The City Clerk noted that the Agenda had been posted on October 22, 1992 at 10:30 a.m. Present: Councilmembers: Mike Gilroy, Leonard A. Hale, Paul V. Kloecker, Sara C. Nelson, Suellen C. Rowlison, Pete Valdez Jr. and Donald F. Gage, 7:00 p.m. Motion was made by Councilman Kloecker seconded by Council- man Hale that the following items under the Consent Calendar be approved by the following Roll Call Vote: Ayes: Councilmembers: Mike Gilroy, Leonard A. Downtown Main St.Prog. Approved Budget Amendments/Transfers as recommended; and Accepted Improvements for Project 92-PW-106, Aeration Pond Sludge Removal as recommended. Noted Council action scheduled on GPA 90-04 from Rural Residential to Low Density Residential, on property located west of Santa Teresa Boulevard, south of Uvas Creek, on approximately 129 acres, Shapell Industries & Filice Family Estates/Filice Estate Vineyards, applicants and pre zoning from County Agriculture to Residential Hillside (PH) and Single Family Residential-Planned Unit Development (R1-PUD), on approximately 882 acres, on property located on the westerly side of Santa Teresa Boulevard from Uvas Creek, and south, approximately 23,000 feet, Shapell Industries and the Glen Loma Group Applicants, Z 90-10, noting the Public Hearings were held October 5, 1992 and Council action continued from October 19, 1992. Senior Planner Myer gave an update on the hearings held. Discussion was had by Council. Motion was made by Councilwoman Nelson and died for lack of a second to adopt a resolution approving GPA 90-04 as presented. Discussion was had by Council. Motion was made by Councilman Kloecker seconded by Councilman Valdez and carried that a sentence be added to the mitigation measures to require the developers to provide a mitigation plan on or before application of a Tentative Map. Motion was made by Councilwoman Nelson seconded by Councilwoman Rowlison that the reading of Resolution No. 92-79 be waived and that it be adopted approving the General Plan amendment to include the additional mitigation measure, Adopting a Statement of Overriding Considerations and Making CEQA Findings and Adopting Mitigation Monitoring Program. RESOLUTION NO. 92 - 79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING GPA 90-04, AMENDING THE GENERAL PLAN MAP TO CHANGE THE DESIGNATION FROM RURAL RESIDENTIAL TO LOW DENSITY RESIDENTIAL ON APPROXIMATELY 129 ACRES LOCATED WEST OF SANTA TERESA BOULEVARD, SOUTH OF UVAS CREEK, MAKING FINDINGS UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AND ADOPTING A STATEMENT OF OVERRIDING CONSIDERATIONS AND A MITIGATION MONITORING PROGRAM. PASSED AND ADOPTED this 26th day of October, 1992, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: GILROY, HALE, KLOECKER, NELSON, ROWL I SON , VALDEZ and GAGE COUNCILMEMBERS: None COUNCILMEMBERS: None; Motion was made by Councilwoman Nelson seconded by Councilman Hale and unanimously carried that the ordinance be read by title only and waive further reading of the ordinance. Motion was made by Councilwoman Nelson seconded by Council- woman Rowlison and carried that the ordinance be introduced approving the Pre zoning (Z 90-10) to be published by title and summary. The Mayor recommended the appointment of Kai S. Lai as Planning Commissioner to fill the unexpired term of Mike Brem (1- 1-93) and an additional full term, expiring January 1, 1997. Mr. Mark Ebner, representing the Gilroy Downtown Develop- ment Corporation, addressed the Council regarding the Downtown Main Street Program requesting the City commitment of the same funding that was previously approved for the project as a Dependent City category, noting nothing has changed except the P.& R.Com. project would receive limited assistance from the Department of Commerce under the Independent City category. Mr. Ernie Olivares, representing the Hispanic Chamber of Commerce and Mary Jenny, member of the Gilroy Downtown Development Corporation addressed the Council giving an update on the GDDC activities. Mr. Carmen Filice, addressed the Council further giving an update on complaints received at GDDC, requesting continued support from the City. Mr. Dave Bouchard, President of the Chamber of Commerce, addressed the Council noting the strategic Plan for Economic Development, presented to Council at their October 5, 1992 regular meeting, noting that one of the priorities was revitali- zation of downtown and he urged full support to GDDC. Councilman Gilroy requested specific accounting for the $30,000.00 promotion budget item. The Mayor requested the GDDC forward copies of the minutes of their meetings to Council for an update on their progress and requested Council give any concerns of the Downtown Mainstreet Project to Councilman Hale (City's representative on GDDC) in order to reagendize the matter on the November 16, 1992 Council agenda to address Council's concerns at said meeting. The following informational items were noted with no separate discussion on same except as noted: Customer Service: Wildlife Education & Rehabilitation Center in appreciation; and Inter-Office Memo of appreciation; Minutes of the Visitors' Bureau Advisory Council Meeting of September 10, 1992; Santa Clara Valley Water District Public Hearing November 5, 1992 - 7:30 p.m., City of Morgan Hill, Civic Center Building, 17555 Peak Avenue, Morgan Hill; United Veterans' Council of Santa Clara County Invitation to Veteran's Day Parade, November 11, 1992 and Status of the City's Long-Range Applications. The Minutes of the Parks & Recreation Commission Meetings of August 18, 1992 and September 15, 1992 were noted. The Minutes of the Library & Culture Commission Meetings of September 8, 1992 and October 13, 1992 were noted. The Minutes of the Senior Advisory Board Meeting of September 21, 1992 were noted. City Administrator Baksa noted a City Council/School Liaison Committee Meeting scheduled for November 5, 1992 - 5:30 p.m. (subsequently set for 5:45 p.m.). Council requested that the Council Study Session of November 30, 1992 re: Violent Crime Rate Issues be televised. City Administrator Baksa requested a five minute meeting following adjournment with the Council Sub-Committees on the Council Retreat and South County Regional Wastewater Authority. Councilman Hale reminded Councilmembers of the Santa Clara Cities Association appointments scheduled for next week if any Councilmember is interested. Councilman Hale gave an update on the Santa Clara County General Plan Review Committee.
