Present: Councilmembers: Mike Gilroy, Leonard A. Hale, Paul
V. Kloecker, Sara C. Nelson, Suellen C. Rowlison, Pete Valdez,
Jr. and Donald F. Gage.
The Mayor stated that the Public Hearing to consider the
1992 Residential Development Ordinance Applications was held June
6, 1993 and Council deliberations and/or action on same was
continued to this Regular Adjourned Meeting.
City Administrator Baksa explained the Staff Report.
Discussion was had by Council on the following RDO issues
and the following consensus of the Council is noted:
1. How to Handle Future Changes in the Projects. To be
discussed in the future.
2. Performance-based Allocations (Future)/Tailored
Contracts. To be discussed in the future.
3. Define Existing Infrastructure. Legal definition only
to be discussed at this meeting.
4. Affordable Housing. To be discussed at this meeting.
5. Revisit Criteria (Prior to 1995 Competition). To be
discussed in the future.
6. Direction of Growth. To be discussed in the future.
Deputy City Attorney Cumpston gave a legal interpretation
of the City'S obligations regarding infrastructure.
It was the general consensus of the Council that substan-
tial or significant infrastructure should be given a higher
ranking and priority in allocation of the RDO build-out; and that
RDO 92-23 would then be in a higher ranking.
Discussion was had regarding Affordable Housing and on the
letter presented from California Rural Legal Assistance. Deputy
City Attorney Cumpston noted that a developer had no vested
rights by gaining a build-out allocation. It was noted that low-
income housing projects are exempt from the RDO process.
Councilman Valdez suggested that the Council set aside 45
allocations in each year for low-income housing. It was noted by
Deputy City Attorney Cumpston that exempt projects are only
tabulated in the totals at the five and ten year goals and not
annually.
It was the consensus of the Council to not change low-
income housing in the RDO process. Councilmembers Kloecker and
Valdez disagreed.
Planning Director Dorn noted that the City has a Resolution
that defines affordable housing.
It was noted that the Chamber of Commerce is in the process
of studying definition of affordable housing to be presented to
Council.

It was further noted by Planning Director Dorn that the
City has been waiting to adopt the Housing Element pending
certification by the state which the State will not do until the
City completes the allocation process.
Discussion was had on the back-log of allocations.
It was unanimously agreed that projects that still have a
backlog should not wait until the backlog is used before they are
assigned a build-out.
It was unanimously agreed that projects with a backlog
should have the start date delayed.
It was agreed by a majority of the Council that the delay
not be until the backlog is used up; case by case determination
and unanimously agreed that performance of backlog is to be in-
cluded in the agreement contract of future allocations. Planning
Director Dorn noted that a model contract would be provided
Council for review and that same would be similar to the sewer
allocation agreements.
Discussion was had on Multi-Year Build-out.
It was unanimously agreed that projects that have build-out
scheduled over multiple years not be limited to a certain number
of years of allocation; keep flexibility to award allocations
between 0-10 years.
It was agreed that percentage of the future year limit that
can be assigned out, to be on a case by case basis.
Discussion was had on Safety Zones and projects being
beyond the rapid response area from a fire station. A majority
of the Council agreed that projects beyond the rapid response
area from a fire station not be restricted. Councilmembers
Kloecker, Valdez and Rowlison disagreed.
Discussion was had regarding adjourning this meeting. At
10:14 p.m. the Mayor adjourned the meeting to Wednesday, June 16,
1993 at 7:00 p.m. (Council agreed to cancel the previously
scheduled date of June 17, 1993 to accommodate Councilman Valdez,
unable to be present at said meeting.)
