The Mayor Protempore led the Pledge of Allegiance to the
Flag at 7:00 p.m.
Pastor Moses Mariscal, Revival Chapel, gave the Invocation.
Mayor Protempore Kloecker noted that Mayor Hughan was on
vacation and Councilman Mussallem was absent due to an illness in
the family.
The City Clerk reported that the Agenda had been posted on
October 11, 1990 at 11:06 a.m.
Present: Councilmembers: Donald F. Gage, Leonard A. Hale,
Paul V. Kloecker, Sara C. Nelson, and Pete Valdez, Jr.; Absent:
Councilmembers: Larry Mussallem and Roberta H. Hughan.
Mr. Jack Pate, Chairman of the Gilroy 2000 Committee Task
Force, addressed the Council and gave an update on the
Committee's progress.
The Mayor Protempore presented the Employee Award for the
month of September, 1990 to Steve Ynzunza, Reserve Police Officer
and Part-time Public Safety Dispatcher.
Motion was made by Councilman Gage seconded by Councilman
Hale that the following items under the Consent Calendar be
approved by the following Roll Call Vote: Ayes: Councilmembers:
Gage, Hale, Nelson Valdez and Kloecker; Absent: Councilmembers:
Mussallem and Hughan:
Approved the Minutes of the Regular Council Meeting of
October 1, 1990;
Approved a Deferred Development Agreement with Jess Arias,
2300 Hecker Pass Highway; and
Accepted Improvements for John Giancola, Eighth Street and
with Amaral, Rossi Lane as recommended.
City Administrator Baksa presented a recommendation on bids
received for the Gilroy/Morgan Hill Wastewater Facilities Solids
Disposal Project 1990-6 recommending award of the bid to Western
Ind. & Env. Services in the amount of $69,600.00 and that same
would be referred to the Joint Powers Sewer Advisory Committee at
their meeting on October 16, 1990 for approval.
Motion was made by Councilman Gage seconded by Councilman
Hale and carried that the bid of Western Ind. & Env. Services in
the amount of $69,600.00 be awarded for the Gilroy/Morgan Hill
Wastewater Facilities Solids Disposal Project 1990-6 as
recommended.
City Administrator Baksa presented a recommendation to
award bids for three trucks; two in the amount of $12,737.01 to
Fremont Ford and one to Mission Valley Ford in the amount of
$10,935.64.
Motion was made by Councilman Gage seconded by Councilman
Hale and carried that the bid for two trucks in the amount of
$12,737.01 be awarded Fremont Ford and the bid for one truck in
the amount of $10,935.64 be awarded Mission Valley Ford as
recommended.

City Administrator Baksa reported on a bid previously
awarded for the Gilroy Shooting Range Improvement Project 1990-2
informing Council that there was a problem in regard to the sub-
contractors bids and recommended that all bids be rejected for
said project.
Motion was made by Councilman Valdez seconded by Councilman
Gage and carried that all bids for the Gilroy Shooting Range
Improvement Project 1990-2 be rejected as recommended.
The Mayor Protempore stated that it was the time and place
scheduled for a Public Hearing to consider a General Plan
Amendment request initiated by the City of Gilroy for property
located Southwest of Uvas Creek from Miller Avenue and Southeast
of Christmas Hill Park along Miller Avenue from Open Space to
Park/public Facility, to allow expansion of Christmas Hill Park,
GPA 90-9. It was noted and recommended that the Public Hearing
be continued to November 5, 1990 since the Planning Commission
had continued same to their November 1, 1990 meeting. The Public
Hearing was continued to November 5, 1990 as recommended.
The Mayor Protempore stated that it was the time and place
scheduled for a Public Hearing to consider a General Plan Text
Amendment, Smith and Associates, Applicant, re: the Intersection
of Santa Teresa Boulevard and First Street, GPA 90-3. It was
noted and recommended that the Public Hearing be continued to
November 5, 1990 since the Planning Commission had continued same
to their November 1, 1990 meeting. The Public Hearing was
continued to November 5, 1990 as recommended.
Discussion was had on the League of California Cities Call
to Action - "Operation Budget freedom" to eliminate City
involvement in the State Budget and Repeal County Charges for
Booking Fees and Property Tax Collection further explained by
City Administrator Baksa.
It was noted that letters sent to local legislators had not
been replied to. Motion was made by Councilman Valdez seconded
by Councilman Gage and carried that additional letters be
forwarded Assemblyman Areias and Senator Mello and Supervisor
Wilson in support of repealing SB 2557 and inviting them to
meeting with Council on the matter to discuss the proposed
legislation.
Council continued the discussion of Undergrounding utility
Fees Policy to the next regular meeting of November 5, 1990
previously requested by Councilman Mussallem, absent at this
meeting.
Discussion was had on review of RDO Allocations. A letter
from County Estates requesting allotments was noted. A letter
from John M. Filice, Jr. was noted regarding RDO allocations.
City Administrator Baksa further explained the matter
noting action required of Council.
Senior Planner Myer gave background information on the RDO
Applications.
Discussion was had by Council on the matter.
Mr. John M. Filice, Jr. addressed the Council representing
the Developers noting that they are not proposing any changes to
the original plans submitted for their projects and that they
will stay within the confines of what was originally approved.
He noted that they understand that any changes would require
Council approval.
Mr. Ted Schaal, representing the Long Meadow Project,
addressed the Council noting that he attends to build affordable
housing on this project. developing 4000-5000 sq. ft. lots, noting
that the concept has not changed.

Mr. David Sanchez, representing Country Estates, addressed
the Council noting that his agreement to concur with eighteen
units at this time is a compromise based upon Tentative Map
approval for the thirty units.
Mrs. Lucky Zimmershead addressed the Council suggesting
that the RDO document (ordinance) may need amendments because of
the time and drought situation and that the City Council owes
more to the residents of Gilroy than any new development.
The Mayor Protempore asked if there was anyone further in
the audience wishing to speak. There was no comment from anyone
in the audience.
Further discussion was had of Council. Council requested
that the RDO allocations be reagendized with a Staff Report at
the next regular meeting to explain the original RDO application
plans of each project and what the developers are proposing for
their project at the present time. Council also requested a
legal opinion regarding the Tentative Map proposal explained by
John M. Filice, Jr.; if there is sewer capacity available does
the City have a legal requirement to allocate any of the
capacity; and how binding are the 1980-81-82, etc. allocations.
It was noted that legal items may not be available until the
regular meeting on November 19, 1990 as the City Attorney is
presently on vacation.
City Administrator Baksa presented a recommendation to
upgrade two part-time Police Record's Technician positions
further explained by Assistant Police Chief McCuiston.
Discussion was had by Council on the matter. Motion was
made by Councilman Valdez seconded by Councilwoman Nelson and
carried that two part-time Police Record's Technician positions
be upgraded as recommended.
Discussion was had in regard to the Intergovernmental issue
as to the feasibility to integrate IGC an SCCCA further explained
by Councilman Hale.
Motion was made by Councilman Hale seconded by Councilman
Valdez and carried that the City of Gilroy recommends that both
IGC and SCCA remain as separate organizations. Councilwoman
Nelson voted "no" on the motion.
Councilman Kloecker noted that he would provide information
to councilmembers on Bay Vision 20/20.
The Mayor Protempore asked if there was anyone in the
audience wishing to speak on any matter not on the agenda. There
was no comment from anyone in the audience.
Motion was made by Councilwoman Nelson seconded by
Councilman Hale and carried that Councilman Mussallem be
reappointed as the City Representative to the Santa Clara Valley
Water District's South Zone-Flood Control Zone Advisory Committee
and Norman S. Allen, Alternate for the October 1, 1990 to October
1, 1991 term.
Motion was made by Councilman Gage seconded by Councilman
Valdez and carried that Councilman Hale be appointed as the
City'S Representative on the Santa Clara County Cities
Association (SCCCA) and Mayor Hughan be appointed as Alternate
representative.

Committee was presented and explained by City Administrator Baksa
for approval of a Chemical Control Manager position.
Motion was made by Councilman Gage seconded by Councilman
Valdez and carried that a Chemical Control Manager position be
approved as presented.
The Report of the Personnel Commission Meeting of October
8, 1990 was noted.
Motion was made by Councilman Gage seconded by Councilman
Valdez and carried that the job description of Associate Civil
Engineer be approved as recommended.
Councilman Hale inquired of the Personnel Commission vote
of three commissioners when four were present. (Current
practice-the Chairperson does not vote unless there is a tie
vote.)
The Minutes of the Parks and Recreation Commission Meeting
of August 21, 1990 were noted.
The Minutes of the Senior Advisory Board Meetings of July
16th and August 20, 1990 were noted.
The Minutes of the Library and Culture Commission Meetings
of August 14th and September 11, 1990 were noted.
Councilman Gage inquired of the schedule for the Sidewalk
Survey. City Administrator Baksa gave an update on same.
City Administrator Baksa noted no update on the Water
Conservation Program.
Discussion was had regarding the City'S policy on Single
Family/Multi-Unit Sewer Charges further explaining same.

Motion was made by Councilman Valdez seconded by Councilman
.Kloecker and carried that a policy be established to charge all
multi-family units the same sewer charge rate regardless of the
number of meters installed, as recommended.
City Aaministrator Baksa presented the Emergency and Non-
emergency Lines of Succession for approval. Motion was made by
Councilman Gage seconded by Councilman Hale and carried that the
Emergency and Non-emergency lines of succession be approved as
presented.
City Administrator Baksa distributed additional information
regarding the November 1990 ballot propositions.
City Administrator Baksa distributed the third Quarterly
Reports to Council.
City Administrator Baksa noted the Ribbon Cutting
Ceremonies at the Gilroy Golf Course Club House, October 17th at
6:00 p.m. and the Old City Hall Ceremonies at 5:04 p.m. on the
same date.
City Administrator Baksa noted the Planning Commission
invitation to Council to participate in a tour of the facilities
at the Rinconada Water Treatment Plant in Los Gatos on October
24, 1990 at 9:30 a.m.
Councilman Kloecker gave an update on the recycling program
and noted that recycling of Christmas trees will be proposed.
Councilwoman Nelson reported on the American Law Institute-
American Bar Association (ALI-ABA) Conference that she will be
attending in Atlanta, November 1-3, 1990.

Gilroy City Council study Session, October 29, 1990 - 7:00
p.m., Gilroy Senior Center re: Discussion of City Annexation
