None None '" The Mayor stated that it was the time and place scheduled for a Public Hearing to Consider Reorganization of Uninhabited Territory Designated "Sunrise Drive Reorganization 86-3", located west of Santa Teresa Boulevard, containing 53.053 acres, David Tang, et aI/City of Gilroy, applicants, not 100% consent. Planning Director Dorn presented and explained the Staff report. The Mayor asked if there was anyone in the audience wishing to speak for or against the proposal. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. Motion was made by Councilman Gage seconded by Councilman Palmerlee that the reading of Resolution No. 87 - 61 be waived and that it be adopted approving said Reorganization of Territory. RESOLUTION NO. 87 - 61 A RESOLUTION AFTER PUBLIC HEARING, OF THE CITY OF GILROY WITH REGARD TO A REORGANIZATION DESIGNATED AS "SUNRISE DRIVE REORGANIZATION 86-3". PASSED AND ADOPTED this 17th day of August, 1987, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: COUNCILMEMBERS: COUNCILMEMBERS: ALBERT, GAGE, KLOECKER, MUSSALLEM, PALMERLEE, VALDEZ and HUGHAN. None None The Mayor stated that it was the time and place scheduled to consider a prezoning request to Rl (Single Family Residential) District for property located between Mesa Road and Santa Teresa Boulevard, east of the existing Mesa Ranch Subdivision, Albert Fortino, applicant. Planning Director Dorn presented and explained the Staff Report. 5548 Fire MOU's Mort.Credit Cert. Prog. Res.87-62 Housing Asst. Plan City Funds The Mayor asked if there was anyone in the audience wishing to speak for or against the proposal. Mr. Gene Wells, representing the applicant, addressed the Council noting his presence to answer questions if any regarding the proposed rezoning. The Mayor asked if there was anyone further in the audience wishing to speak on the matter. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. Motion was made by Councilman Gage seconded by Councilman Valdez that the proposed ordinance be introduced and published by title and summary approving the prezoning request. J The Mayor noted that it has been recommended to table action on the 1987-1989 M.O.U.'s for the Fire Unit, to be reagendized at the September 8, 1987 regular Council Meeting. A recommendation to participate in the Mortgage Credit Certificate Program 1987, was noted and further explained by HCD Grant Coordinator Ford. He further noted that an additional cooperative agreement would be required at a future date for administration of the City's funds under the Mortgage Credit Certificate Program. A letter from the San Jose Real Estate Board endorsing the Mortgage Credit Certificate Program was noted. Mr. Larry Connell, representing the San Jose Real Estate Board, addressed the Council further explaining the program. Motion was made by Councilman Gage seconded by Councilwoman Albert and carried that the Cooperative Agreement for the Mort- gage Credit Certificate Program 1987 be approved as presented. Motion was made by Councilman Gage seconded by Councilwoman Albert that the reading of Resolution No. 87 - 62 be waived and that it be adopted authorizing filing of the application for allocation of Mortgage Credit Certificate Issuance Authority. ~ ....i RESOLUTION NO. 87 - 62 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY RELATING TO APPLICATION FOR ALLOCATION OF MORTGAGE CREDIT CERTIFICATE ISSUANCE AUTHORITY. PASSED AND ADOPTED this 17th day of August, 1987, by the following vote: AYES: COUNCILMEMBERS: AN NOES: ABSENT: ALBERT, GAGE, KLOECKER, MUSSALLEM, PALMERLEE, VALDEZ and HUGHAN. A request of Growth and Opportunity, Inc. and Emergency Housing Consortium was noted for funds for their program for Homeless Children in Santa Clara County. ,., ! ...... Local resident recommending prohibiting sale of fireworks in the City of Gilroy. Council requested that the Fire Chief prepare a report regarding same for Council presentation at a future meeting. State Department of Transportation's study of alternative sites for the location of an equipment maintenance facility for the Peninsula Commute Service Passenger Rail Operation. Planning Director Dorn noted that he will be meeting with Cal Trans re- garding same August 18, 1987 at 10:30 a.m. Councilman Mussallem noted that he will be present at said meeting to note the Council's wishes for said facility to be located in Gilroy. Councilman Kloecker requested a copy of Cal Trans' Economic Benefit Study. The Report of the Planning Commission Meeting of August 6, 1987 was noted. Planning Director Dorn presented and explained the recom- mendation to approve four (4) actions recommended by Staff re: Open Space Preservation: A Program for Santa Clara County. Motion was made by Councilwoman Albert seconded by Council- man Palmerlee and carried that the four actions recommended by Staff re: Open Space Preservation be approved. The Mayor appointed Councilwoman Albert as representative from Gilroy to serve on the Implementation Committee as recom- mended in the Program. The Report of the Personnel Commision Meeting of August 10, 1987 was noted. The City Attorney gave an update on the rent control status noting that the owners of Pacific Mobile Estates had obtained a court order to prohibit arbitration procedure, noting that the owners of the Mobile Home Park had agreed not to impose the $25.00 rent increase until after the case is tried. He further recommended that the City review the ordinance and amend same if necessary in order that the ordinance will be updated and in effect when the case is closed. Mr. Charles Gilmore, 500 W. 10th St., Space #159, addressed the Council noting that the tenants had not received anything from the owners that they will not impose the $25.00 rent increase until the suit is settled. The City Attorney noted that he was informed of this through the owner's attorney. The Mayor noted that Louis Palacios, had received the Employee of the Year Award at the annual City Barbecue. The Mayor noted that she would be on vacation from August 23 through September 3, 1987. The Mayor noted the Wastewater Treatment Plant Facilities Law Suit, scheduled for September 22, 1987. 5550 League Conf. Adjrnmt. '" Councilman Kloecker noted that he was reappointed Chairman of, the Planning and Program Committee of the Transportation Co~ission, County of Santa Clara. Councilman Valdez noted that the opening ceremonies of the Hispanic Cultural Festival have been scheduled for September 4, 1987 at the Sycamore Stage in Christmas Hill Park and invited Councilmembers to attend. Councilman Palmer lee noted that the Downtown Interim Board is proceeding with adopting by-laws and will be incorporating as a non-profit group in order to be prepared for future funding that may be forthcoming. The Mayor noted the League of California Cities Annual Conference, October 4-7, 1987 in San Francisco. At 8:59 p.m. the Mayor adjourned the meeting to Tuesday, September 8, 1987 at 8:00 p.m., due to September 7, 1987 being a legal holiday. Respectfully submitted,
