Minutes 1984/02/27 4984 Appeal Hear. Offi cer G. Braze February 27, 1984 Gilroy, Californiq Present: Co'uncil Members:' Sharon A. Albert, Donald F. Gage, Paul V. Kloecker, John E. Pate~ Pete Valdez, Jr. and Roberta H. Hughan. Absent: Council Member: Larry Mussallem. re: At 7:01 p.m., Mayor Hughan noted the purpose of the Special Meeting was to he~r the appeal to a decision of the City Administrator and the matter of Officer'Braze and hiS discip'iinary action. She noted that each side would be allowed fifteen minutes t6 present their point of view and then, there would be a brief time for direct questions by Adjournment .. 4985 member.s of the City Council. She further noted that, at that time, the meeting would be adjourned to a Closed Session regarding personnel and the City Council decision would be announced at the next regular meeting of the City Council on March 5, 1984, to allow time to prepare written findings necessary in an appeal such as this. She further noted that this is not a re-hearing on the matter; that the matter has been before the Personnel Commission and the, City Administrator and a decision has been made; Coun- cil is now acting in the role of an Appeals Board. Mayor Huqhan asked the City to present its case. Police Chief Cowart addressed the Council and presented the City's side of the case. At 7:13 p.m., Councilman Mussallem entered and took his seat at the Council table. Police Chief Cowart continued his presentation. Mr. Russell V. Rossler, Attorney for Officer Braze, 111 West St. John St., San Jose, addressed the Council and presented the appellant's case. Council asked the Police Chief direct questions. Mr. Rossler, accompanied by Officer Braze, addressed the Council and Council asked direct questions of Officer Braze. At 7:33 p.m., the Mayor adjourned the meeting to a Closed Session noting that the results of the Council's deliberations would be announced at the March 5, 1984, regular Council Meeting.
