Kloecker; Intro.New The Mayor introduced the following new employees: Sandra Employees Sammut, Recreation Coordinator (Senior Center); Guadalupe Gutierrez, Groundskeeper I; and Lisa Mary Menacho, Resource Management Coordinator. Emp.Award Presented the Employee Award for the Month of July 1991 to Patrick Sullivan, Reserve Police Officer. Motion was made by Councilwoman Nelson seconded by Councilman Gage and carried that the following Development Agreements with amendments as noted be approved: Gary Walton, 171 Liman Avenue, #91 -28; Gilroy Redwood Association (South County Housing), Kern Avenue /Mantelli, #88 -46 R -1 as recommended and Item H, Accepting Improvements with amendments as noted be approved: for Robert Mann Packaging, 5999 Rossi Lane, #91 -01 and Police Department Shooting Range #90 -08. )'- 0"o Bids re: City Administrator Protempore Dorn presented a Utility recommendation to accept a proposal of Camp, Dresser & McKee, Sys.MP Inc. in the amount of $351,315.00 for Utility Systems Master Plan further explained by Director of Public Works Allen. Motion was made by Councilman Gage seconded by Councilman Hale and carried that the proposal of Camp, Dresser & McKee, Inc. in the amount of $351,315.00 for Utility Systems Master Plan be accepted as presented and recommended. PubHear.re: The Public Hearing to Consider a Zoning Ordinance Text RDO Amendment Initiated by the City to Amend the City's Residential Development Ordinance and Rating Scale Section was continued to September 16, 1991 in order to follow the Planning Commission Hearing on same. Res.91 -54 City Administrator Protempore Dorn presented and explained a resolution urging the State Legislature and Governor Wilson to totally repeal SB 2557 and enact Local Government Fiscal Reform. Motion was made by Councilman Gage seconded by Councilman Hale that the reading of Resolution No. 91 -54 be waived and that it be adopted. RESOLUTION NO. 91 - 54 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY URGING THE STATE LEGISLATURE AND GOVERNOR WILSON TO TOTALLY REPEAL SB 2557 AND ENACT LOCAL GOVERNMENT FISCAL REFORM. PASSED AND ADOPTED this 19th day of August, 1991, by the following vote: AYES: COUNCILMEMBERS: GAGE, HALE, MUSSALLEM, NELSON, VALDEZ and HUGHAN. NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBER: KLOECKER. Sewer Use City Administrator Protempore Dorn presented an amendment Ord. to the Sewer Use Ordinance to include approved Local Limits explaining same and further explained by Assistant Fire Chief Ledesma and Chemical Control Supervisor Amper. Councilwoman Nelson requested that the businesses be notified that would be affected by this proposed amendment. Motion was made by Councilman Gage seconded by Councilman Hale and carried that Staff be instructed to prepare the proposed ordinance for introduction at the next regular meeting. Budget City Administrator Protempore Dorn presented a request that Amendmt. a proposed budget amendment be agendized as an emergency measure regarding Country Estates, Phase I Assessment District, noting that the first billing for principal and interest payment was not provided for in the current budget needed to be paid prior to the next regular Council Meeting. Motion was made by Councilman Mussallem seconded by Councilman Valdez and carried that the budget amendment proposal be agendized and acted upon as an emergency measure. Motion was made by Councilman Gage seconded by Councilman Mussallem and carried that the budget amendment as presented be approved as recommended. Bart Ext. Council took no action on the request of James T. Beall, Jr., Santa Clara County Cities' Representative to the Metropolitan Transportation Commission re: Bart Extension to Santa Clara County. GardenVal. Discussion was had on a request of Garden Valley Foods, re: Foods water rates and the Staff Report was noted further explained by City Administrator Protempore Dorn. Mr. Tom Filice, representing Garden Valley Foods addressed the Council further explaining their request and noting that he was available to answer any questions of the Council. Council took no action on the matter at this time and requested that this matter be reviewed again in 1992 when the water rates will be annually reviewed. The following informational items were noted with no separate discussion except as noted: Governor's Interagency Council on Growth Management Public Hearing of July 30, 1991 and Mayor Jack Sutorius' Statement to the Governor's Council; 1991 General Plan Amendment Requests; Gilroy Unified School District in appreciation; Santa Clara County Transportation Agency Service Change Proposals; Santa Clara County Cities Association Organizational Changes; Gilroy Garlic Festival in appreciation; Letter from Department of Housing and Community Development regarding review of City of Gilroy's revised Draft Housing Element; Letter from Mark Kennedy resigning from the Building Board of Appeals, effective September 1, 1991; Letter to Mike Evanhoe, Congestion Management Agency, regarding Level of Service (LOS) Standard for South County; Invitation to join in the Santa Clara County Christopher Columbus Quincentennial Celebration in 1992; and Letter re: Hillsdale Rock Company's Proposal for a Quarry Operation in the Flint Hills in San Benito County. Motion was made by Councilman Gage seconded by Councilwoman Nelson and carried that Staff review the proposal to determine if the EIR should be challenged regarding the Proposal for the Quarry Operation. Housing The Minutes of the Housing Task Force Meeting of July 24, TaskForce 1991 were noted. Bldg.& The Minutes of the Building Board of Appeals and Handicap. Handicapped Board of Appeals Meeting of August 7, 1991 were Bd.of Ap. noted. Pers.Com. The Report of the Personnel Commission Meeting of August 12, 1991 was noted. Fire Ed. Motion was made by Councilman Gage seconded by Councilman Spec. Hale and carried that the job description for Fire Education Specialist be approved as presented and recommended. Water City Administrator Protempore Dorn noted no update on the Consrvtn. Water Conservation Program and that the meters would be read at a different time of the month. Councilman Gage requested that the residents be notified of this change. (It was subsequently advised that this would not affect the time the residential water meter readings are read, but the well meters only, and no need to advise the residents.) {►044- Old City City Administrator Protempore Dorn gave an update on the Hall Old City Hall, noting that the received verbal approval of the preliminary structural drawings from the State Historic Preservation Office. The Mayor noted that lapel pins of the Old City Hall Restoration Committee are available for $5.00 at the Gilroy Visitors' Bureau and the Nimble Thimble. There was no update on the Recycling Program. There was no update on Operation Budget Freedom. Councilman Valdez noted the Gilroy Hispanic Cultural Festival at Christmas Hill Park, August 24th and 25, 1991 and urged Council and others to attend. Councilwoman Nelson reported that the Visitor's Bureau Meetings have been scheduled for the second Thursdays of each month. Councilman Mussallem noted that the Council Committee regarding the Gilroy Downtown Development Corporation met on August 14th and will meet on August 21st and 28, 1991 at O.D.'s Restaurant on Martin Street at 7:30 a.m. and the Committee would make a recommendation to Council at their September 3rd or 16th Regular Meeting. The Mayor noted the following meetings: Gilroy City Council Study Session, September 9, 1991 - 7:00 p.m., re: Review Proposal Options re: State Mandated and Waste Reduction Goals (AB 939), Employees' Lounge, City Hall, 7351 Rosanna Street, Gilroy, CA 95020; Santa Clara County Cities Association General Membership Meeting, September 19, 1991 - 6:30 p.m., Christmas Hill Park, Mulberry East and West Areas, Miller Avenue, Gilroy, CA 95020, requesting Council to RSVP to the City Clerk if they are planning to attend; and Council requested that the Gilroy Downtown Development Corporation Meetings of August 21st and 28, 1991 be publicly noticed in the event Councilmembers other than the Committee wished to attend.
