Minutes 1989/12/04 Invocation Posting Agenda Roll Call Res.etc. F. Castro Regular Meeting December 4, 1989 Gilroy, California Mayor Protempore Kloecker led the Pledge of Allegiance to the Flag at 8:01 p.m. Dr. Joe Caldwell, First Baptist Church gave the Invocation. The City Clerk reported that the Agenda had been posted on November 30, 1989 at 12:29 p.m. Present: Councilmembers: Donald F. Gage, Leonard A. Hale, Paul V. Kloecker, Larry Mussallem, Sara C. Nelson, and Pete Valdez, Jr. Absent: Councilmember: Roberta H. Hughan. Mayor Protempore Kloecker presented Francisco Castro, Public Works Maintenance II, retired, with a Resolution, Certificate of Service and Gift. Motion was made by Councilman Gage, seconded by Councilman Kloecker that the following items under the Consent Calendar be approved by the following Roll Call Vote: Ayes: Councilmembers: Gage, Hale, Kloecker, Mussallem, Nelson, Valdez and Hughan; Approved the Minutes of the Regular Council Meeting of November 20, 1989; Adopted Ordinance No. 89-20 Setting Forth a Seismic Hazard Identification Program for Unrein forced Masonry Buildings. ORDINANCE NO. 89 - 20 ORDINANCE OF THE COUNCIL OF THE CITY OF GILROY SETTING FORTH A SEISMIC HAZARD IDENTIFICATION PROGRAM FOR UNREINFORCED MASONRY BUILDINGS. RESOLUTION NO. 89 - 63 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY HONORING JUNE CADILE, SECRETARY - PUBLIC WORKS DEPARTMENT, UPON HER RETIREMENT. PASSED AND ADOPTED this 4th day of December, 1989, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: COUNCILMEMBERS: COUNCILMEMBERS: GAGE, HALE, KLOECKER, MUSSALLEM, NELSON, VALDEZ and HUGHAN None None City Administrator Baksa presented and explained a report and recommendation on bids received for the electric gate at the Police Department recommending awarding same to Bay Valley Fence in the amount of $9,935.00. Motion was made by Councilman Gage seconded by Councilman Kloecker and carried that the bid of Bay Valley Fence in the amount of $9,935.00 be awarded as recommended. City Administrator Baksa presented and explained a report and recommendation on bids received for a turf tractor recommending awarding same to C & N Tractors in the amount of $10,505.62. Motion was made by Councilman Mussallem seconded by Councilman Kloecker and carried that the bid of C & N Tractor in the amount of $10,505.62 be awarded as recommended. The Mayor stated that it was the time and place scheduled for the Continued Public Hearing to consider Urban Service Area Revision request of Shapell Industries (USA 88-3) to include 2,142 acres into the Urban Service Area. (Continued from 12-4-88 Regular Council Meeting.) Senior Planner Myer presented and explained the Staff Report. Planning Director Dorn presented and explained a letter from the Building Trades Council regarding this proposal. c 8 ,1 ~ J I,..) Res. 89-64 Open Space The Mayor asked if there was anyone in the audience wishing to speak for or against the proposal. Mr. Jack Schenk, representing Shapell Industries, addressed the Council requesting approval of the property in the Urban Service Area. Mr. David Bouchard, representing the Gilroy Chamber of Commerce, addressed the Council concurring with the proposal to include the Shapell property within the Urban Service Area. Mr. Sam Bozzo, representing the Gilroy Unified School District, addressed the Council concurring with the proposal to include the Shapell property within the Urban Service Area. Ms. Sharon Holloway, 840 Carignane Drive, addressed the Council opposing inclusion of the Shapell property within the Urban Service Area. The Mayor asked if there was anyone further in the audience wishing to speak on the proposal. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. Discussion was had by Council on the matter. Motion was made by Councilman Gage seconded by Councilman Hale that the reading of Resolution No. 89-64 be waived and that it be adopted recommending that the Shapell property be included in the Urban Service Area. RESOLUTION NO. 89 - 64 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY RECOMMENDING MODIFICATION OF THE URBAN SERVICE AREA OF THE CITY OF GILROY WITHIN THE COUNTY OF SANTA CLARA. PASSED AND ADOPTED this 4th day of December, 1989, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: GAGE, HALE, KLOECKER, NELSON and VALDEZ None HUGHAN MUSSALLEM, COUNCILMEMBERS: COUNCILMEMBER: The Mayor removed the recommendation to update the current automatic aid agreement between the City and the South Santa Clara County Fire District from the agenda. A request for the City of Gilroy's determination to be included in the Open Space Authority for Santa Clara County's Eastern and Southern Regions was noted and tabled for additional information on same. The following informational items were noted with no separate discussion on same: City of Indian Wells, California, re: Earthquake and Contribution to Disaster Relief Fund; County of Maui, Hawaii, re: Earthquake; Metropolitan Transportation Commission re: Earthquake and Request for Continued Transit Financing; Update and Additional Requests for City Commission appointments; Council set Wednesday, December 20, 1989 at 6:30 p.m. in the Employees' Lounge for Interviews of the Planning and Parks & Recreation Commission Applicants; Santa Clara County Cities Association Meeting; Santa Clara County Traffic Authority in Support of Senate Constitutional Amendment (SCA-1): the Traffic Congestion Relief and Spending Limitation Act of 1990; Recycling Program Water Conservtn. Res.89-65 rS10 J !) Santa Clara County Traffic Authority re: Donation of Publicly owned Property for Measure A Program; and Report of Investments. Councilman Kloecker gave an update on the Gilroy Recycling Task Force noting the letter to the Committee Members, dated Novwember 21, 1989; Anti-scavenger Law; and purchase of collection bins recommending development of an anti-scavenger law, directing purchase of the collections bins, purchase of the conveyor system and development of advertising literature further explaining same. Ms. Natalie, Cook, South Valley Jr. HIgh School Teacher and Task Force Committee member, addressed the Council noting activities planned for the Committee to promote the Recycling Program. Mr. Miguel Paredes, addressed the Council noting support for the recycling program and requesting consideration of no increase in the rates for this voluntary effort. Motion was made by Councilman Kloecker seconded by Councilman Hale and carried that Staff be directed to submit an anti-scavenger ordinance for their consideration; that South Valley Refuse be authorized to purchase the collection bins required, including the conveyor system and that they submit a rate proposal for Council consideration. City Administrator Baksa gave an up-date on the water conservation program with recommendations for future conservation. Council directed Staff to investigate a life-line program for water conservation and submit same to Council for consideration. Motion was made by Councilman Gage seconded by Councilman Mussallem that the reading of Resolution No. 89 - 65 be waived and that it be adopted removing prohibition of outdoor irrigation from December 1st to March 1st from the City'S regulations on water use. RESOLUTION NO. 89 - 65 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY AMENDING RESOLUTION NO. 89-11 REGULATING WATER USE. City Administrator Baksa gave an update on the proposed Council Retreat noting that same has been scheduled for March 9- 11, 1990 with Mr. David Jones, Consultant, location to be determined. City Administrator Baksa reported on the recent Staff Retreat held in San Juan Bautista and noted proposed supervisory training classes scheduled in 1990. City Administrator Baksa distributed Wellness Committee Calendars to Councilmembers. Councilman Mussallem requested up-dates on the Gilroy/Morgan Hill Wastewater Treatment Plant EIR Schedule for future Council agendas. 1 C::8'\n I J LU I I League Adjrnmt. Councilman Valdez presented information regarding District Elections for the City of Gilroy and requested that same be agendized for Council action on the December 20, 1989 Council Agenda. The Mayor noted the League of California Cities Annual Conference, San Francisco - December 17-19, 1989. At 10:43 p.m. the Mayor adjourned the meeting to a Closed Session re: Possible Litigation in that there is significant exposure to litigation, in accordance with Section 54956.9 (b) (1) of the Government Code. At 12:00 midnight, the Mayor reconvened the meeting and further adjourned to December 20, 1989 at 8:00 p.m., cancelling the December 18, 1989 Regular Meeting due to the League of California Cities Conference, December 17-19, 1989.
