Minutes 1993/06/16 Regular Adjourned Meeting June 16, 1993 Gilroy, California The Mayor led the Pledge of Allegiance to the Flag. Posting Agenda The City Clerk noted that the Agenda had been posted on June 15, 1993 at 8:40 a.m. (Notice of Adjourned Meeting also posted June 15, 1993 - 8:40 a.m.) Roll Call Present: Councilmembers: Mike Gilroy, Leonard A. Hale, Paul V. Kloecker, Suellen C. Rowlison, Pete Valdez, Jr. and Donald F. Gage; Absent: Councilmember: Sara C. Nelson. RDO The Mayor stated that the Public Hearing to consider the 1992 Residential Development Ordinance applications was held June 6, 1993 and Council deliberations and/or action on same was if ~ ; -, ~ '~ -f l.....! ;:; continued to June 14, 1995 and further continued to this Regular Adjourned Meeting. Planning Director Dorn gave an update on the information distributed to Council: He noted the requested change in the build-out for Arcadia Development; correspondence from Albert Fortino and Farotte Construction and the new Amended Build-out Requested Phasing Plans, dated June 16, 1993 - #2. Councilman Valdez requested future discussion regarding the Safety Zone Issue. At 9:08 p.m. Councilwoman Nelson entered and took her seat at the Council table. Planning Director Dorn suggested Council obtain a consensus on the projects to receive a build-out and then proceed with issuing build-out to the individual projects. Discussion was had by Council whether or not they wished to allocate build-outs beyond 1995. It was suggested that Staff and developers meet and recommend to Council mJ.nJ.ffium number of build- outs needed and length of time needed to proceed through the system. Motion was made by Councilwoman Nelson seconded by Council- man Gilroy and carried that the projects as identified on Page 4 of the 1992 RDO Buildout Worksheets - In Numerical Order be accepted to include RDO 92-23 for a preliminary of 5 years allow- ing the numbers to be worked out by Staff and developers; gross numbers to be set by consensus of the Council (1994 Numerical limits at 200); Ayes: Councilmembers: Gilroy, Hale, Nelson and Gage; Noes: Councilmembers: Kloecker, Rowlison and Valdez. Discussion was had regarding the annual numerical limits for five years. Motion was made by Councilwoman Nelson seconded by Councilman Gilroy and failed by the following Roll Call Vote to set the annual numerical limits for 5 years at 315 beginning with 1995 through 1998: Ayes: Councilmembers: Hale and Nelson; Noes: Councilmembers: Gilroy, Kloecker, Rowlison, Valdez and Gage. Motion was made by Councilwoman Nelson seconded by Councilman Hale by the following Roll Call vote to set the annual numerical limits beginning with 1995 through 1998 at 300: Ayes: Councilmembers: Hale, Nelson and Gage; Noes: Councilmembers: Gilroy, Kloecker, Rowlison and Valdez. Motion was made by Councilman Gilroy seconded by Councilwoman Rowlison by the following Roll Call vote that the annual numerical limits for 1995 through 1998 be set at 275: Ayes: Councilmembers: Gilroy, Hale, Nelson, Rowlison and Gage; Noes: Councilmembers: Kloecker and Valdez. It was noted by Deputy City Attorney Cumpston that the resolution required for the RDO applications could not be prepared until the numbers are agreed upon by the Staff and Developers. Discussion was had on the 1993 Applications and June 30, 1993 deadline date. Motion was made by Councilwoman Nelson seconded by Councilman Hale and carried that the current RDO applications due June 30, 1993 will be rolled over with a window to extend the deadline for thirty days after Council approves amendments for the next competition and noted that this is not precedent setting for future years competitions. Adjrnmt. Motion was made by Councilwoman Nelson seconded by Councilman Hale by the following Roll Call vote to allow Staff to extend the numbers at 420 annual maximum in each of the second five years (1999-2003) for developers in the system, up to 50% allotment if they need additional years to complete their projects with Council to review and adjust the numbers as the RDO applications are reviewed annually, noting that this is a planning 'tool only: Ayes: Counci1members: Gilroy, Hale, Nelson, Rowlison'and Gage; Noes: Councilmembers: Kloecker and Valdez. The Mayor noted video tapes from the League of California qities regarding state prescription for change. City ~dministrator Baksa requested that he approve same prior to viewing on C~annel 34.
