The Regular Meeting of the ~ilroy City Council was called to order
by Her Honor Mayor Roberta H. Huqhan at 8:09 !).m.
Present: Council Members: Sharon A. Albert, Donald F. Gage, Paul V.
Kloecker, Larry Mussallem, Pete Valdez, Jr. and Roberta H. Hughan.
Motion was made by Councilman Gage seconded by Councilman Valdez
that the following items under the Consent Calendar be approved by the
followin9 Roll Call Vote: Ayes: Council Members: Albert, Gage, Kloecker,
Mussallem, Valdez and Hughan;
Approved a request of the Girl Scouts o~ Santa Clara County for
waiver of the City License for their annual cookie sale;
Approved the recommendation for acceptance and noti ce of completion
for the Waldon Pond Levee Reconstruction Project; and
Approved a Change Order for Accelerated Completion of the Municipal
Wastewater Ponds Expansion Project 1983-4, Phase II.
City Administrator Saksa nresented a recommendation for award of
the bid of El Camino Crop Supply' in the allount of $9,976.39 for 15 tons
of fertilizer.
Motion was made by Councilman Gage seconded by Councilman Mussallem
ahd carried that the bid of El Camino Crop Supply in the amount of $9,976.39
be awarded for 15 tons of fertilizer as recommended.
City Administrator Baksa presented a recommendation requesting
authorization to purchase one (1) 1983 CHP Dodge Diplomat police vehicle
through Cooperative Purchasing, State,of California, in the amount of
$8,555.59. '
Motion was made by Councilwoman Albert seconded by Councilman Gage
and carried that authorization be given to purchase one (1) 1983 CHP Dodge
Diplomat vehicle for the Po1ice Departnent through Cooperative Purchasinq,
State of California, in the amount of $8,555.59 as t'ecor!lmended.

The Mayor stated that it was the time and place scheduled for a
Public Hearing to consider a Tentative Map request of T0ny Lerma, appli-
cant, for a residential subdivision of 35 lots located 1,200 feet north of
Mantelli Drive, west of Santa Teresa Boulevard.
Planning Director Darn presented and explained the Staff Report
noting inclusion of Public Safety Fee requirements in condition No.2.
The Mayor asked if there was anyone present in the audience wishing
to soeak on the matter.
Mr. Arnold Brunetti, representing the applicant, addressed the
Council noting the applicant's presence and that they would answer questions
regarding the proposal.
The Mayor asked if there was anyone present in the audience wishing
to speak in opposition to the matter. There was no comment from anyone
in the audience.
Motion was made by Councilman Gage seconded by Councilman Valdez
and carried that the Public Hearing be closed.

Discussion was had by Council on the matter.
Motion was made by Councilman Gaqe seconded by Councilwoman
Albert that the readirig of Resolution No. 83-79 be waived and that
it be adopted, to include requirement of Public Safety Fees in Con-
diti on No.2.

The Mayor stated that it was the time and place scheduled for
a Public Hearing on the City's Tenth Year (1984-85) Community Develop-
ment Block Grant Application.
HCD Grant Coordinator Ford presented and explained the Staff
Report.
The Mayor asked if there was anyone present in the audience
wishing to speak on the matter.
There was no comment from anyone in the audience.
Motion was made by Councilman Mussallem seconded by Councilman
Gage and carried that the Public Hearing be continued to December 5,
1983.
City Administrator Baksa noted receipt of a petition from
residents on Victoria Drive and Staff recommendations regardinq a
Walk-through at Victoria Drive.

Motion was made by Councilman Gage seconded by Councilwoman Al-
bert and carried that the matter be aqendized for a hearinq at the
December 5, 1983, reqular Council Meeting in order to receive input
from residents in the area followinn notification of said hearing.
The Mayor asked if there was anyone present in the audience
wishing to speak on the matter at this meetinq. There was no comment
from anyone in the audience.

noting arrangements have been made to use the Community Center for said
occasion instead of the Council Chambers.

The Minutes of the Parks and Recreation Commission Meeting of
November 15, 1983, were noted.
The Minutes of the Senior Citizens' Advisory Council Meeting of
October 15, 1983, 2343 noted.
The Minutes of the Library and Culture Commission Meeting of October
11, 1933, were noted.
The Mayor stated that this was the time and place scheduled for
Council appointment to fill her Councilmember unexpired term (11-85) and
noted that this appointment is open to the public for nominees in addition
to names recommended by Council Members. She invited the public to submit
names and speak on the; r behalf.
Charles Larson, Jr., 790 Carla Way, addressed the Council seeking
apoointment as Councilman to fill this unexpired term.
John E. Pate, addressed the Council notinq acceptance of the nomina-
tion for the Coundlmember unexp'ired term.
Discussion was had by Council on the matter. The Mayor recommended
the nomination of ,lohn E. Pate Tor the unexpired Councilmember term.
Motion was made by Councilman Gaqe seconded by Councilman Valdez
and carried that John E. Pate be appointed to fill the unexpired Council-
meP1ber term :(11-85).
The City Clerk swore in Councilman Pate and issued a Certificate
of Appoi ntment.
Council set December 12, 1983, at 7:30 p.m. for a Council Study
Session re: proposed Residential Development Ordinance amendments and
recommended Public Safety Impact Fees. It was noted that the first order
of business would be the proposed Residential Development Ordinance Amend-
ments taking approximately one (1) hour and the second order of business
at approximately 8:30 p.m., Public Safety Impact Fees.
The City/School Liaison Advisory Committee Meeting of November 22,
1983, 3:30 p.m. was noted to be held in the Council Chambers.
The Mayor recommended the following Council Advisory Committee and
Representative appointments:

Motion was made by Councilman Gage seconded by Councilman Kloecker
and carried approving the appointments recommended by Mayor Hughan.
Motion was made by Councilman Valdez seconded by Councilman Gage and
carried that Councilman Pate be appointed as Chairman of the City Golf Course
Committee and Alternate representative to the Santa Clara Valley Water Dis-
trict South Zone Advisory Committee.

The Mayor noted Commission vacancies January'l, 1984, and in-
vited members of the public to submit~resumes and presentations if
desired at the December 5,.1983, regular Council M~eting; requesting
resumes by noon on November 30, 1983, for inclusion in the Council
Agenda packet. It'was noted that the appointments for expired terms
on various Commissions would be made at the December 19, 1983, reqular
Council Meeting.
Councilman Pate thanked the Council for their vote of confidence.
Discussion was had regardinq the ICCjIGC Annual Christmas Din-
ner Dance scheduled for December 15, 1981. '
City Administrator Baksa reported on the State Reqional Water
Quality Control Board Hearing of November 18, 1983. He noted that re-
sult was that Morgan Hill does not have a ban on their sewer connections;
that the voluntary ban was incorporated the Cease and Desist Order and
was not only incorporated in the points of th~ law suit-but also several
points that the State is requirinq the City to do. He noted that all
of these are scheduled to be completed by Seotember 1, 1984; thus con-
tinuing the ban until at least September 1, 1984. He ~urther noted
that September 1, 1984, is the deadline for the City to report to the
State, however, they do not meet until about mid-September. He further
noted that the civil penalties were referred to the Attorney General
for his consideration.
At 9:14 p.m., motion was made by Councilman Gage seconded by Coun-
cilman Valdez and carrierl that the meeting be adjourned.
