The Mayor Protempore led the Pledge of Allegiance to the
Flag at 7:00 p.m.
City Administrator Baksa presented a report and
recommendation on bids received for a truck for the Police
Department recommending award of bid to Bob Lynch Ford in the
amount of $7,283.10. Motion was made by Councilman Gage seconded
by Councilman Kloecker and carried that the bid of Bob Lynch Ford
in the amount of $7,283.10 be awarded as recommended for a pickup
truck for the Police Department. Councilwoman Nelson voted "no"
on the motion.
The City Clerk noted that the Agenda had been posted on
April 4, 1991 at 8:24 a.m.
Present: Councilmembers: Donald F. Gage, Leonard A. Hale,
Paul V. Kloecker, Sara C. Nelson, and Pete Valdez, Jr.; Absent:
Councilmembers: Larry Mussallem and Roberta H. Hughan.
Council tabled the report and recommendation on Water
Conservation Kits to follow the discussion on the Water
Conservation Program.
City Administrator Baksa gave an update on the Water
Conservation Program and presented and explained recommended
changes to the 1991 Water Reduction Program. Discussion was had
by Council on the matter.
The Mayor Protempore asked if there was anyone in the
audience wishing to speak in regard to Water Conservation.
Mr. K. A. Mike Gilroy, resident, addressed the Council
objecting to the City purchasing flow reduction devices for
residents as most residents already have them in place.
Mr. Sam Thayer, Nursery Clearance Center, addressed the
Council objecting to the proposal prohibiting all new or
replacement landscaping and grass.
Mr. Bill Shepherd, Royal Swimming Pools, addressed the
Council inquiring of any prohibitions on refilling swimming
pools.
Mr. Miguel Paredes, addressed the Council and objected to
prohibiting replacement landscaping and grass. He further noted
that he concurred with the Odd/Even concept for residents to
follow and believes they would be able to comprehend this method
of saving water. He agreed with prohibiting operation of
decorative fountains.
Dr. Daniel Palmerlee, addressed the Council and objected to
the Odd/Even concept of watering days because of the difficulty
of scheduling automatic sprinklers.

Council agreed with the following changes to the Water
Reduction Program:
Motion was made by Councilman Kloecker seconded by
Councilman Gage and carried that washing of vehicles only on
resident's watering days be allowed. Councilman Hale voted "no"
on the motion.
Motion was made by Councilman Kloecker seconded by
Councilwoman Nelson and carried that Odd/Even Concept for outside
watering be approved, specifically even numbered addresses to
water on even numbered days of the month and odd numbered
addresses to water on odd numbered days of the month.
Motion was made by Councilman Kloecker seconded by
Councilwoman Nelson and carried that the proposal to prohibit all
new or replacement landscaping and grass as presented in Item 112
be eliminated.
Motion was made by Councilman Kloecker seconded by
Councilman Gage and carried that the recommendation to require
water audit for large industrial, commercial, and multi-family
residential water users be approved and that the recommendation
to defer the installation of all landscaping for all new/current
construction projects be eliminated.
Motion was made by Councilman Kloecker seconded by
Councilwoman Nelson that the reading of Resolution No. 91-22 be
waived and that it be adopted amending the 1991 Water Reduction
Program to include the above changes.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY AMENDING
RESOLUTIONS NOS. 89-11, 89-46 AND 90-16 REGULATING WATER USE.
PASSED AND ADOPTED this 8th day of April, 1991 by the following
vote:

Discussion was had regarding the location of the Official
Rainfall Record.
Discussion was had on proposed Water Reducing Devices
Program further explained by City Administrator Baksa.
Motion was made by Councilman Kloecker seconded by
Councilman Gage and carried that Water Reducing Devices be
distributed as presented with the exception of a $2.00 fee for
each kit. Councilwoman Nelson voted "no" on the matter.
City Administrator Baksa presented the recommendation on
bids for the Water Reducing Devices and recommended award of the
bid to Resources Conservation Inc. in the amount of $25,324.00.
Motion was made by Councilman Gage seconded by Councilman
Kloecker and carried that the bid of Resources Conservation, Inc.
be awarded in the amount of $25,324.00 as recommended.
Councilwoman Nelson voted "no" on the motion.
Discussion was had on the proposed Water Rate Schedule
further explained by City Administrator Baksa. Council agreed
that a fourth tier should be proposed to discourage water
wasters. It was noted that the proposed rate increased as a
result of the Santa Clara Valley Water District pump tax and that
the rates will have to be further increased if the District
increases their tax. Council requested Staff prepare a rate
schedule with the fourth tier as discussed and research the
effect this would have on Commercial and Industrial for their
consideration at the Public Hearing to be scheduled.
