Sewer Rates GPA 90-07 The City Clerk noted that the agenda had been posted on June 25, 1992 at 10:02 a.m. Present: Councilmembers: Mike Gilroy, Leonard A. Hale, Paul V. Kloecker, Sara C. Nelson, Suellen C. Rowlison, Pete Valdez, Jr., and Donald F. Gage; Motion was made by Councilwoman Nelson seconded by Council- man Hale that the following items under the Consent Calendar be approved by the following Roll Call Vote: Ayes: Councilmembers: Gilroy, Hale, Kloecker, Nelson, Rowlison, Valdez and Gage; Minutes of the Regular Council meeting of June 15, 1992; and Approved Budget Amendments/Transfers as recommended; The Mayor stated that it was the time and place scheduled for the continued Public Hearing to consider revisions and adjustments of rates and charges for Municipal Sewer Service, continued from the 6-15-92 Regular Council meeting. The Staff Report was noted and further explained by City Administrator Baksa. The Mayor asked if there was anyone in the audience wishing to speak for or against the proposed revisions and adjustments and charges for municipal sewer service. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. Motion was made by Councilwoman Nelson seconded by Councilwoman Rowlison that the reading of Resolution No. 92-48 be waived and that it be adopted to include the changes noted by Councilwoman Rowlison. RESOLUTION NO. 92 - 48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY ESTABLISHING RATES FOR SANITARY SEWER SERVICE EFFECTIVE JULY 1, 1992 THROUGH JUNE 30, 1999. PASSED AND ADOPTED this 29th day of June, 1992, by the following vote: AYES: NOES: ABSENT: COUNCILMEMBERS: GILROY, HALE, KLOECKER, NELSON, ROWLISON, VALDEZ and GAGE COUNCILMEMBERS: None COUNCILMEMBERS: None The Mayor stated that it was the time and place scheduled for Council action on a proposed resolution to approve a General Plan Amendment request to amend the General Plan Map from Industrial Park to General Services Commercial and making CEQA findings and adopting mitigation monitoring program for property located on the west side of San Ysidro Avenue, east of U.S. 101, between Las Animas Avenue and Leavesley Road, on approximately 11 acres, J. Filice, & Sons, applicants, GPA 90-07 continued from 6- 15-92 regular council meeting. Councilman Kloecker suggested that the matter be continued to follow the studies regarding land use elements, etc. of the General Plan. Motion was made by Councilman Kloecker seconded by Councilman Valdez by the following Roll Call Vote to continued Council action on the GPA request to November 2, 1992: Ayes: Councilmembers: Gilroy, Kloecker, Rowlison and Valdez; Noes: Councilmembers: Hale, Nelson and Gage. It was noted that the EIR was certified by the City Council on January 21, 1992. Z 91-08 Res.92-49 Weed Abate. Council Meetings Prop. 155 Motion was made by Councilman Hale seconded by Councilwoman Nelson and carried that the proposed ordinance prezoning property located at 655 Cohansey Avenue to PO (Professional Office), on 2.436 acres, Dr. T. Gallo, et al, applicants, Z 91-08 be read by title and waive further reading of the ordinance. Motion was made by Councilman Gilroy seconded by Councilman Hale by the following Roll Call vote that the ordinance be introduced and published by title and summary: Ayes: Council- members: Gilroy, Hale, Kloecker, Nelson, Rowlison, Valdez and Gage. Motion was made by Councilman Valdez seconded by Council- woman Nelson that the reading of Resolution No. 92-49 be waived and that it be adopted approving the decision of the Planning Commission to deny a General Plan Amendment request to change the designation and density of Gilroy's General Plan Map for approximately 3 acres from Low Density Residential to Medium Density Residential for property located at 8790 Kern Avenue and the parcel to the south, steven Nicholas and Leo Ludewig applicants, GPA 91-04. (Public Hearing held 6-15-92; Council denied request by motion; resolution required.) RESOLUTION NO. 92 - 49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY DENYING GPA 91-04, WHICH PROPOSED TO AMEND THE GENERAL PLAN MAP OF THE CITY OF GILROY TO CHANGE THE DESIGNATION AND DENSITY FROM LOW DENSITY RESIDENTIAL TO MEDIUM DENSITY RESIDENTIAL ON AN APPROXIMATELY 3-ACRE PROPERTY LOCATED AT 8790 KERN AVENUE AND THE PARCEL TO THE SOUTH. Motion was made by Councilman Hale seconded by Councilwoman Nelson and carried that the proposed ordinance be introduced and published by title and summary. Motion was made by Councilman Hale seconded by Councilman Kloecker and carried that the title of a proposed ordinance setting an additional regular meeting of the Council on the fourth Monday be read and waive further reading of the ordinance. Motion was made by Councilman Valdez seconded by Councilman Kloecker and carried that the proposed ordinance be introduced and published by title and summary. Council requested that the matter of a discussion of Council policy regarding the length of Council Meetings be agendized at the next regular meeting. A request of Assemblyman Jim Costa was noted requesting a resolution in support of Proposition 155, the $1 Billion Bond Act for Rail Transportation. Motion was made by Councilman Kloecker seconded by Councilman Valdez and failed by the following Roll Call Vote to support Proposition 155: Ayes: Councilmembers: Kloecker, Rowlison and Valdez; Noes: Councilmembers: Gilroy, Hale, Nelson and Gage. Council selected July 22, 1992 at 5:30 p.m. for a City of Gilroy School Board Liaison Committee Meeting at the City of Gilroy Council Chambers to discuss issues of mutual concern. City Administrator Baksa noted scheduled meetings of the South County Regional Wastewater Authority, and gave an update on the time schedule of the sewer bonds for the Wastewater Treatment Facilities. Councilman Kloecker reported that Councilman Nick Szabo, City of Cupertino, was selected as the representative of Santa Clara County Cities Association on Measure T Committee. Council requested that he be invited to meet with them at an early date. Councilman Hale noted that the Santa Clara County Cities Association is seeking volunteers for their Legislative Review Task Force Committee. The Mayor noted that he would review the City's previous actions for a response if possible.
