The Mayor led the Pledge of Allegiance to the Flag.
Pastor Roger Wisdom, Grace Evangelical Church gave the
Invocation.
The City Clerk noted that the Agenda had been posted on
September 3, 1992 at 9:09 a.m.
Present: Councilmembers: Mike Gilroy, Leonard A. Hale, Paul
V. Kloecker, Sara C. Nelson, Suellen C. Rowlison, Pete Valdez Jr.
and Donald F. Gage.
The Mayor introduced new employees: Minoo Borhanmojabi,
Junior Staff Account and Greg Kossob, Public Works Maintenance I,
Water Department.
The Mayor presented Mary Callahan, retiring reporter from
the Gilroy-Morgan Hill Dispatch Newspaper with a Certificate of
Appreciation.
Motion was made by Councilman Kloecker seconded by Council-
man Hale that the following items under the Consent Calendar be
approved as recommended by the following Roll Call Vote: Ayes:
Councilmembers: Mike Gilroy, Leonard A. Hale, Paul V. Kloecker,
Sara C. Nelson, Suellen C. Rowlison, Pete Valdez, Jr. and Donald
F. Gage;
Minutes of the Regular Council Meeting of August 3, 1992;
Minutes of the Regular Council Meeting of August 17, 1992;
Approved Budget Amendments/Transfers as recommended;
Denied the following Claims as recommended: Jeanne Calabro
and Mike Aceves; and
Minutes of the Regular Council Meeting of August 24, 1992.
The Mayor deviated from the regular order of the agenda in
order to accommodate interested persons in the audience.
The Mayor stated that it was the time and place scheduled
for a Public Hearing to establish numerical limits of dwelling
units to be permitted under the requirements of the City of
Gilroy'S Residential Development Ordinance for a ten year period.
The Staff Report was noted and further explained by Senior
Planner Myer.
Correspondence from local residents was noted.
The Mayor asked if there was anyone in the audience wishing
to speak on the matter. The following addressed the Council:
Wayne Young, Chairman of the Growth Task Force Committee,
7115 Concord Place explaining the reasoning of the Committee's
recommendations regarding numerical limits of 450 per year.
John Rottler, Sports Connection on behalf of Ace Hardware
requesting Council accept the recommendation of the Task Force of
450 per year.
Maureen Anderson, 1615 Brentwood Lane, owner of Hecker Pass
Florist, presenting petitions and supports the recommendation of
the Task Force Committee.

John Locastro, 15200 Watsonville Rd., Morgan Hill, works in
Gilroy and noted that the businesses depend on new homes, new
construction and growth.
David Collier, 1291 Hersman Drive suggests a percentage
policy growth rate be established and compounded, urging 2.75%
growth rate.
Joan Harrison, 7525 Kentwood Court, suggesting a ballot
measure, noting that the citizens want low growth.
Don Santana, 5570 Kern Court, works at Gavilan College
presented a petition containing 23 signatures, requesting 75 new
homes per year and urging Council not to increase the number of
homes without increasing the individual tax base.
Rick Mello, 7330 Orchard Drive, urging pro-growth.
Dave Bouchard, President of the Chamber of Commerce urging
adopting the Task Forces' recommendation.
Connie Rogers, 7690 Santa Theresa Drive, requesting Council
to choose a number substantially less than 450 per year, noting
that 90% of the people would be satisfied with 200 units per year
and noting the SRI poll to be much less than 450 per year.
Pat Vickroy, 10275 Lucky Court recommending that a decision
be made for quality of life for all.
steve Valencia, 8417 Carmel Street noting that the schools
would be required to establish double-sessions with growth and
urged pro-slow growth.
Todd Perkins, 1176 Peterson Drive, a member of the Task
Force Committee recommending 3000 units over a 10 year period.
Harold Lowney, representing the Plumbers & Steam Fitters
Local of Santa Clara and San Benito Counties' recommending
approval of the Task Forces' recommendation.
Elaine Long, 7580 Westwood Dr., recommending that the City
maintain the level of quality of life that the residents now have
and recommended 2.2% growth rate or 200 per year.
Mark Lazzarini, representing the Building Industries
Association and recommending approval and support of the Growth
Task Forces' recommendation.
Miguel Paredes, 7781 Church Street, in support of pro-
growth and approval of the Task Forces' recommendations.
Carolyn Tognetti, 820 Carignane Dr., opposed to 450 units
per year recommending 150 units per year or slow growth.
John Neece, representing the Building Construction Trades
Council recommending 450 units per year in support of the Task
Forces' recommendation.
Mr. John Locastro further addressed the Council noting that
construction supplies are purchased from Gilroy businesses.
Kathleen Chavez, 7177 Saratoga Place, member of the Task
Force Committee noting that the school impact fees are too low
and is opposed to the 450 units per year.
Bob Dyer, primarily in commercial and industrial develop-
ment and sales noting that there is not sufficient affordable
housing in Gilroy to attract these types of businesses.
At 9:02 p.m. the Mayor declared a five minute recess and
reconvened the meeting at 9:10 p.m.

Cal Le Neave, Morey Ave. (Santa Teresa Blvd.) recommending
support of the Task Forces' recommendation of 450 units per year.
Frank Romero, 6400 Sussex Place, member of the Task Force
urging acceptance of the Task Forces' recommendation.
Dr. Joe Caldwell, 790 Lawrence Drive, First Baptist Church
noting that he is not afraid of growth in the City of Gilroy.
Hearing no further comments the Mayor closed the Public
Hearing. Discussion was had by Council on the matter.
Motion was made by Councilman Hale seconded by Councilwoman
Nelson and failed by the following Roll Call Vote to approve 450
units for the first five years and 400 units for the second five
year period for a total of 4000 units in ten years: Ayes:
Councilmembers: Hale, Nelson and Gage; Noes: Councilmembers:
Gilroy, Kloecker, Rowlison and Valdez.
Motion was made by Councilwoman Rowlison and not seconded
to approve 350 units per year or 1750 - five year maximum goal
and 3500 - ten year goal.
Motion was made by Councilman Gilroy and not seconded to
approve 360 units per year or 1800 units for the first five years
and 440 units for the second five years or 4000 units maximum in
ten years.
Res.92-72 Motion was made by Councilman Gilroy seconded by Councilman Hale
that the reading of Resolution No. 92-72 be waived and that it be
adopted approving 1900 units for the first five years (calculated at
380 units for the first five years) and 2100 units for the second five
years (calculated at 420 units for the second five years), totalling
maximum units of 4000 units in ten years.

RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING
NUMERICAL LIMITS FOR RESIDENTIAL DWELLING UNITS TO BE ISSUED
BUILDING PERMITS FOR A TEN YEAR GOAL.
PASSED AND ADOPTED this 8th day of September, 1992, by the
following vote:
AYES: COUNCILMEMBERS: GILROY, HALE, NELSON and GAGE
NOES: COUNCILMEMBERS: KLOECKER, ROWLISON and VALDEZ

At 10:39 p.m. the Mayor declared a five minute recess and
reconvened the meeting at 10:49 p.m.
Motion was made by Councilman Hale seconded by Councilwoman
Nelson to begin the numerical limits in 1994 (five year goal
through 1998; second five years 1999 through 2003). Councilman
Hale withdrew the motion and Councilwoman Nelson withdrew the
second to the motion and tabled action on the matter to the
September 28, 1992 regular Council Meeting. Council requested
that the matter be reagendized to set the yearly numerical
limits; starting year; consider other recommendations of the
Growth Task Force; and sewer allocation carry-overs for the
september 28, 1992 regular Council Meeting.
The Mayor continued with the regular order of the Agenda.

Garb. Rates
The Mayor stated that it was the time and place scheduled
for a Public Hearing to consider revisions and adjustments of
charges for the collection of garbage, rubbish and refuse in the
City of Gilroy to reflect the new AB 939 Fee.
The Report and recommendation of South Valley Refuse
Disposal, Inc. was noted.

Motion was made by Councilman Kloecker seconded by
Councilwoman Rowlison that the reading of Resolution No. 92-73 be
waived and that it be adopted approving garbage rate revisions
and adjustments as presented.

Discussion was had on proposed City-wide Traffic Impact
Fees further explained by City Administrator Baksa.
The proposed fees were noted that included seven railroad
overpasses; two railroad overpasses and zero overpasses.
Motion was made by Councilwoman Nelson seconded by
Councilman Hale and carried to direct Staff to prepare an
ordinance for proposed City-wide Traffic Impact fees that would
not include construction of any railroad overpasses. Council-
members: Kloecker, Rowlison and Valdez voted "no" on the motion.
Council continued the request of Peter Baez regarding City
Code restrictions on keeping animals and fowl in the City to the
October 5, 1992 regular Council Meeting.

The Report of the Planning Commission Meeting of September
3, 1992 was noted.
The Minutes of the Gang Task Force Meeting of August 26, 1992
were noted.
The Minutes of the Handicapped Appeals Board Hearing and
Study Session of August 24, 1992 were noted.
An update on the Water Conservation Program was noted.
City Administrator Baksa recommended tabling action on a
request for a letter in support of the Main Street Program as an
Independent City category until the budget issue is finalized.
City Administrator Baksa presented and explained a 1992
Sewer Plant Dry Weather Flow Report. Motion was made by
Councilwoman Kloecker seconded by Councilwoman Rowlison and
carried that the sewer allocations as recommended be approved,
specifically 2,700 gpd for Residential Infill; 20,000 gpd for
Commercial/Industrial; and 27,500 for Assessment Districts as
presented.
City Administrator Baksa noted Ground-breaking Ceremonies
for construction of the new Wastewater Facility Project.
City Administrator Baksa distributed a League of California
Cities Bulletin regarding the State Budget issue and effects on
the City's revenues.
Council set September 29, 1992 at 7:00 p.m. for a Study
Session regarding continued discussion of Storm Drain
utilities/Curb-Gutter Issues, to be televised.
City Administrator Baksa noted that it is uncertain at this
time whether a Study Session on the City's budget will be
necessary.
The City Attorney noted that SB 161 was a dead issue for
this legislative session, and noted the Kopp Bill (Brown Act)
passed the legislature with amendments and will be effective
January 1, 1993. Councilman Gilroy suggested that a strong
letter in opposition be forwarded our legislators regarding the
enactment of this bill.
The Mayor noted an invitation from the Sister City of China
to their Celebration of Confucius September 26th to October 10,
1992.
Councilman Gilroy noted that he would be late for the
September 9th Study Session because he would be attending an Air-
port Land Use Commission Meeting.
Councilman Hale noted the Santa Clara County Cities
Association meeting in Los Gatos on September 24, 1992.
