The Mayor led the Pledge of Allegiance to the Flag at 7:02
p.m.
The Reverend Travis J. Large, Revival Center gave the
Invocation.
The City Clerk reported that the Agenda had been posted on
April 11, 1991 at 9:18 a.m.
Present: Councilmembers: Donald F. Gage, Leonard A. Hale,
Paul V. K1oecker, Larry Mussallem, Sara C. Nelson, Pete Valdez,
Jr. and Roberta H. Hughan;
The Mayor introduced New Employee: Shirley Bass, Police
Records Technician I; Landy Quaill, Lube Person; and Steve
Gaither, Police Officer.
The Mayor presented the Employee Award for the Month of
March, 1991 to Gayle Glines and Julie Gilroy Spier.
Jack Pate, Chairman of the Gilroy 2000 Committee Task
Force, gave an update.
Motion was made by Councilman Gage seconded by Councilman
Hale that the following items under the Consent Calendar be
approved by the following Roll Call Vote:: Ayes: Councilmembers:
Gage, Hale, Kloecker, Mussallem, Nelson, Valdez and Hughan;
Approved the Minutes of the Regular Council Meeting of
April 1, 1991;
Denied Claim of Maura Ramirez as recommended;
Approved Budget Amendments/Transfers as recommended;
Denied Claim of Michael Frank and Phil Lawton as
recommended;
Approved the Minutes of the Special Council Meeting of
March 26, 1991; and
Approved the Minutes of the Special Council Meeting of
April 8, 1991.
Noted a recommendation to repeal Section 6.5 of the City
Code making violations of Article I, Chapter 6, Infractions
further explained by the City Attorney.
Motion was made by Councilman Kloecker seconded by
Councilman Valdez and carried that a proposed ordinance be
introduced repealing Section 6.5 of the City Code as recommended
to be published by title and summary.

Noted a Reimbursement Agreement of Country Estates for
Connections to the Water System and Sewer Trunk Main together
with a request of Matteoni, Saxe & Nanda/Country Estates Venture
for reimbursement under a 20 year Agreement, further explained by
Director of Public Works Allen. Discussion was had by Council on
the matter. Motion was made by Councilman Mussallem seconded by
Councilwoman Nelson and carried that action on the matter be
continued to determine from City'S legal counsel if this would
affect the City of Gilroy v. Carl Bozzo Suit.
City Administrator Baksa presented an amendment to the
Sewer Use Ordinance to conform to Federal Code Regulations
further explaining same.
Motion was made by Councilman Gage seconded by Councilman
Kloecker and carried that the reading of the proposed ordinance
be introduced and published by title and summary amending the
Sewer Use Ordinance to conform to Federal Code Regulations.
Councilwoman Nelson voted "no" on the motion.
Director of Public Works Allen presented a recommendation
to close streets at Country Estates. Motion was made by
Councilman Gage seconded by Councilman Kloecker that the reading
of Resolution No. 91-23 be waived and that it be adopted.

RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY PROHIBITING
PUBLIC TRAFFIC ON UNDEVELOPED STREETS IN THE COUNTRY ESTATES
SUBDIVISION.
PASSED AND ADOPTED this 15th day of April, 1991, by the following
vote:

The Mayor asked if there was anyone in the audience wishing
to speak on any item not on the agenda. There was no comment

Councilman Kloecker presented a draft letter in response to
the Congestion Management Agency Joint Powers Draft Agreement.
Motion was made by Councilman Kloecker seconded by
Councilman Valdez and carried that the letter be forwarded to the
Congestion Management Agency as corrected.
The Santa Clara County Cities Association re: 1991-1992
Work Program was noted and Councilman Hale (City'S
representative) requested that any concerns and issues regarding
same be directed to him for submission.

Hale and carried that Lube Person title be changed to Assistant
Mechanic as recommended.
Noted the Report of the Personnel Commission Meeting of
April 8, 1991.
Motion was made by Councilman Gage seconded by Councilman
Hale and carried that job description and salary range of
Information Systems Coordinator be approved as presented.
The Report of the Planning Commission Meeting of April 4,
1991 was noted.
The Minutes of the Joint Powers Sewer Advisory Committee
Meeting of March 12, 1991 were noted.
Noted the Minutes of the Gilroy 2000 Steering Committee
Meeting of April 3, 1991.
City Administrator Baksa gave an update on the Water
Conservation Program.
The Drought Alert Calculations were noted.
The Santa Clara Valley Water District re: Water
Conservation Measures were noted.
Councilman Mussallem suggested that the Cities of Los
Altos, Sunnyvale and Mountain View be contacted for samples of
their placards indicating water savings or goals for similar
signs for Gilroy.
Distributed June 30, 1990 Financial Audit and Quarterly
Reports to Council.
Discussed Sewer Debt Ratios. Council concurred with
previous discussion of 6.1% debt ratios to be recovered by
residents and any additional expansion of the sewer plant to be
paid for by new development.
Noted selection of the name of the Citizens' Newsletter
"Inside Scoop" submitted by Karen Pogue who donated the prize to
the Parks and Recreation Department for underprivileged
children's scholarships.
Councilman Kloecker noted National Recycling Week, April
15-21, 1991.
Councilman Gage suggested that City representatives attend
other cities Council Meetings, such as Watsonville to inform them
of the City'S future long-term wastewater treatment facility
plans. It was noted that this proposal would be presented to the
Joint Powers Sewer Advisory Committee for recommendation. It was
further suggested that letters be forwarded to these cities to
express the City'S interest to meet with them and address any
concerns they may have regarding the City'S long-term wastewater
facilities.
Discussed Operation Budget Freedom.
Noted a letter from Senator Henry Mello re: SB 169 and
Corrective Measures proposed for SB 2557.
Noted the League of California Cities News Bulletin, Volume
8, March 11, 1991.
Councilman Mussallem suggested that the Santa Clara County
Greenbelt proposal be agendized on the May 6, 1991 Council Agenda
to review and take action on same.
