Motion was made by Councilman Gilroy seconded by Councilman
Valdez that the following items under the Consent Calendar be
approved as recommended by the following Roll Call Vote: Ayes:

Approved Budget Amendments/Transfers as recommended;
Adopted Ordinance No. 92-12 approving Z 91-10, rezoning
from R1 to R1-PUD approximately 48.7 Acres located at the
northwest corner of Santa Teresa Boulevard and Longmeadow Drive;

Approved the Minutes, of the Adjourned Regular Council
Meeting of July 27, 1992 as corrected (Councilman Kloecker
seconded motion approving Consent Calendar.)
At 7:06 p.m. the Fire Chief and his Staff gave their
Department Report. The Mayor reconvened the meeting at 7:48 p.m.
The Mayor noted Continued Council Action required to con-
sider a General Plan Amendment request of the City of Gilroy to
adopt a new Circulation and Air Quality Element to its General
Plan, and proposing a city-wide Traffic Impact Fee for new devel-
opment, GPA 84-01, City of Gilroy, applicant. (Public Hearing
held 6-15-92 and Council action continued to 7-27-92 and 8-3-92.)
The Staff Report and an updated Staff Report were noted,
further explained by Planning Director Dorn. Discussion was had
by Council.
Motion was made by Councilman Kloecker seconded by Council-
man Gilroy and carried that the Final EIR be certified as comple-
ted in compliance with CEQA, reflecting the Independent Judgement
of the City, and as reviewed and considered by the City Council.
Motion was made by Councilman Kloecker seconded by Council-
man Hale that the reading of Resolution No. 92-68 be waived and
that it be adopted approving the General Plan Amendment and
making CEQA Findings and adopting Mitigation Monitoring Program.
RESOLUTION NO. 92 - 68
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING
GPA 84-01, ADOPTING A NEW CIRCULATION AND AIR QUALITY ELEMENT FOR
ITS GENERAL PLAN, MAKING CERTAIN FINDINGS PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT AND ADOPTING A MITIGATION
MONITORING PROGRAM.

The Mayor continued action on the proposed city-wide
Traffic Impact Fee to the September 8, 1992 regular Council
Meeting when all Councilmembers are expected to be present.
Council concurred. Councilman Hale requested that a copy of the
right-of-way costs previously presented to Council be re-sent for
review.
Discussion was had regarding the State Budget proposals and
further updated information from Assemblyman Areias' Office by
City Administrator Protempore Dorn.
The Mayor recommended that Councilman Hale be appointed Mayor
Protempore from August 1, 1992 to April 1, 1993.
Motion was made by Councilman Kloecker seconded by Council-
man Gilroy and carried that Councilman Hale be appointed Mayor
Protempore from August 1, 1992 to April 1, 1993 as recommended.
Motion was made by Councilman Hale seconded by Councilman
Kloecker and carried that Jean McCammond be appointed as the
City's representative on the Council on Aging Advisory Board as
recommended.
The Mayor asked if there was anyone in the audience wishing
to speak on an item not on the agenda.
Mr. Mark Ebner, Project Manager of the Downtown Development
Main Street Project, addressed the Council requesting the City's
approval to accept the invitation of the State Department of
Commerce to proceed as an Independent City and further requested
that the city's funding approved under the Demonstration City
Program be allowed for the Independent City Program.
The Mayor requested that this matter be agendized for the
regular Council Meeting of August 17, 1992 for Council action at
that time.
Discussion was had on the Santa Clara County Cities
Association re: ABAG Growth Management Discussions, further
explained by Councilman Kloecker (continued from 7-27-92).
Council concurred with the recommendations of Councilman Kloecker
on the proposed amendments.
Councilman Hale noted that he concurred if ABAG is the
regional planning body. Councilman Kloecker noted that he would
prepare a letter for the Mayor's signature on the City's
recommendations regarding the proposed amendments for review by
Council on the August 17, 1992 Council Agenda.
Appointed Councilman Kloecker as Delegate and Councilwoman
Rowlison as Alternate for the League Annual Conference October
10-13, 1992.

Noted an update on 1992 Water Usage.
The Mayor distributed souvenirs to Councilmembers from the
Chinese delegation attending the Garlic Festival. He noted that
the Japanese and Chinese Delegations presented the City with
gifts that will be framed for City Hall after the construction
project is completed.
The Mayor requested that pin-type name tags be ordered for
Councilmembers to wear when representing the City at meetings,
conferences, etc.
Councilmembers Gilroy and Rowlison reported on the recent
League of California Cities Executive Forum they attended in
Monterey.
Councilman Gilroy announced the First Annual Asphalt Bazaar
on Forest Street August 8, 1992.
