council, School District and the Building Industry.
Councilman Valdez entered during the school imDaction discussion
and took his seat at the Council table.
The Mayor Protempore asked if there was anyone further in the
audience wishing to speak on the matter. There was no comment from
anyone in the audience.
Discussion was had by Council on the matter.
Motion was made by Councilman Valdez seconded by Councilwoman
Albert that the reading of Resolution No. 82-117 be waived and that it
be adopted declaring the schools to be impacted as recommended.

RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY DECLARING SCHOOLS OF
THE GILROY UNIFIED SCHOOL DISTRICT TO BE IMPACTED AND DETERtlINING
FEES TO BE PAID.
PASSED AND ADOPTED this 18th day of October, 1982, by the following vote:
AYES: COUNCIL MEMBERS: ALBERT, GAGE, TAYLOR, VALDEZ and LINK
NOES: COUNCIL MEMBERS: NONE
ABSENT: COUNCIL MEMBERS: HUr,HAN and GOODRICH
A request of the Gilroy High School Principal for a two (2) hour
parking restriction on the north side of Tenth Street was noted.
Mr. George Ozuna, Assistant Principal, addressed the Council
further explaining the matter.
Discussion was had by Council on the matter.
Police Chief Cowart and Director of Public Works-City Engineer
Hansen further explained the matter.
Motion was made by Councilman Gage seconded by Councilman Val-
dez and carried that a two-hour parking limit be established for the
north side of Tenth Street during the time school is in session, noting
before and after school, Saturdays, Sundays and holidays are to be
excluded from this parking restriction.

Dr. Rudy Melone, President of Gavilan College, addressed the
Council regarding a Gavilan Softball/Soccer Field Complex further ex-
plaining same and requesting City participation in the creation of said
complex.
Council referred the matter to the Parks and Recreation Commission

for a recommendation on same, noting that the Little League Program should
not be included in any Gavilan College Complex since the location of the
complex would be too far out of the City for participants of this age group.
The Mayor Protempore asked if there was anyone present in the audi-
ence wishing to speak on any matter not on the agenda. There was no
comment from anyone in the audience.
A request of Operation Sentinel for support and endorsement of
Operation Sentinel IS Gilroy Office to become certified by the U. S. Depart-
ment of Housing and Urban Development (HUD) was noted.
Motion was made by Councilwoman Albert seconded by Councilman Gage
and carried that the City support and endorse Operation Sentinel's Gilroy
Office being certified by the U. S. Department of Housing and Urban Develop-
ment (HUD) as requested.
A letter from the City of Roseville opposing a railroad merger was
noted and further expl ained by City Administrator Protempore Reinsch.
Motion was made by Councilman Taylor seconded by Councilman Gage
and carried that the matter be tabled to invite Southern Pacific Trans-
portation representatives to address the City Council with additional
information on the matter.
An informational letter from the State of California Assembly was
noted requesting the General Public to observe Handicapoed Parking desig-
nations.
Mayor Protempore Link noted that the Mayor had issued a proclama-
tion on a request for declaration of Safe Schools Week.
The following informational items were noted with no separate dis-
cussion on same:
County of Santa Clara Library in regard to funding;
Airport Land Use Commission in regard to re-organization;
Ms. Susie Adams opposing expansion of Planned Parenthood in South
County; and
Cal-Trans regarding Freeway Maintenance Agreement.
Plan. Com. Report The Report of the Planning Commission Meeting of October 7, 1982,
10/7/82 was noted.

Co. Use Permit
Discussion was had regarding a County referral regarding a T.V.
Transmitting Tower, further explained by Planning Director Darn.
Mr. Bob Saks, representing the Blair Broadcasting Company, Channel
8, and T.V. Station in San Luis Obispo, addressed the Council further ex-
plaining same.
Mr. Brian O'Halloran, representing Ruth and Going, presented a
slide presentation showing visual impact of said proposed tower.
Motion was made by Councilman Taylor seconded by Councilman Gage
and carried that the City had no objection to the proposed TV Transmitting
Tower.
Planning Director Darn presented and explained a recommendation of
the Planning Commission on acceptable conditions for a County issued use
permit which may be assumed by the City of Gilroy upon annexation of a
parcel at 375 Ronan Avenue.
Motion was made by Councilman Gage seconded by Councilman Taylor
that the Ctiy accepts the conditions as recommended and approved by
the Planning Commission for the issuance of said County use permit.
Lib. & Cult. Com. The Minutes of the Library and Culture Commission Meeting of Sep-
9/7/82 tember 9, 1982, were noted.

The Financial Quarterly Report ending September 30, 1982, was
noted and further explained by City Administrator Protemoore Reinsch.
A request for Council direction on allocation of HCD Funds was
noted. Mayor Protempore Link recommended that Council consider a com-
mittment of HCD Funds for the next two (2) years providing that said
funds are available.
Motion was made by Councilman Gage seconded by Councilman Taylor
and carried that Council concurs with a November 1, 1982, Public
Hearing required for consideration of the allocation of HCD Funds.

A Report on Medevac's user rates was noted and discussed. Coun-
cil tabled action on same to the next regular Council Meeting and
requested Staff contact the County of Santa Clara and determine results
if the City did not aDprove the new user rates because the City is
violently opposed to sa~e. It was also requested that Staff obtain
information from Stephens & Poletti Ambulance Service for costs to com-
pare same with the County's proposed rates.
Motion was made by Councilman Taylor seconded by Councilman
Gage that the reading of Resolution No. 82-118 be waived and that it
be adopted authorizing a grant application to rehbilitate the Southern
Pacific Depot.

RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY SUPPORTING THE RESTORA-
TION OF PASSENGER TRAIN SERVICE TO GILROY.

A report on a temporary permit for two (2) food sale vehicles
was noted and further explained that no complaints have been received
regarding said business operation.
Mr. Philip Vargo, attorney representing the owner of said busi-
nesses, addressed the Council commenting on the operation of same.
Motion was made by Councilman Gage seconded by Councilman Valdez
and carried that a 30 day extension be approved for said food sales
vehicles to include the same conditions applied to the original permit.
Discussion was had in re9ard to review of the Nab Hill Family
Park proposal scheduled for November 1, 1982. Motion was made by
Councilwoman Albert seconded by Councilman Valdez and carried that the
County Planning Commission be requested to postpone action on the Nob
Hill Family Park proposal until after November 1, 1982, when the City
Council is expected to review same.
Sewer Treatment Councilman Link reported that he recently met with members of the
Plant Bay Area Air Pollution Control Board regarding the Sewer Treatment
Plant and that since January 1, 1981, through October 4, 1982, they had
received no verified violations regarding odor from the Sewer Treatment
Plant and had no reason to issue citations to the City of Gilroy. He
further noted that they had received twenty-six (26) calls from four
(4) persons but that said complaints could not be verified.

Councilman Taylor reported that a hearing before the County Plan-
ning Commission had been scheduled for October 21, 1982, at 9:30 a.m.
regarding recommendations from the San Martin Planning Committee of
which he is a member and noted that he is expecting the County Planning
Commission to not approve the recommendations of the San Martin Planning
Committee; that the San Martin Planning Committee is having another
meeting on same October 19, 1982, in San Martin prior to the hearing
before the County and that he will inform the City of any action taken
as to the future plans of San Martin.

:Councilman Gage thanked Staff for placement of the coat racks in
the Council Chambers.
Mayor Protempore reminded Council of the City Council/Planning Com-
mission Study Session October 25, 1982, at 8:00 p.m. in the Council Chambers
regarding Urban Service Area requests.
At 9:27 p.m., Mayor Protempore Link adjourned the meeting.
