Consent Calendar Minutes Ord.88-1 Ord.88-2 Regular Meeting January 4, 1988 Gilroy, California The Mayor led the Pledge of Allegiance to the Flag. The City Clerk reported that the Agenda had been posted on December 31, 1987 at 9:25 a.m. Present: Councilmembers: Donald F. Gage, Paul V. Kloecker, Larry Mussallem, Pete Valdez, Jr. and Roberta Hughan - 8:06 p.m.; Absent: Councilmembers: Leonard A. Hale and Daniel D. Palmerlee: The Mayor noted New Employee, Carol Ponzini, Police Records Clerk not present for introduction. The Mayor noted Certficates of Service to the following Retired Commissioners and Board Member not present: Andree Schoutens, Parks & Recreation Commissioner, Lupe Sanchez, Plan- ning Commissioner and Gordon Farotte, Building Board of Appeals. Motion was made by Councilman Gage seconded by Councilman Kloecker that the following items under the Consent Calendar be approved by the following Roll Call Vote: Ayes: Councilmembers: Gage, Kloecker, Mussallem, Valdez and Hughan. Approved the Minutes of the Regular Council Meeting of December 21, 1987; Adopted Ordinance No. 88-1 Enacting as Chapter 3A of the Gilroy City Code an Alarm System Registration Ordinance; ORDINANCE NO. 88 - 1 ORDINANCE OF THE COUNCIL OF THE CITY OF GILROY ENACTING AS CHAPTER 3A OF THE GILROY CITY CODE AN ALARM SYSTEM REGISTRATION ORDINANCE. PASSED AND ADOPTED this 4th day of January, 1988, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: GAGE, KLOECKER, MUSSALLEM, HUGHAN. Approved request of American Cancer Society to solicit Funds in the City of Gilroy for the Calendar Year 1988. Denied a Damage Claim of Robert A. Lang as recommended; Denied a Claim of Del Monte Developers, Ed Sanchez, South- side Industrial Park (Obata) as recomended. (At 8:05 p.m. Councilmen Hale entered and took his seat at the Council table.) The Mayor stated that it was the time and place scheduled for a Public Hearing to Consider Annual Destruction or Removal of Weeds and/or Refuse Constituting a Public Nuisance Arising out of Weeds Growing Upon Lots or in Front of Properties in the City. The Mayor asked if there was anyone present in the audience wishing to speak on the matter. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. Motion was made by Councilman Kloecker seconded by Councilman Gage that the reading of Resolution No. 88-1 be waived and that it be adopted instructing the Fire Chief to Abate the Nuisance Arising Out of Weeds Growing Upon Lots or in Front of Properties in the City. RESOLUTION NO. 88-1 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY INSTRUCTING THE CHIEF OF THE FIRE DEPARTMENT TO ABATE NUISANCE ARISING OUT OF WEEDS GROWING UPON LOTS OR IN FRONT OF PROPERTY IN THE CITY OF GILROY AS REQUIRED BY SECTION 5 OF ORDINANCE NO. 754. PASSED AND ADOPTED this 4th day of January, 1988, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: GAGE, HALE, KLOECKER, MUSSALLEM, VALDEZ AND HUGHAN NONE PALMERLEE COUNCILMEMBERS: COUNCILMEMBER: City Administrator Baksa presented a recommendation for Closure of the Sewer Treatment Plant EPA 1978 Grant further explaining same. Motion was made by Councilman Gage seconded by Councilman Mussallem and carried that a proposed ordinance pe introduced amending the sewer use ordinance as recommended to comply with State Water Resources Control Board's requirements for Clean Water Grant release to be published by title and summary. Motion was made by Councilman Gage seconded by Councilman Mussallem that the reading of Resolution No. 88-2 be wavied and that it be adopted regarding Sewer Rate Ratios as recommended. RESOLUTION NO. 88-2 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ESTABLISHING RATIOS FOR FUTURE SANITARY SEWER SERVICE RATE CALCULATIONS. City Administrator Baska recommended Council schedule a Workshop for Capital Improvement Program, Comprehensive Fee Schedule Revisions and Revenue Projections. Council set January 25, 1988 at 7:00 p.m. in the Employees' Lounge for a Study Session of the Council to review Revenue Projections, Comprehensive Fee Schedule and Capital Improvement Program. ... City Administrator Baksa noted that there would be a Luncheon on January 13, 1988 at the Old City Hall Restaurant, 12:00 noon for retiring Police Chief Cowart and requested that RSVP's be directed to Commander Gardner. .... City Administrator Baksa distributed an update of Summary of Transfers, Distributions and Methodology - 1987-88 Budget. City Administrator Baksa reported that an eight week Supervisory Training has been scheduled. A newspaper article from the S.F. Chronicle was distributed in regard to quality of life study in 98 Bay Area cities, ranking the City of Gilroy as 12th. Councilman Kloecker requested adoption of a resolution supporting further improvements to Highway 152 as top priority for funds in Santa Clara County to be presented to a Transportation Commission meeting January 6, 1988 at Gilroy Foods. Motion was made by Councilman Kloecker seconded by Council- man Mussallem and carried that Council vote upon this matter at this meeting due to the urgency. .... Motion was made by Councilman Kloecker seconded by Council- man Mussallem and carried that the reading of Resolution No. 88-3 ~ be waived and that it be adopted endorsing further improvements to Highway 152 as top priority for funds in Santa Clara County. RESOLUTION NO. 88-3 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY ENDORSING FURTHER IMPROVEMENTS TO HIGHWAY 152 AS TOP PRIORITY FOR FUNDS IN SANTA CLARA COUNTY. City Administrator Baksa gave an update on same. The Mayor noted the Reception for Soviet Union Visitors on January 8, 1988 - 5 p.m. to 7 p.m. at the Old City Hall Restaurant. The Mayor noted the Police Department ribbon cutting ceremonies scheduled for January 15, 1988 at 11:00 a.m. The Mayor noted the Police Department Open House scheduled for Saturday, January 23, 1988 from 1 p.m. to 4 p.m. The Mayor noted the Council Retreat scheduled for January 30 and 31, 1988 in Carmel to begin at 8:00 or 8:30 a.m. At 8:21 p.m. the Mayor adjourned the meeting to Tuesday, January 19, 1988 due to the Legal Holiday January 18 (Martin Luther King Day).
