Bids re: Waste study 5Y69 Regular Meeting February 4, 1991 Gilroy, California The Mayor led the Pledge of Allegiance to the Flag at 7:00 p.m. Roger Wisdom, EV3 Church, gave the Invocation. The City Clerk reported that the Agenda had been posted on January 31, 1991 at 5:30 p.m. Present: Councilmembers: Donald F. Gage, Leonard A. Hale, Paul V. Kloecker, Larry Mussallem, Sara C. Nelson, Pete Valdez, Jr. and Roberta H. Hughan; Jack Pate, Chairman of the Gilroy 2000 Committee Task Force gave an update of the Committee's progress. Motion was made by Councilman Kloecker seconded by Councilman Gage that the following items under the Consent Calendar be approved by the following Roll Call Vote: Ayes: Councilmembers: Gage, Hale, Kloecker, Mussallem, Nelson, Valdez and Hughan; Approved the Minutes of the Regular Council Meeting of January 22, 1991; Adopted Ordinance No. 91-3 Amending Gilroy City Code Chapter 16.31 re: Loud Noise During Curfew Prohibition; ORDINANCE NO. 91 - 3 AN ORDINANCE OF THE CITY OF GILROY AMENDING SECTION 16.31 OF THE GILROY CITY CODE PERTAINING TO LOUD NOISES DURING CURFEW. PASSED AND ADOPTED this 4th day of February, 1991, by the following vote: AYES: COUNCILMEMBERS: GAGE, HALE, KLOECKER, MUSSALLEM, NELSON, VALDEZ and HUGHAN. NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None; Approved Budget Amendments/Transfers as recommended. City Administrator Baksa presented a report and recommendation to award the bid of Jenkins Machinery Company in the amount of $8,870.30 for a Verticutting Attachment for the Parks and Recreation Division. Motion was made by Councilman Gage seconded by Councilman Kloecker and carried that Jenkins Machinery Company be awarded the bid in the amount of $8,870.30 for a Verticutting Attachment as recommended. City Administrator Baksa presented and explained a report and recommendation on bids for renovation of Well 16 and 17. Motion was made by Councilman Valdez seconded by Councilman Kloecker and carried that Salinas Pump Company be awarded the bid for renovation of Well 16 and 17 as recommended. City Administrator Baksa presented and explained a report and recommendation on bids received for a South County Waste Characterization Study. Motion was made by Councilman Kloecker seconded by Councilman Valdez and carried authorizing approval of Cal Recovery Systems Incorporated bid in the amount of $28,360.00 for a South County Waste Characterization Study, noting Gilroy's share to be $16,114.00 as recommended. c Y' '7 n . , ,) /..' Mgmt.Agency IGC City Administrator Baksa presented and explained revised draft revisions and update to the Gilroy City Code Chapter 13 - Business Licenses and Chapter 16A - Peddlers, Vendors and other Transient Businesses requesting Council policy for vendors locating on City sidewalks. Discussion was had on the matter. Motion was made by Councilman Valdez seconded by Councilman Kloecker to allow vendors to operate on sidewalks by the following Roll Call Vote: Ayes: Councilmembers: Kloecker and Valdez; Noes: Councilmembers: Gage, Hale, Mussallem, Nelson and Hughan. Motion failed. Council tabled action on the introduction of the ordinances to the February 19, 1991 regular meeting to include additional revisions requested by Council, specifically to prohibit vendors locating on sidewalks within the City of Gilroy excepting the High School site with approved permits. The Congestion Management Agency Joint Powers Agreement was noted with a letter containing the City's concerns further explained by Councilman Kloecker. Motion was made by Councilman Kloecker seconded by Councilman Gage and carried that the Joint Powers Agreement be approved and the letter containing the City's concerns as amended. A request of Santa Clara County Intergovernmental Council for endorsement and appointment of a volunteer representative to the Urban Forestry Task Force was noted. The following informational items were noted with no separate discussion on same: Proclamations Issued by Mayor Hughan: American History Month - February 1991 and Rebekah Assembly One Hundredth Anniversary Celebration May 19-24, 1991; Gilroy Chamber of Commerce in appreciation of City'S contributions to the Christmas Decoration Program; P. G. & E. re: Special Payment Program; Tri-County Apartment Association Update Information; Judith Meyer in appreciation; Falcon Cable Systems Company Management; and Monthly Cash and Investments Report, December 31, 1990. City Administrator Baksa gave an update on the Water Conservation Program. Councilman Kloecker requested that yearly totals be included in the Monthly Water Production reports. Council set February 25, 1991 at 7:00 p.m. as a Council Study Session with South Valley Refuse and Disposal to discuss refuse landfill and pending rate increases. City Administrator Baksa noted scheduled interviews February 7th and 8, 1991 for prospective surveyors on the Gilroy Survey. City Administrator Baksa noted that the Annual Report and Newsletter is proposed to be mailed next week. City Administrator Baksa distributed procedures for Customer Service Program to Council. Council set February 12, 1991 at 7:00 p.m. as a Council Study Session to discuss the Bay Vision 2020 Draft Report. Res.91-6 Cable TV Adjrnmt. 597' Councilman Kloecker noted no update on the Recycling Program. City Administrator Baksa noted that the February 5, 1991 Joint Council/Planning Commission study Session has been relocated to the Employees' Lounge. Motion was made by Councilman Hale seconded by Councilman Nelson that the reading of Resolution No. 91-6 be waived and that it be adopted in support of SB 169 (repeal of SB 2557) re: Operation Budget Freedom, noted in the League of California Cities News Bulletin, Volume 7, January 17, 1991. RESOLUTION NO. 91-6 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY SUPPORTING SENATE BILL 169 REPEALING PORTIONS OF SB2557 AND PROVIDING ALTERNATE FUNDING. PASSED AND ADOPTED this 4th day of February, 1991, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: COUNCILMEMBERS: COUNCILMEMBERS: GAGE, HALE, KLOECKER, MUSSALLEM, NELSON, VALDEZ and HUGHAN. None None Councilmen Valdez noted that he has contacted the Cities of Morgan Hill and Hollister and San Benito County Board of Supervisors for a meeting regarding Falcon Cable TV. Councilwoman Nelson noted a meeting she had with Heritage Cable who intend to view the City'S present cable system. Councilman Mussallem requested the City support the War in the Persian Gulf by proclamation to include local servicemen and women presently serving who reside in Gilroy. Councilman Mussallem to prepare the proclamation for Council approval. The Mayor suggested that this document include encouraging citizens to fly the U.S. flag. The following meetings were noted: Joint Council/Planning Commission Study Session, February 5, 1991 - 7:00 p.m., re: Capital Improvement Budget and Revenue Projections. Joint Council/Planning Commission Study Session, February 11, 1991 - 7:00 p.m. re: Circulation/Air Quality Elements to the General Plan. Joint Council/school Liaison Committee Meeting, February 14, 1991 - 5:15 p.m. Councilman Hale noted that he would be attending a Conference in Visalia on February 15th and 16, 1991 re: Revitalizing Smaller Communities.
