At 7:59 p.m. the Mayor declared a recess and reconvened the meeting at 8:05 p.m. The Mayor Introduced New Employees: Olga Mary Juarez, Clerk Typist I - Public Works, and Loren Richard Mansel, Lube Person. The Mayor presented a Certificate of Service to Rudolfo Nunez, Advisory Council of the Council on Aging, April 1988 to January 1990. The Mayor tabled presentation of a Certificate of Service to Vinod Patel, retired Library & Culture Commissioner, to the March 5, 1990 Regular Council Meeting. The Mayor presented Mr. Matthew Drummond with a Certificate of Appreciation for his heroic actions on January 31, 1990. The Mayor presented the Employee of the Month Award for January, 1990 Award to Rod Pavao, Assistant Fire Chief. Motion was made by Councilwoman Nelson to further clarify Section 12.57 re: collection of recyclable materials by unauthorized persons prohibited. Motion died for lack of a second. Motion was made by Councilman Valdez seconded by Councilman Kloecker that the reading of Ordinance No. 90-3 be waived and that it be adopted. ORDINANCE NO. 90 - 3 AN ORDINANCE OF THE CITY OF GILROY ENACTING CHAPTER 12, ARTICLE OF THE GILROY CITY CODE PERTAINING TO RECYCLABLE MATERIALS. RESOLUTION NO. 90 - 12 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY DESIGNATING MARCH, 1990 AS "WOMEN' HISTORY MONTH." PASSED AND ADOPTED this 20th day of February, 1990, by the following vote: AYES: COUNCILMEMBERS: GAGE, HALE, KLOECKER, VALDEz and HUGHAN NOES: COUNCILMEMBERS: MUSSALLEM and NELSON. ABSENT: COUNCILMEMBERS: None Discussion was had on the recommendation to approve the Santa Clara County Cities Association Agreement. The Mayor explained the Statewide Legislation and League of California Cities policy regarding this Association to Councilwoman Nelson, noting the elimination of the Inter-City Council and Mayor'S Conference is to be replaced by the new Cities Association. Motion was made by Councilman Kloecker seconded by Councilman Valdez and carried that the Santa Clara County Cities Association Agreement be approved as presented. Motion was made by Councilwoman Nelson seconded by Council- Councilman Kloecker and carried to continue the Public Hearing to consider a General Plan Amendment request from Park/Public Facility to Low Density Residential, on property located at 651 Sixth Street, between Carmel and princevalle Streets, on approxi- mately 3.74 acres, Wheeler Hospital Association, applicant, GPA 89-4 to the April 16, 1990 Regular Council Meeting due to the Planning Commission continuing same to their April 5, 1990 regular meeting. Motion was made by Councilman Valdez seconded by Councilman Kloecker and carried that the Public Hearing to consider a rezoning from PF (Public Facility) to R1 (Single Family Residen- tial) District and to remove the historic site designation from the 1929 Wheeler Hospital building for the purposes of demolishing the building, on property located at 651 Sixth Street, between Carmel and princevalle Streets, on approximately 3.74 acres, Wheeler Hospital Association, applicant, Z 89-5 (a & b) to the April 16, 1990 Regular Council Meeting due to the Planning Commission continuing same to their April 5, 1990 regular meeting. The Mayor stated that it was the time and place scheduled for the Public Hearing to consider the City's 16th Year Housing and Community Development Block Grant (CDBG) Application. The Staff Report was noted and further explained by HCD Grant Coordinator Rojas including the recommendation in Category A. Chief Building Inspector James explained the recommendation in Category B for City Code Enforcement. Heard from representatives of the applicants in each category (C-E) further explanation of their individual requested funding. The Mayor asked if there was anyone further in the audience wishing to speak on Categories A through E. There was no further comment from anyone in the audience. The Mayor closed that portion of the Public Hearing for Categories A through E. Discussion was had by Council on the matter. Motion was made by Councilman Mussallem seconded by Councilman Kloecker and carried that the Staff recommendations for Categories A through E with an exception to Category D be approved as follows: Category A - City of Gilroy Housing Rehabilitation Program - $30,000.00. Category B - City of Gilroy Code Enforcement - $30,000.00. Category C - Special Activities by a Subrecipient - $29,531.00.; Category D - Real Property Actuisition: Bridge Clustered Housing (Housing for Independent People - HIP) - $12,000.00; La Isla Pacifica (South County Alternatives - SCA) - $10,000.00; and The Redwoods Housing project - Kern Avenue (South County Housing - SCH) - $10,000.00.; Category E - Reloaction Assistance - Relocation/Rehabilita- tion Assistance (Operation Sentinel) - $4,900.00. (It was noted that Category G be eliminated and if Contingency for Added Public Service funds become available that the City would conduct a subsequent Public Hearing for distribution of same.) The Mayor opened the Public Hearing for Category F - Public Service Non-Profit Organizations Request and asked if there was anyone in the audience wishing to speak on the matter. Motion was made by Councilman Valdez seconded by Councilman Kloecker and carried that the following allocations be approved for Category F ($22,350.00): Child Care at Ochoa Homeless Center - Growth & Opportunity, Inc. - $1,000.00; Emergency Shelter Nights for Homeless - Emergency Housing Consortium - $4,000.00; Gilroy Senior Center Nutrition Transportation - Outreach & Escort, Inc. - $1,000.00; Homebound Senior Program/Case Management - Catholic Charities of Santa Clara County - $2,000.00; Intensive Design Cottages - Odd Fellow Rebekah Children's Home - $2,000.00; Operation Brown Bag - Food Bank of Santa Clara County - $3,000.00; Reading Program - Friends of the Reading Program - $1,000.00; School Prevention Program & Child Abuse Treatment - The Bridge Counseling Center, Inc. - $2,000.00; Shared Housing project - Catholic Charities of Santa Clara county - $800.00; Tenant/Landlord Counseling Program - Operation Sentinel - $2,550.00; and Tutorial Program for Disadvantaged Children - CAUSA/ESO - $3,000.00. (The Mayor deviated from the regular agenda in order to accommodate interested persons in the audience.) Mr. Ken Allemand, Auditor for the City's Financial transactions addressed the Council noting distribution of copies of the Financial Audit for Fiscal Year Ended June 30, 1989. Mr. Steve Emick, Gilroy Vicitor's Bureau, addressed the Counciland gave a Six Months Progress Report of the Bureau. ~ (At 10:26 p.m. Councilman Gage left the Council Chambers and returned at 10:28 p.m.) The Mayor asked if there was anyone in the audience wishing to speak on any matter not on the agenda. Mr. Miguel Paredes, addressed the Council regarding the recent demolition project of the Gilroy Unified School District Administration Offices on Church Street. (At 10:37 p.m. Councilwoman Nelson left the Council Chambers at returned at 10:40 p.m.) (The Mayor returned to the regular order of the Agenda.) The Mayor noted the Library and Culture Commission vacancy to fill the unexpired term of Vinod Patel (1-1-94) noting application for same will be accepted until March 14, 1990 at 5:00 p.m. (Councilman Mussallem left the Council Chambers and returned at 10:44 p.m.) Handicap Appeals Bd. Narcotics Task Force RDO Res.90-13 JPA 5845 The City Attorney presented and explained a proposed ordinance required for the creation of a Handicapped Appeals Board. Motion was made by Councilwoman Nelson seconded by Councilman Valdez and carried that the proposed ordinance creating a Handicapped Appeals Board be introduced, the reading waived and that it be published by title and summary. Police Commander Gardner presented and explained a proposal for South Santa Clara County and San Benito County Narcotics Task Force. Motion was made by Councilman Gage seconded by Councilman Hale and carried that the proposal for a South Santa Clara County and San Benito County Narcotics Task Force be approved as presented in concept. The Mayor recommended tabling action on a request of the Santa Clara Valley Water District proposed District Resolution regarding solid waste landfills. The matter was tabled. Councilman Hale noted the Water District Channel adjacent to the freeway, noting opportunity for chemical spills close proximity to groundwater supplies. The Mayor presented a recommendation to instruct the Plan- ning Department Staff to include priority status for developers with projects in process to their list of RDO revisions. Motion was made by Councilman Mussallem seconded by Council- man Gage and carried that the Mayor's recommendation for RDO revisions be approved and referred to the Planning Department Staff. Motion was made by Councilman Kloecker seconded by Council- man Gage that the reading of Resolution No. 90-13 be waived and that it be adopted approving designation of Source Reduction and Recycling Task Force for Santa Clara County, requested by IGC. RESOLUTION NO. 90 - 13 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY APPROVING COUNTY OF SANTA CLARA DESIGNATE A SOURCE REDUCTION AND RECYCLING TASK FORCE. Noted the Wastewater Treatment Plant Schedule with no change from the February 5, 1990 Agenda. Adjrnmet. Noted the Minutes of the Joint Powers Sewer Advisory Committee Meeting of January 23, 1990. City Administrator Baksa noted that he had nothing to report on the Water Conservation Program Update. City Administrator Baksa presented a proposed revised ordinance re: "Fee and Service Charge Revenue/Cost Comparison System" from the February 12, 1990 Council Study session, noting that same would be agendized for introduction as recommended by Council. City Administrator Baksa recommended that the proposed traffic signal study at Santa Teresa Boulevard and Welburn Avenue be temporarily tabled. Council agreed and temporarily tabled same. Councilman Hale inquired of the County's time schedule for street construction on Santa Teresa Boulevard north of Welburn Avenue Intersection. City Administrator Baksa noted that he did not have their time schedule for same. He also noted that he had not received information on traffic signals warranted on Monterey Street at Highland Avenue. The Mayor extended applications for the Minority Under- Representation Task Force appointments to February 28, 1990 at 5:00 p.m. The Mayor requested Councilmembers to seek applications for City's Representative to the Advisory Council on Aging for the Unexpired Term (June 1991). The Mayor noted Councilman Gage's consent to serve as the City's Representative on the County Drug Abuse Council, to be agendized for appointment on the March 5, 1990 Agenda. Councilman Kloecker noted receipt of a letter from a Committee Member of the City's Recycling Task Force on Germany's recycling process. Councilman Hale noted a proposed November 1990 Election Ballot issue for a State Constitution Amendment regarding fair allocation of State income taxes. The Mayor noted the February 26, 1990 Joint Special Meeting of the Gilroy/Morgan Hil City Councils' in the City of Morgan Hill at 5:00 p.m. The Mayor noted the City Council Retreat, March 9-11, 1990 at the Days Inn in Seaside.
