Minutes 1989/09/18 Invocation Posting Agenda Roll Call Cert. of Service Consent Calendar Minutes Budget Impts.- Heinsen Measure A Sewer Data SB1422 Sprinklers Res./Hillside 578S Regular Meeting September 13, 1989 Gilroy, California Mayor Protempore Mussallem led the Pledge of Allegiance to the Flag. The Mayor Protempore called on Pastor Richard Smith, Seventh Day Adventist Church to give the Invocation. The City Clerk reported that the Agenda had been posted on September 14, 1989 at 4:25 p.m. Present: Councilmembers: Donald F. Gage, Leonard A. Hale, Paul V. Kloecker, Daniel D. Palmer lee , Pete Valdez, Jr. and Larry Mussallem; Absent: Councilmember: Roberta H. Hughan. The Mayor Protempore presented Rudolfo F. Nunez, member of the Advisory Council of the Council on Aging (4-18-88/7-1-89) with a Certificate of Service. It was noted that an Up With People representative would be present later this meeting. Motion was made by Councilman Gage, seconded by Councilman Kloecker that the following items under the Consent Calendar be approved by the following Roll Call Vote: Ayes: Councilmembers: Gage, Hale, Kloecker, Palmerlee, Valdez and Mussallem; Absent: Councilmember: Hughan: Approved the Minutes of the Regular Council Meeting of September 5, 1989; Approved Budget Amendments and Transfers as recommended; and Accepted Improvements for Heinzen, 305 Mayock as recommended. Mr. Jim Pierson, Deputy Director for Project Management, Santa Clara County Traffic Authority, gave an update of the Strategic Plan for Measure "A" Program. Up With People representative invited Council to the 100th Anniversary of McCormick Spice, Inc. and 30th Anniversary of Gilroy Foods, Inc. to their celebration September 23, 1989 from 4:00 p.m. to 6:80 p.m. and 8:00 p.m. barbecue at Coyote Ranch. City Administrator Baksa presented and explained the 1989 Sewer Flow Data recommending the balance of 9,950 gpd be allocated for 20 units of residential fill-in and 3,550 gpd for local business expansion. Mr. Frank Arrendondo, 4410 Hecker Pass Highway, addressed the Council explaining his dilemma in applying immediately for the 20 unit fill-in category. , Motion was made by Councilman Gage seconded by Councilman Valdez and carried that Staff recommendation on sewer allocation be approved as submitted. Noted a request of Sharon. Albert for support of SB 1422, Open Space Programs. Motion was made by Councilman Valdez seconded by Councilman Palmerlee and carried that the Council supports SB 1422 and that a letter be forwarded regarding their action. A recommendation to amend the Uniform Fire and Building Codes regarding installation of sprinklers in Residential Hillside designations was noted and further explained by Public Safety Director Gillespie and Tom Campbell, Fire Chief and Director of Building of the City of Salinas. 5786 Recess Traffic Study Pers.Com. The following addressed the Council in opposition to the requirement of sprinkler installation in Residential Hillside Developments: John Hughan, Architect, Robert Livengood, Executive Director of the Building Industry Association - Southern Division; David Sanchez, Country Estates Venture; and Micky Clark, Pyramid Homes representative. Discussion was had by Council on the matter. Council set a Study Session at 6:00 p.m. on October 2, 1989 to further discuss the proposed requirement of the installation of sprinklers in Residential Hillside designations, prior to the October 2, 1989 - 8:00 p.m. regular meeting. At 10'34 p.m. the Mayor Protempor~ declared a recess and reconvened the meeting at 10:40 p.m. City ~ngineer Allen presented and explained a Santa Teresa Traffic Signal Study. Council agreed that the matter should be further studied in six months. Mr. Richard Perino, 9115 Crest Hill Drive, addressed the Council requesting an additional traffic study for the inter- section of Welburn Avenue and Santa Teresa Boulevard within six months. Council agreed that an additional study would be forthcoming to determine warrants for a traffic signal at this location. The Mayor Protempore asked if there was anyone in the audience wishing to speak on any matter not on the agenda. There was no comment from anyone in the audience. A letter from Tony Lerma, Personnel Commissioner, resigning from the Personnel Commission was noted. Motion was made by Councilman Valdez seconded by Councilman Kloecker and carried that Commissioner Lerma's resignation be accepted with regret. It was noted that a replacement be scheduled for the regular appointments OL commissioners in December, 1989. The Report of the Planning Commission Meeting of September 7, 1989 was noted. The Minutes of the Parks and Recreation Commission Meeting of August 15, 1989 and June 20, 1989 were noted. (There was no meeting in July 1989). The Minutes of the Senior Advisory Board Meeting of July 17, 1989 were noted. The Minutes of the Library & Culture Commission Meeting of July 11, 1989 and Study Session were noted. The Minutes of th~ Gilroy Golf Course Advisory Board Meeting of July 18, 1989 were noted. City Administrator Baksa noted the letter to be forwarded to property owners regarding unreinforced masonry. Council concurred with same. City Administrator Baksa presented the Multi-Hazard Functional Planning Guidance Plan - 1990. Motion was made by Councilman Valdez seconded by Councilman Hale that the reading of Resolution No. 89-47 be waived and that it be adopted, approving the Plan as presented. Councilmembers Gage and Hale requested copies. Councilman Valdez requested that a copy be available at City Hall for public inspection. RESOLUTION NO. 89 - 47 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING THE MULTlHAZARD FUNCTIONAL PLANNING GUIDANCE. PASSED AND ADOPTED this 18th day of September, 1989, by the following vote: AYES: COUNCILMEMBERS: 1990 NOES: ABSENT: GAGE, HALE, KLOECKER, PALMERLEE, VALDEZ and MUSSALEM None HUGHAN. COUNCILMEMBERS: COUNCILMEMBER: Councilman Gage recommended that a letter be forwarded the City of Morgan Hill requesting information on their proposed sewer alternatives for presentation to the Joint Powers Sewer Advisory Committee. Councilman Hale noted that he would be attending a Redevelopment Seminar in San Diego on September 21, 1989. The Mayor Pro tempore requested that a Closed Session of the Council be scheduled to follow the October 2, 1989 regular meeting regarding discussion of the City Administrator and City Attorney's compensation.
